BONDED LABOURSYSTEM*(ABOLITION) RULES,1976

Inexerciseofthepowersconferredbysub-section(1),readwithsub-section(2)ofsection26oftheBondedLabourSystem(Abolition)Act,1976(19of1976),theCentralGovernment hereby makes the following rules,namely:-

  1. Shorttitleandcommencement-(1)TheserulesmaybecalledtheBondedLabourSystem(Abolition)Rules,1976.

(2)TheyshallcomeintoforceonthedateofpublicationintheOfficialGazette.

2.Definitions

In these rules, unless the context otherwiserequires:-

(a)”Act”meanstheBondedLabourSystem(Abolition)Act,1976(19of1976);(b)”DistrictVigilanceCommittee”meansaVigilanceCommitteeconstituted

foradistrictundersub-section(1)ofsection13;(c)”Section” means a section of theAct;

(d)”Sub-DivisionalVigilanceCommittee”meansaVigilanceCommitteeconstitutedforasub-divisionundersub-section(1)ofsection13.

3.TermsofOffice,andvacationofseat,ofmembersofDistrictVigilanceCommittee

-1[(1)EverymemberofaDistrictVigilanceCommittee,nominatedunderclauses(b),(c),

(d)and(e)ofsub-section(2)ofsection13shallholdofficeforaperiodoftwoyearsfromthedate onwhichhisnominationisnotifiedintheOfficialGazetteandshall,ontheexpiryofthesaidperiod,continuetoholdofficeuntilhissuccessorisnominatedandshallalsobeeligibleforre-nomination.]

(2)Everymemberreferredtoinsub-rule(1)-2[(a)may,begivingnoticeinwritingofnotlessthan30days,totheauthoritywhichnominatedhim,resignhisofficeandonsuchresignation being accepted or on the expiry of the notice period of 30 days, whicheverisearlier,shallbedeemedtohavevacatedhisoffice;]

(b)shallbedeemedtohavevacatedhisoffice-(i)ifhefailstoattendthreeconsecutivemeetingsoftheDistrictVigilanceCommitteewithoutobtainingleaveoftheChairmanofsuchabsence:

Provided that the authority, which nominated him may, if it is satisfied thatsuchmemberwaspreventedbysufficientcausefromattendingthethreeconsecutivemeetingsoftheCommittee,restorehimtomembership;

(ii)ifhebecomessubjecttoanyofthefollowingdisqualifications,namely:-

(1)is adjudged insolvent;

(2)is declared to be of unsound mind by a competentcourt;

(3)is convicted of an offence which, in the opinion of the authority,whichnominated him, involvesturpitude;

(c) may be removed from office, if the authority, which nominatedsuchmembers,isoftheopinionthatsuchmemberhasceasedtorepresenttheinterestto represent which he was nominated:

Providedthatamembershallnotberemovedfromofficeunderthisclauseunless a reasonable opportunity is given to him for showing cause againstsuch removal.

(3)Amember,nominatedtofillacasualvacancyshallholdofficefortheunexpiredportionofthetermofhispredecessor.

4. Terms of Office, and vacation of seat, of members of Sub-DivisionVigilanceCommittees-1[(1)EverymemberofaSub-DivisionVigilanceCommittee,nominatedunderclauses(b),(c),(d)and(e)ofsub-section(3)ofsection13shallholdofficeforaperiodoftwoyearsfromthedateonwhichhisnominationisnotifiedintheOfficeGazetteandshall,ontheexpiryofthesaidperiod,continuetoholdofficeuntilhissuccessorisnominatedandshallalsobeeligibleforre-nomination.]

(2)Everymemberreferredtoinsub-rule(1)

1[(a)may,begivingnoticeinwritingofnotlessthan30days,totheauthoritywhich nominated him, resign his office and, on such resignation beingacceptedor on the expiry of the notice period of 30 days, whichever is earlier, shall be denied to have vacant hisoffice.]

(b)shall be deemed to have vacated his office — (i) if he fails t o attendthreeconsecutivemeetingsoftheSub-DivisionalVigilanceCommitteewithoutobtainingoftheChairmanofsuchCommitteeforsuchabsence:

Provided that the authority which nominated him may, if it is satisfied thatsuchmember was prevented by sufficient cause from attending threeconsecutive meetingsoftheCommitteerestorehimtomembership:

(ii)ifhebecomessubjecttoanyofthefollowingdisqualifications,namely:—

(1)is adjudgedinsolvent;

(2)is declared to be of unsound mind by a competentcourt;

(3)isconvictedofanoffencewhich,intheopinionoftheauthority,which

nominatedhim,involvesmornalturpitude;

(c)mayberemovedfromoffice,iftheauthoritywhichnominatedsuchmember,isoftheopinionthatsuchmemberhasceasedtorepresenttheinteresttorepresent which he wasnominated:

Provided that a member shall not be removed from office under thisclauseunless a reasonable is given to him for showing cause against suchremoval.

