PREAMBLE:This is a military Power of Attorney prepared pursuant to Title 10, United States Code, Section 1044b, and executed by a person authorized to receive legal assistance from the military service. Federal law exempts this power of attorney from any requirement of form, substance, formality, or recording that is prescribed for powers of attorney by the laws of a state, the District of Columbia or a territory, commonwealth or possession of the United States. Federal law specifies that this power of attorney shall be given the same legal effect as a power of attorney prepared by and executed in accordance with the laws of the jurisdiction where it is presented.
BE IT KNOWN TO ALL PERSONS, that 1, **, of ______County, ______, a member of the United States Armed Forces, currently at ______, ______, pursuant to Military Orders, do hereby appoint my attorney, ***, as my true and lawful attorney in fact with limited power to conduct my affairs with regard to litigation to be filed the same as I could do if personally present.
The Durable Power of Attorney created herein shall become effective immediately upon execution of this document and shall remain in effect throughout the period of the representation of ***in divorce proceedings in the State of ______, County of ______, File No. ______. This Durable Power of Attorney is revoked, upon entry of a judgment of divorce, a final order closing the case or, by operation of law, upon my death.
SPECIFIC POWERS INCLUDED IN THE SCOPE OF THIS LIMITED DURABLE POWER OF ATTORNEY:
The powers granted in this Limited Durable Power of Attorney to ***include, but are not limited to the following:
1- TO SIGN MY ORIGINAL SIGNATURE TO REQUIRED DOCUMENTS TO BE FILED WITH THE COURT: Once I have received by email attachment a document that needs to be filed by the Court—even one that needs to be notarized—and I have verified by email that the facts set forth in the document are true or specified as true to the best of my knowledge, information and belief, and I have communicated by email with *** to authorize her to affix my signature to the document(s), then she is to sign my name to them as required by the Court and file them. Said documents shall be regarded as though they had been signed by me personally.
TERMS OF APPOINTMENT: Any lawful act performed by said attorney and described in paragraph I above shall be binding upon myself. I reserve the right to amend or revoke this Limited Power of Attorney at any time hereafter; provided, however, anyone dealing with my said attorney may rely upon this Limited Power of Attorney until receipt by it of a duly executed copy of my revocation thereof.
3. COPIES OF LIMITED DURABLE POWER OF ATTORNEY: Any reproduced copy of this signed original shall be deemed to be an original counterpart of this Limited Power of Attorney. This Limited Durable Power of Attorney shall not be affected by any legal incapacity during my lifetime, except as provided by statute.
4. CAPTIONS OF PARAGRAPHS: The captions of paragraphs within this Durable Power of Attorney are not intended to limit, in any way, the powers granted hereunder, the captions being applied for the convenience of the reader only. if there is any conflict between the actual language of any paragraph and the caption applied to that paragraph, the language of the paragraph shall control.
