Waste tyre pile at [ADDRESS]

I spoke with you earlier today about the large pile of tyres from the Council land at [ADDRESS], managed by Trash Co. As discussed, Irequest that action be taken to remove the pile and ensure that rubbish is not dumped on the site in future.

The pile has accumulated on the site over the past 12 months and has been regularly vandalised and set alight on at least one occasion. Recently, other people have also started to dump their waste on this site.

Council’s Waste Strategyrecognises the need to discourage irresponsible disposal of waste and to direct waste to approved facilities. The Council land is not an approved waste depot or a waste management facility. The site is near the foreshore and is not an appropriate area for the storage or collection of waste.

It is an offence under reg 10 of the Environmental Management and Pollution Control (Waste Management) Regulations 2000 to use land for the disposal of general waste without approval. The unsightly rubbish pile, which may present a public health risk, fire risk or cause environmental harm if not managed appropriately, is also a nuisance within the meaning of section 199 of the Local Government Act 1993.

For these reasons, I request that Council officers take action to ensure that the waste pile is removed and no further waste is stored there in future. I note that section 20A of the Environmental Management and Pollution Control Act 1994 requires Council to “use its best endeavours to prevent or control acts or omissions which cause or are capable of causing pollution.”

A number of options are available to address this situation. For example, Council could issue Trash Co with an abatement notice under s.200 of the Local Government Act1993, an environment protection notice under EMPCA or a notice under the Random Council Environment and Health Services By-law. I request that Council also erect signs declaring that the area is not to be used for waste disposal.

I would be happy to provide any further information you need about this matter. In accordance with section 61 of EMPCA, please keep me advised of any action taken by the Council in response to my complaint.