(3)Amembernominatedtofillacasualvacancyshallholdofficefortheunexpiredportionofthetermofhispredecessor.

  1. Prescribedauthorityundersub-section(6)ofsection6-Anapplicationundersub-section(6)ofsection6forrestorationofpossessionofanypropertyreferredtoinsub-section(4)orsub-section(5)ofthesectionshallbemadetotheExecutiveMagistrate,onwhomthepowersofaJudicialMagistrateofthefirstclassorofthatsecondclasshavebeenconferredundersub-section(1)ofsection21,andwithinthelocallimitsofwhosejurisdictionthesaidpropertyis,ortheapplicanthasreasontobelieveis,situatedatthetimeofmakingtheapplication:

ProvidedthatwheretherearetwoExecutiveMagistrates,ononeofwhomthepowers ofaJudicialMagistrateofthefirstclassandontheotherthepowersofaJudicialMagistrate of the second class have been conferred under sub-section (1), section21havingjurisdictiontoentertaintheapplicationforrestorationofpossessionofpropertyreferredtoinsub-rule(1),theapplicationshallbemadetotheExecutionMagistrateonwhom the powers of a Judicial Magistrate of the second class have beenconferred.

  1. Time within which an application under sub-section (6) is to be made -Anapplicationundersub-section(6)ofsection6forrestorationofpossessionofanyproperty referred to in sub-section (4) or sub-section (5) of that section shall bemadewithinaperiodofninetydaysfromthedateonwhichtheserulescomeintoforce.
  1. RecordstobemaintainedbyDistrictVigilanceCommitteestoensuretheimple- mentationoftheprovisionsoftheActandRules-InordertoensuretheimplementationoftheActandtheRulesevery,DistrictVigilanceCommitteeshallmaintainthefollowingregistersinrespectoffreedbondedlabourwithinthelocallimitsofitsjurisdiction,namely:-

(a)a register containing the names and addresses of freed bondedlabour;

(b)a register containing statistics relating to the vocation, occupationandincome of every freed bondedlabour;

(c)aregistercontainingdetailsofthebenefitswhichthefreedbondedlabour

arereceiving,includingbenefitsintheformofland,inputsforagriculture,

traininginhandicraftsandalliedoccupations,loansatdifferentialratesofinterest or employment in urban or non-urbanareas;

(d)aregistercontainingdetailsofcasesundersub-section(6)ofsection6,sub-section(2)ofsection8,sub-section(2)ofsection9,section16,section17,section 18, section 19 and section20.

THE EQUAL REMUNERATION RULES,1976

CHAPTERII COMPLAINTSANDCLAIMSUNDERTHEACT

  1. ComplaintsregardingcontraventionoftheAct-(1)Everycomplaintunderclause

(a)ofsub-section(1)ofsection7shallbemadeintriplicate.inForm‘A’totheAuthority.

(2)Asinglecomplaintmaybemadeby,oronbehalfof,orinrelationtoagroupofworkers,iftheyareemployedinthesameestablishmentandthecomplaintrelatestothesamecontravention.

(3)A complaint may be made by the worker himself or herself or by anylegalpractitioner,orbyanyofficialofaregisteredTradeUnion,authorisedinwritingtoappearandactonhisorherbehalforbyanyInspectorappointedundersection9orbyanyotherperson acting with the permission of theAuthority.

  1. Claimregardingnonpaymentofwages,etc.-(1)Everyclaimunderclause(b)ofsub-section(1)ofsection7shallbemadebypetitionintriplicate.inFormBtotheAuthority.

(2)A single petition may be made by or on behalf of, or in relation to, a groupofworkers,iftheyareemployedinthesameestablishmentandtheirclaimsareofthesamenature.

(3)Aclaimmaybemadebytheworkerhimselforherselfofbyanylegalpractitioner,orbyanyofficialofaregisteredtradeUnion,authorisedinwritingtoappearandactonhis or her behalf or by any Inspector appointed under section 9 or by any otherpersonacting with the permission of theAuthority.

Inexerciseofthepowersconferredbysection13oftheEqualRemunerationAct.1976(25 of 1976) the Central Government hereby makes the following rules, namely:-

  1. (1)TheserulesmaybecalledtheCentralAdvisoryCommitteeonEqualRemuneration Rules,1991.

(2)TheyshallcomeintoforceonthedateoftheirpublicationintheOfficialGazette.

  1. Definitions-(1)Intheserulesunlessthecontextotherwiserequires:-

(a)CommitteemeanstheCentralAdvisorycommitteeconstitutedbytheCentralGovernment under sub-section (1) of section 6 of the Equal RemunerationAct,1976(25of1976);(b)ChairmanmeanstheChairmanoftheCommittee.

