New York State Preferred Source Program for People Who are Blind (NYSPSP) herewith submits summary information on the proposal to offer a new line of drug testing kits.

151 series – NxScan Cups

One of the easiest to use onsite testing products on the market now comes in a flat panel cup for easy copying or scanning for a permanent record.

150 Series

Express Diagnostics offers single- and multiple-drug dip test devices, as well as single test strips. The DrugCheck Dip Drug Test is a rapid, qualitative immunoassay for the detection of up to 14 drugs of abuse in a convenient, one-step test. Simply dip test strips in urine sample for 15 seconds and read results at 5 minutes.

The DrugCheck® SalivaScan™ oral fluid drug test includes the first sponge saturation indicator on the market. No more throwing away devices due to inadequate specimen in the saliva drug test. The indicator strip in the collection swab changes color once the sponge contains enough saliva. The swab locks into the device for a tamper evident and airtight seal.

Preferred Source Supplier and Manufacturer information:

Our manufacturer is a US-based Manufacturer out of Blue Earth, Minnesota, called Express Diagnostics (www.drugcheck.com). Our supplier, TX Lighthouse for the Blind, is pleased with the performance of this manufacturer, having been working with them for some time now, proving their capability of on-time order fulfillment and delivery.


Market Information:

Hand-held devices have become very popular with criminal justice agencies due to their portability, ability to rapidly provide results, and ease of operation. Because they require no machinery to maintain and calibrate, they can be used by criminal justice officers with no formal training in drug testing. Also, it is not necessary to refrigerate them before use, as is the case with the reagents used in analyzers. Another advantage of rapid on site devices is that they simplify chain of custody concerns with specimens by creating a one-step testing process. These are being used extensively in the federal courts; they are widely purchased by various NYS agencies such as the Department of Corrections, Probation and Parole, Drug Courts, County Mental Health, Juvenile Justice, Child Protective Services, Sheriffs and Police, Schools and Colleges. There may be practical applications for Department of Motor Vehicles as well. Drug testing can become costly when all the testing is sent out to labs. Reducing the number of tests that need to be sent out by doing onsite tests first can be an important financial factor anywhere that drug testing gets done routinely.

Location / Client Employment:

This line of products will be produced by Northeastern Association of the Blind at Albany (NABA), located in Albany, NY. Employees who are blind will receive and inspect the bulk product from the supplier. They will create simple kits with most of the items as well as offering the basic repackaged version with the test only. Kit ingredients will vary from item to item. In some instances, individual tests will be placed into baggies with a pair of gloves and sterile cup with a temperature strip for collection. The bags will be placed into boxes of 25, closed and sealed, weighed and marked for shipping to the end user. We can create more extensive kits upon customer request, including chain of custody forms if needed for the times when a positive result requires additional testing. Repackaging projects will employ people who are blind repacking items from bulk to smaller case units, weighing, labeling and sealing for shipping to end users. 100% of the direct labor that will be performed at NABA will be performed by employees who are blind.

FTE Analysis:

The labor that will be performed will contribute to the daily workflow of 4 employees in the NABA manufacturing department. With anticipated sales of approximately $660,000 per year by OGS estimates, or about 10,000 cases, this offering will create approximately 2,000 annual labor hours for employees who are blind, or 1.1 FTE’s for our Albany affiliate.

Current Supplier / Preferred Source Supplier:

There was an existing NYS contract (34104 Award 21002) for drug and alcohol screening products (http://www.ogs.state.ny.us/purchase/spg/pdfdocs/3410421002ra.pdf) that was valid through November of 2012. New York State Industries for the Disabled (NYSID) has also been providing urine based drug tests as a Preferred Source to NYS since April of 2004. At the time of that 2004 approval, it was agreed that the existing contract would remain in effect; incorporating provisions to recognize that the same or similar products may be offered by another NYS contract and/or a NYS Preferred Source (as per minutes from the State Procurement Council meeting of April 17th, 2004). There were six companies on that state contract, one of whom was a NYS-based business, American Bio Medica Corporation (ABMC) of Kinderhook, New York.

Benefits Analysis / Price Data:

The addition of a second Preferred Source for drug tests to NYS provides another option for state purchasers in addition to the NYS Contract and the Minnesota Multi-State Contract Alliance for Pharmacy MMCAP (http://www.mmd.admin.state.mn.us/mmcap/). This in itself provides an advantage for NYS. NYSPSP is comfortable with the conditions outlined in 2004 providing that preferred sources will sell alongside state contract providers with the provision that preferred source availability is noted within the language of the state contract.

Use of rapid onsite tests can be of great benefit to the state for the reduction of expense, by eliminating the need for lab testing except when an on-site test provides a positive result. Reducing the number of tests that have to be shipped out by providing a cost effective alternative is a significant benefit to NYS. By adding NYSPSP’s offering to the list, there will be another choice added for NYS, and increased labor hours for employees who are blind in Albany, NY who might otherwise face layoffs. If employees at NABA are laid off, it leads to greater expense for the state in the form of additional assistance for the individuals not working.

Small NYS Business & MWBE Concerns:

Searches were performed through ThomasNet.com and through the Empire State Development MWBE search tool online. Most of the MWBE’s were either pharmacies or drug abuse and addiction treatment therapists, and not associated directly with the provision of rapid on-site drug and alcohol testing devices. From the small business search, ABMC was the most directly comparative company. They would not have lost footing within NYS by the addition of NYSPSP to this list of preferred source offerings, since they were a contract holder in NYS.
