A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF OXNARD AUTHORIZING SUMITTAL OF 2014 Water-EnergyGRANT APPLICATION

WHEREAS, The State of California, Department of Water Resources (DWR) issued a Proposal Solicitation Package dated October 10, 2014 (PSP), under its 2014 Water-Energy Grant Program; and

WHEREAS, the City of Oxnard (Applicant) desires to apply for a water-energy grant and submit the 2014 Water-Energy Grant Program Application Package released by DWR for the Program; and

WHEREAS, DWR is authorized to approve funding allocations for the DWR Program, subject to the terms and conditions of the PSP, 2014 Water-Energy Grant Program Guidelines, Application Package, and Standard Agreement; and

WHEREAS, City Council Resolution No. 12,053 sets out the procedure by which City staff may submit grant applications, following approval by resolution of the City Council; and

WHEREAS, the General Services Department of the City of Oxnard has requested that City Council approve the submittal of a grant application to HCD for the Housing Related Parks Program grant funds to be used for qualifying park improvements at City parks located in Park Deficient and Disadvantaged areas of the City as identified under HCD guidelines.

NOW, THEREFORE, IT IS RESOLVED BY THE CITY COUNCIL THAT:

  1. Applicantis hereby authorized and directed to apply for and submit to California Department of Water Resources to obtain a 2014 Water-Energy Grant pursuant to Senate Bill No. 103 Section 11 (2013-2014 Regular Session). If the application is approved, the City Manager or designee is hereby authorized and directed to enter into, execute, and deliver a State of California Standard Agreement (Standard Agreement) to receive a grant for the City of Oxnard, and any and all other documents required or deemed necessary or appropriate to secure the Water-Energy Program Grant from DWR, and all amendments thereto (collectively, the “DWR Grant Documents”) with California Department of Water Resources.
  2. Applicantshall be subject to the terms and conditions as specified in the Standard Agreement. Funds are to be used for allowable project expenditures to be identified in theStandard Agreement. The application in full is incorporated as part of the Standard Agreement. Any and all activities funded, information provided, and timelines represented in the application are enforceable through the Standard Agreement. Applicanthereby agrees to use the funds for eligible project expenditures in the manner presented in the application as approved by the DWR and in accordance with the PSP and 2014 Water-Energy Grant Program Guidelines and Application Package.
  3. City Council of the City of Oxnard authorize execution of the State Agreement with DWRfor the 2014 Water-Energy Grant Program grant funds to be used for qualifying improvements as identified under DWR guidelines. The City Council further resolves that the Finance Director or designee is authorized to submit financial reports and grant claims and approve special budget appropriations for the use of grant funds; and the General Services Manager or designee is authorized to submit non-financial reports.