  1. CompositionoftheCommittee-TheCommitteeshallconsistofnotlessthantenpersonsandnotmorethantwentypersonsexcludingtheChairman,tobenominatedbytheCentralGovernment,ofwhichone-halfshallbewomen.NominationshallbemadefromamongsttherepresentativesoftheCentralGovernment,StateGovernments/Union,TerritoryAdministrations,MembersofParliamentEmployersOrganisations,EmployeesOrganisations and Non Governmental Organisations engaged in the study andwelfareactivitiesofwomenlabour.Thecompositionofthecommitteeshallnotbeinvalidforthereasonthatrepresentativebelongingtoanyoftheaforesaidcategorieshasnotbeenincluded in thecommittee.
  1. TermsofofficeofmembersoftheCommittee-(1)Saveasotherwiseexpresslyprovidedintheserules,thetermofofficeofanon-officialmembersofthecommitteeshallbe two years from the date of hisnomination:

Providedthatsuchmembershall,notwithstandingtheexpiryofthesaidperiodoftwo years, continue to hold office until his successor isnominated.

(2)Anon-officialmemberofthecommitteenominatedtofillacasualvacancyshallholdofficefortheremainderperiodofthetermofofficeofthememberinwhoseplaceheisnominated.

(3)TheofficialmemberofthecommitteeshallholdofficeduringthepleasureoftheCentralGovernment.

  1. Allowancesofmembers-(1)Thetravellingallowancesofanofficialmembershallbe

governedbytherulesapplicabletohimforjourneyperformedbyhimonofficialdutiesandshall be paid by the authority paying hissalary.

(2)Thenon-officialmembersoftheCommitteeshallbepaidtravellingallowanceforattending the meeting of the Committee, at such rates as rate admissible to Group‘A’officersoftheCentralGovernmentanddailyallowancesshallbecalculatedatthemaximumrateadmissibletoGroup‘A’officersoftheCentralGovernmentintheirrespectiveplaces.

  1. Cessationofmembership-IfanymemberofCommitteenotbeinganex-officiomemberoftheCommittee,failstoattendthreeconsecutivemeetingsoftheCommittee,withoutobtainingtheleaveoftheChairmanforsuchabsence,heshallceasetobeamemberoftheCommittee:

ProvidedthattheChairmanmay,ifheissatisfiedthatsuchmemberwaspreventedbysufficientcausefromattendingthreeconsecutivemeetingsoftheCommitteewithoutobtainingsuchleave,directthatsuchcessationshallnottakeplaceandonsuchdirectionbeingmade,suchmembershallcontinuetobememberoftheCommittee.

  1. Disqualification for membership - (1) A person shall be disqualified forbeingnominatedas,andforbeing,amemberoftheCommitteeifhe:-

(i)is of unsound mind and stands so declared by a competent court ;or

(ii)is an undischarged insolvent; or

(iii)hasbeenorisconvictedofanofficewhich,intheopinionoftheCentralGovernment involves moralturpitude.

(2)If a question arises as to whether a disqualification has been incurredundersub-rule(1),theCentralGovernmentshalldecidethesame.

  1. Comments

InexerciseofpowersconferredbySubsection(6)ofSection7oftheEqualRemunerationAct,1976(ParliamentAct25of1976)andallotherpowersenablinghiminthisbehalf,theGovernorof Haryana has specified the Joint Labour Commissioner, Haryana to the authority forthepurposeofthesaidsubsectionvideHaryanaGovt.LabourDepartmentnotificationNo.8048/76/22365, dated 25th August,1976.

THE HARYANA CONTRACTLABOUR (REGULATION AND ABOLITION) RULES, 1975

Inexerciseofthepowersconferredbysection35oftheContractLabour(RegulationandAbolition)Act,1970theGovernorofHaryanaherebymakesthefollowingrulesnamely:-

CHAPTER-I

  1. ShortTitle-TheserulesmaybecalledtheHaryanaContractLabour(Regulationand Abolition)Rules,1975.
  1. Definitions - In these rules, unless the subject or context otherwise requires,-

(a)"Act” means the Contract Labour (Regulation and Abolition) Act,1970;

(b)"AppellateOfficer"meanstheAppellateOfficerappointedbytheStateGovernment under sub-section (1) of section15;

(c)"State Board or Board" means the State Advisory Contract LabourBoardconstituted under section4;

(d)"Chairman"meansaChairmanoftheBoard;

(e)"Committee" means a committee constituted under sub-section (1)ofsection5;

(f)"Form" means a Form appended to theserules;

(g)"Government"meanstheGovernmentoftheStateofHaryana;

(h)"Inspector" means an Inspector appointed under sub-section (1) ofsection28;and

(i)"Section" means a section of theAct.

CHAPTER-II

StateBoard

1[3. ConstitutionoftheBoard

TheStateBoardshallconsistofthefollowingmembers:-

(a)A Chairman to be appointed by theGovernment;

(b)TheLabourCommissioner,Haryana,ex-officio;

(c)OnepersonrepresentingthePublicWorksDepartmentoftheGovermentto be appointed by theGovernment;

(d)Four persons, two representing the principal employers andtwo representingthecontractorstowhomthisActappliestobeappointedbytheGovernment after consultation with such organisation, if any, of theemployersand the contractors by theGovernment;

(e)Five persons representing the employees of the contractors to whom thisAct

applies to be appointed after consultation with such organisations, if any, oftheemployees representing the respective interest recognised bythe Government.”]

  1. TermofOffice-(1)TheChairmanoftheBoardshallholdofficeforperiodofthreeyears from the date of hisappointment.

(2)ThemembersoftheBoard,referredtoinclause(c)ofrule3,shallholdoffice,during the pleasure of theGovernment.

(3)ThemembersoftheBoardreferredtoinclause(d)and(e)ofrules3shallholdofficeforaperiodofthreeyearsfromthedateoftheirappointment:

Providedthatsuchmembershallcontinuetoholdsuchofficetilltheappointmentofhissuccessor.

(4)IfamemberisunabletoattendameetingoftheBoard,theStateGovernmentorthebodywhichappointedornominatedhimmaybynoticeinwritingandsignedonit'sbehalfandbysuchmemberandaddressedtothechairmannominateasubstitute(member) who shall have all the rights of a member in respect of that meeting andanydecision taken at the meeting shall be binding on the saidbody.

  1. Resignation-AmemberoftheBoard,notbeinganex-officiomember,mayresignhisofficebyalettersignedbyhimandaddressedtotheGovernmentandonsuchresignationbeingacceptedbytheGovernment,hisofficeshallfallvacant.
  1. Cessationofmembership-IfanymemberoftheBoard,notbeinganex-officiomember failstoattendthreeconsecutivemeetingsoftheBoard,withoutobtainingtheleaveoftheChairman,heshallceasetobememberoftheBoard:

ProvidedthattheGovernmentmay,ifitissatisfiedthatsuchmemberwaspreventedbysufficientcausefromattendingthesaidmeetingsoftheBoard,directthatsuchcessationmade,shallnottakeplaceandonsuchdirectionbeingmadesuchmembershallcontinuetobeamemberoftheBoard.

  1. Removalfrommembership-TheGovernmentmayremovefromofficeanymember oftheBoard,ifinitsopinionsuchamemberhasceasedtorepresenttheinterestwhichhe purports to represent on theBoard:

Providedthatnosuchmembershallberemovedunlessareasonableopportunityisgiven to him of making any representation against proposedaction.

  1. Vacancy-(1)WhenavacancyoccursorislikelytooccurinthememberoftheBoard,the Chairman shall submit a representation to the Government and on receipt of suchrepresentation the Government shall take steps to fill thevacancy.

(2)IfanyvacancyoccursinthemembershipoftheBoardbyanyreasonwhatsoever,thevacancycausedtherebyshallbefilledbytheGovernmentbymakinganappointmentfromamongstthecategoryofpersonstowhichsuchmembersbelongedandpersonssoappointedshallholdofficefortheremainderofthetermofofficeofthememberinwhoseplace he isappointed.

  1. Staff-(1)TheGovernmentmayappointoneofitsofficialsasSecretarytotheStateBoardandappointsuchotherstaffasitmaythinknecessarytoenablestheBoardtocarryout itsfunctions.

(2)The salaries and allowances payable to the staff and the other conditionsofservice of such staff shall be such as may be decided by theGovernment.

(3)The Secretary shall-

(i)assist the Chairman in convening meeting of the Board;and

(ii)attends the meetings but shall not be entitled to vote at suchmeetings;(iii)keeparecordofminutesofsuchmeeting;and

(iv)takenecessarymeasurestocarryoutthedecisionstakenatthemeetingsof theBoard.

  1. Allowancepayabletomembers-(1)Thepaymentoftravellingallowanceanddailyallowanceofanofficialmembershallbepayableaccordingtotherulesapplicabletohimand shall be paid by authority paying hissalary.

(2) Each non-official member of the Board shall be entitled to drawtravellingallowanceanddailyallowanceforanyjourneyperformedbyhiminconnectionwiththeperformance of his duties at the rates admissible to a Grade-I Officer of theHaryanaGovernment.

  1. Disposalofbusiness-EveryquestionwhichtheBoardisrequiredtotakeintoconsiderationshallbeconsideredatameetingor,ifthechairmansodirectsbysendingthenecessarypapertoeverymemberforopinion,andthequestionsshallbedisposedof

inaccordancewiththedecisionofthemajority:

Providedthatinthecaseofequalityofvotes,theChairmanshallhaveasecondora castingvote.

Explanation-“Chairman”forthepurposeofthisruleshallincludeChairmannominatedunderrule13topresideoverameeting.

  1. Meetings - (1) The Board shall meet at such places, and at such times as maybespecified by theChairman.

(2)TheChairmanshallpresideovereverymeetingoftheBoardatwhichheispresentand in his absence a member elected by those present at the meeting shall presideoversuchmeetings.

  1. Notice of meetings and list of business - (1) Seven days notice of theproposedmeetingshallbegiventothemembers.

(2)NobusinesswhichisnotonthelistofbusinessforameetingshallbeconsideredatthatmeetingwithoutthepermissionoftheChairman.

  1. Quorum-Nobusinessshallbetransactedatanymeetingunlessatleastfivemembersarepresent:

Providedthatifatanymeetinglessthanfivemembersarepresent,theChairmanmayadjournthemeetingtoanotherdateinformingmemberspresentandgivingnoticetotheothermembersthatheproposestodisposeofthebusinessattheadjournedmeetingwhether there is prescribed quorum or not, and it shall thereupon be lawful for himtodisposeofthebusinessattheadjournedmeetingirrespectiveofthenumberofmembersattending.

  1. CommitteeoftheBoard-(1)(i)TheBoardmayconstitutesuchcommitteeforsuchpurpose or purposes as it may thinkfit.

(ii) While constituting a committee the Board may nominate one of itsmembertobetheChairmanofthatcommittee.

(2)ThecommitteeshallmeetatsuchtimesandplacesastheChairmanoftheCommitteemaydecideandthecommitteeshallobservesuchrulesofprocedureinregardto the transaction of business at its meeting as it may decideupon.

(3)Themembersofthecommitteeshallbepaidtheallowanceinaccordancewiththeprovision of rule11.

CHAPTER-III

RegistrationandLicensing

  1. Mannerofmakingapplicationforregistrationofestablishments-(1)Theappli-cationreferredtoinsub-section(1)ofsection7inrespectofestablishmentinexistencepriortothecommencementoftheserulesshallbemadeintriplicateinFormIwithin30daysofthecommencementoftheserulesandfortheestablishmentswhichcomesintoexistenceafterenforcementoftheseruleswithin15daysaftercomingintoexistencetothe registering officer having jurisdiction in thatarea.

(2)Theapplicationshallbeaccompaniedbytreasuryreceiptintokenofthepaymentof fees for the registration of theestablishment.

(3)Everyapplicationshallbeeitherpersonallydeliveredtotheregisteringofficersent to him by registeredpost.

(4)Onreceiptoftheapplication,theregisteringofficershallafterrecordingthereinthedateofreceiptbyhimoftheapplication,grantanacknowledgementtotheapplicant.

17.AACOMMENTS

(b)the maximum number of workmen employed as contract labour intheestablishment;

(c)thetypeofbusiness,trade,industry,manufactureoroccupationwhichiscarried on in theestablishment;

(d)suchotherparticularsasmayberelevanttotheemploymentofcontractlabour in theestablishment.

(3)TheRegisteringOfficershallmaintainaregisterinForm3showingtheparticulars

ofestablishmentinrelationtowhichcertificateofregistrationhavebeenissuedbyhim.

(4)If,inrelationtoanestablishment,thereisanychangeintheparticularsspecifiedinthecertificateofregistrationtheprincipalemployeroftheestablishmentshallintimatetotheRegisteringOfficerwithinthirtydaysfromthedatewhensuchchangetakesplace,the particulars of, and the reason, for suchchange.

  1. Circumstancesunderwhichapplicationforregistrationmayberejected-(1)Ifany applicationforregistrationisnotcompleteinallrespects,theRegisteringOfficershallrequiretheprincipalemployertoamendtheapplicationsoastomakeitcompleteinallrespect.

(2)Iftheprincipalemployer,onbeingrequiredbytheRegisteringOfficertoamendhisapplicationomitsorfailstodoso,theRegisteringOfficershallrejecttheapplication.

  1. AmendmentofCertificateofRegistration-(1)Where,onreceiptoftheintimationundersub-rule(4)ofrule18theregisteringofficerissatisfiedthatanamounthigherthantheamountwhichhasbeenpaidbytheprincipalemployerasfeesfortheregistrationofthe establishment is payable, he shall require such principal employer to deposit asumwhichtogetherwiththeamountalreadypaidbysuchprincipalemployerwouldbeequalto such higher amount of fees payable for the registration of the establishment andtoproduce the treasury receipt showing suchdeposit.

(2) Where on receipt of the intimation referred to in sub-rule (4) of rule 18,theregistering officer is satisfied that there has occurred a change in the particulars oftheestablishment,asenteredintheregisterinForm3,heshallamendthesaidregisteraccordingly:

Providedthatnosuchamendmentshallaffectanythingdoneoranyactiontakenoranyright,obligationorliabilityacquiredorincurredbeforesuchamendment:

ProvidedfurtherthattheregisteringofficershallnotcarryoutanyamendmentintheregisterinForm3unlesstheappropriatefeeshavebeendepositedbyprincipalemployer.

  1. Applicationforalicence-(1)Everyapplicationbyacontractorforthegrantofalicenceshall be made in triplicate in Form 4, to the licensing Officer of the area in whichtheestablishment in relation to which the is the contractor, islocated.

(2)EveryapplicationforthegrantofalicenceshallbeaccompaniedbyacertificatebytheprincipalemployerinForm5totheeffectthattheapplicanthasbeenemployedbyhimasacontractorinrelationtohisestablishmentandthatheundertakestobeboundedbyalltheprovisionsoftheActandtherulesmadethereunderinsofarastheprovisionsareapplicabletohimasprincipalemployerinrespectoftheemploymentofcontractlabour.

(3)Everysuchapplicationshallbeeitherpersonallydeliveredtothelicensingofficerorsent to him by registeredpost.

(4)Onreceiptoftheapplication,thelicensingofficershall,afterrecordingthereinthedateof receipt of the application, grant an acknowledgement to theapplicant.

(5)Everyapplicationshallalsobeaccompaniedbyatreasuryreceiptshowing- (i)the deposit of the security at the rates specified in rule 24;and

(ii)thepaymentofthefeesattheratesspecifiedinrule26(2).

21.ACOMMENTS

Inexerciseofthepowerundersection6oftheContractLabour(RegulationandAbolition)Act,1970theHaryanaGovt.hasappointedtheDeputyLabourCommissioner,(II)Haryana,Chandigarhtobe the Licensing Officer for the purpose of Chapter IV of the said Act for the whole of theStateof Haryana, vide Haryana Govt. Notification No 3946-4 Lab/76/10858, dated29.4.1976.

  1. Matterstobetakenintoaccountingrantingorrefusingalicence-Ingrantingorrefusing to grant a licence, the Licensing Officer shall take the following mattersintoaccount,namely:-

(a)whether the applicant- (i)isaminor;or

(ii)is of unsound mind and stands so declared by a competent court;or(iii)is an undischarged insolvent;or

(iv)hasbeenconvicted(atanytimeduringperiodoffiveyearsimmediatelyprecedingthedateofapplication)ofanoffencewhichintheopinionoftheGovernment,involvesmoralturpitude;

(b)whether there is an order of the Government or an award of settlement fortheabolitionofContractLabourintheestablishmentinrelationtowhichtheapplicantisa contractor; in respect of the particular type of work in the establishment for whichtheapplicant is acontractor;

(c)whetheranyorderhasbeenmadeinrespectoftheapplicantundersub-section

(1)ofsection14,and,ifso,whetheraperiodofthreeyearshaselapsedfromthedateofthatorder;

(d)24;
whethersecurityhasbeendepositedbytheapplicantattheratesspecifiedinrule

(e)whetherthefeesfortheapplicationhavebeendepositedattheratesspecifiedinrule26(2).

  1. Grantofrefusaloflicence-Onreceiptoftheapplication,thelicensingofficershallmakesuchenquiryasheconsidersnecessarytosatisfyhimselfabouttheeligibilityoftheapplicant for alicence.

(2)Wherethelicensingofficerisoftheopinionthatthelicenceshouldbegranted,heshallafteraffordingareasonableopportunitytotheapplicanttobeheardmakeanorderrejecting the application and communicate the same to theapplicant.

  1. Security-Beforealicenceisissued,anamountcalculatedattherateofRs.30/-foreachoftheworkmantobeemployedascontractlabour,inrespectofwhichtheapplicationforlicencehasbeenmade,shallbedepositedbythecontractorfordueperformanceoftheconditionsofthelicenceandforcompliancewiththeprovisionsoftheActandtherulesmadethereunder:

Providedthatwherethecontractorisacooperativesociety,theamountdepositassecurityshallbeattherateofRs.5/-foreachoftheworkmantobeemployedascontractlabour.

1[“24B.Adjustmentofsecuritydepositsincertaincases-Wheretheapplicantforthelicencewasholdingalicenceinregardtotheanotherworkandthatlicencehadexpired,thelicensingOfficer,ifheisoftheviewthatanyamountofthesecuritydepositedinrespectofthatlicenceistobedirectedtoberefundedtotheapplicantunderrule31,may,onanapplicationmadeforthatpurposeinForm6-Cbytheapplicant,adjusttheamountsotoberefundedtowardsthesecurityrequiredtobedepositedinrespectoftheapplicationforthenewlicenceandtheapplicantneeddeposit,insuchacase,onlythebalanceamounts,ifany,aftermakingsuchadjustment.

  1. TermsandConditionsofLicence-Everylicencegrantedundersub-section(1)ofsection12shallbeinform6andshallbesubjecttothefollowingconditionsnamely:

(i)the licence shall benon-transferable;

(ii)thenumberofworkmenemployedascontractlabourintheestablishmentshallnot,onanyday,exceedthemaximumnumberspecifiedinthelicence;

(iii)saveasprovidedintheserules,thefeespaidforthegrant,orasthecasemaybe,for renewal of the licence shall benon-refundable;

(iv)theratesofwagespayabletotheworkmenbythecontractorshallnotbelessthantheratesprescribedundertheMinimumWagesAct,1948(CentralActIXof1948),forsuchemploymentwhereapplicableandwheretheratehavebeenfixedbyagreement,settlement

or award, not less than the rates sofixed.

(v)(a)incasewheretheworkmenemployedbythecontractorperformthesameorsimilarkindofworkastheworkmendirectlyemployedbytheprincipalemployer of the establishment, the wage rates, holidays, hours of work andotherconditionsofserviceoftheworkmenofthecontractorshallbethesameasapplicabletotheworkmendirectlyemployedbytheprincipalemployeroftheestablishmentonthesameofsimilarkindofwork;

Providedthatinthecaseofanydisagreementwithregardtothetypeofworkthe same shall be decided by the Labour Commissioner Haryana,whose decision shall befinal;

(b)inothercasesthewagerates,holidays,hoursofworkandconditionsofserviceoftheworkmenofthecontractorshallbesuch,asmaybespecifiedinthisbehalf,bytheLabourCommissioner,Haryana.

Explanation-Whiledeterminingthewagerates,holidays,hoursofworkandotherconditionsofserviceundersub-clause(b)ofclause(v)above,theLabourCommissioner,Haryana,shallhavedueregardtothewagerates,holidays,hoursofworkandotherconditionsofserviceobtaininginsimilaremployments.

(vi)(a)ineveryestablishmentwheretwentyofmorewomenareordinarilyemployedatcontractlabour,therewillbeprovidedtworoomsofreasonabledimensionsfor the use of their children under the age of sixyears;

(b) one of such rooms shall be used as a play-room for the children and theotheras bed room for thechildren;

(c)the contractor shall supply adequate number of toys and games in the

playroom and sufficient number of cots and bedding in thesleeping-rooms;(d)the standard of construction and maintenance of the creches shall besuchasmaybespecifiedinthisbehalfbytheLabourCommissioner;

(vii)Thelicenceshallnotifyanychangeinthenumberofworkmenortheconditionsofworktothelicencingofficer;

(3)(i) If the licensing officer allows the application he shall require theapplicant

tofurnishatreasuryreceiptfortheamount,ifany,bywhichthefeesthatwouldhave been payable if the licence had been originally issued in the amendedformexceedsthefeesoriginallypaidforthelicence.

(ii)On the appointment furnishing the requisite treasury receipt in token ofthepaymentofthefee,thelicenceshallbeamendedbythelicensingofficer.

(4)Wheretheapplicationforamendmentisrefused,thelicensingofficershallrecordthe reasons for such refusal and communicate the same to theapplicant.

  1. Renewaloflicence-(1)Everycontractorshallmakeanapplicationtothelicensingofficerforrenewalofthelicencethirtydaysbeforeitsdateofexpiry.

(2)EverysuchapplicationshallbemadeinForm7,intriplicate,andiftheapplicationissomade,thelicenceshallbedeemedtohavebeenreneweduntillsuchdatewhentherenewed licence isissued.

(3)Thefeeschargeableforrenewalofthelicenceshallbethesameaslaiddowninsubrule (2) of rule26:

Providedthatiftheapplicationforrenewalisnotreceivedwithinthetimespecifiedinsub-rule(1)penaltyamountingto25percentofthefeeordinarilypayableforthelicenceshallalsobepayableforrenewal:

ProvidedfurtherthatincasewheretheLicensingOfficerissatisfiedthatthedelayinsubmissionoftheapplicationisduetounavoidablecircumstancesbeyondthecontrolofthecontractor,hemayreduceorremitthepenalty.

  1. Issue of duplicate certificate of registration or licence - Where a certificateofregistrationoralicencegrantedorrenewedundertheprecedingruleshasbeenlostdefacedoraccidentallydestroyedaduplicatemaybegrantedonpaymentofafeeofrupeesfive.
  1. RefundofSecurity-(1)Ontheexpiryoftheperiodoflicencethecontractor,may,ifhedoesnotintendtohavehislicencerenewed,makeanapplicationtothelicensingofficerfor the refund of the security deposited by him under rule24.

(2)Ifthelicensingofficerissatisfiedthatthereisnobreachoftheconditionsoflicenceorthereisnoorderundersection14fortheforfeitureofsecurityoranyportionthereof,he shall direct the refund of the security to theapplicant.

(3)Ifthereisanyorderdirectingtheforfeitureofanyportionofthesecurity,theamounttobeforfeitedshallbedeductedfromthesecuritydeposit,andthebalance,ifanyshall be refunded to theapplicant.

(4)Anyapplicationforrefundshall,asfaraspossible,bedisposedofwithinsixtydays of theapplication.

  1. Grantoftemporarycertificateofregistrationandlicence-Whereconditionsarisesinanestablishmentrequiringtheemploymentofcontractlabourimmediatelyandsuchemploymentisestimatedtolastfornotmorethanfifteendays,theprincipalemployeroftheestablishmentofthecontractor,asthecasemaybe,mayapplyforatemporarycertificateorregistrationorlicencetotheregisteringofficerorthelicensingofficer,asthecase may be, having jurisdiction over the area in which the establishment issituated.

(2)TheapplicantforsuchtemporarycertificateofregistrationforlicenceshallbemadeistriplicateinForm1orForm4,respectively,andshallbeaccompaniedbyatreasuryreceiptoracrossedpostalorderdrawninfavouroftheappropriateregisteringorlicensingofficer,asthecasemaybe,showingthepaymentofappropriatefeesandinthecaseoflicence, the appropriate amount of securityalso.

(3)Onreceiptoftheapplication,completeinallrespectandonbeingsatisfiedeitheronaffidavitbytheapplicantorotherwisethattheworkinrespectofwhichtheapplicationhasbeenmadewouldbefinishedwithinaperiodoffifteendaysandisofanaturewhichistobecarriedoutimmediatelytheregisteringofficerorthelicensingofficer,asthecasemaybeshallforthwithgrantacertificateofregistrationinForm2ofalicenceinForm6, as the case may be, for a period of not more than fifteendays.

(4)Whereacertificateofregistrationorlicenceisnotgranted,thereasonsforrefusalshallberecordedbytheregisteringofficer,orthelicensingofficer,asthecasemaybe.

(5)Ontheexpiryofthevalidityoftheregistrationcertificatetheestablishmentshallnot employ in the establishment contract labour in respect of which the certificatewasgiven.

(6)Thefeestobepaidforthegrantofthecertificateofregistrationundersub-rule

(3)shallbespecifiedbelow:-

CHAPTERIV

AppealsAndProcedure

  1. Appeal-(1)Everyappealundersub-section(1)ofsection15shallbepreferredintheformofamemorandumsignedbytheapplicantorhisauthorisedagentandpresentedtothe appellate officer in person or sent to him by registered post.

(2)Thememorandumshallbeaccompaniedbyacertifiedcopyoftheorderappealedfrom and a treasury receipt of tenrupees.

(3)Thememorandumshallsetforthconciselyandunderdistinctheadsthegroundsofappeal.

33.AACOMMENTS

  1. Proceedingonappeal-(1)Wherethememorandumofappealdoesnotcomplywiththe provisions or rule 33, it may be returned to the applicant for the purpose ofbeingamendedwithinatimetobefixedbytheappellateofficer.

(2)Ifthememorandumisnotsoamendedwithinthetimefixed,theappellateofficershall reject the memorandum. After recording the reasons for such rejection, heshallcommunicate the order to theapplicant.

(3)Wherethememorandumofappealisinorder,theappellateofficershalladmittheappeal, endorse thereon the date of presentation and shall register the appeal in abookto be kept for the purpose called the register ofappeals.

(4)(i)Whentheappealhasbeenadmittedtheappellateofficershallsendthenoticeoftheappealtotheregisteringofficerorthelicensingofficer,asthecasemaybe,fromwhoseordertheappealhasbeenpreferredandtheregisteringofficerorthelicensingofficershallsendtherecordofthecasetotheappellateofficer.

(ii)onreceiptoftherecord,theappellateofficer,shallsendanoticetotheapplicanttoappearbeforehimatsuchdateandtimesospecifiedinthenoticefor the hearingappeal.

  1. Dismissalindefault-Ifonthedatefixedforhearingtheapplicantdoesnotappear,theappellateofficermaydismisstheappealfordefaultofappearanceoftheappellant.
  1. RestorationofAppeal(1)Whereanappealhasbeendismissedunderrule35,theappellantmayapplytotheappellateofficerforthereadmissionoftheappeal,andwhereitisprovedthathewaspreventedbysufficientcausefromappearing,theappellateofficershall restore the appeal on its originalnumber.

(2)Suchanapplicationshall,unlesstheappellateofficerextendsthetimeforsufficientreason,bemadewithinthirtydaysofthedateofdismissal.

  1. Decisionofappeal-(1)Iftheappellantispresentwhentheappealiscalledonforhearingtheappellateofficershallproceedtoheartheappellantorhisauthorisedagentandany other person summoned by him for this purpose, and pronounce judgement ontheappeal,eitherconfirming,reversingorvaryingtheorderappealedfrom.

(2)Thejudgementoftheappellateofficershallstatethepointsfordetermination,the decisions there on and the reasons for thedecisions.

(3)Theordershallbecommunicatedtotheappellantandcopythereofshallbesentto the registering officer or the licensing officer from whose order the appeal hasbeenpreferred.

  1. Paymentoffees-Allfeespaidundertheserulesshallbepaidinthelocaltreasuryundertheheadofaccount“0230-LabourandEmployment106RegistrationandrenewalfeeunderContractLabour(RegulationandAbolition)Act1970”andreceiptobtainedwhichshallbesubmittedwiththeapplicationorthememorandumofappealasthecasemaybe.
  1. Copies-Copiesoftheorderoftheregisteringofficer,licensingofficerortheappellateofficermaybeobtainedonpaymentofafeeofRs.twoforeachorderprovidedanapplicationforobtainingsuchcopiesismadetotheofficerconcerned,specifyingthedateand other particulars of theorder.
