MOTION REQUESTING ORDER DIRECTING CREDIT REPORTING AGENCIES TO PRODUCE JUDGMENT DEBTOR’S CREDIT REPORT

Creditor Corp., Plaintiff, through counsel, as its Motion requesting order directing credit reporting agencies to produce judgment debtor’s credit report, pursuant to Rules 2-633 and 2-651 of the Maryland Rules of Civil Procedure, respectfully says:

1. This Court entered judgment against Defendant in the amount of $78,000.00

on 6/12/08. The Defendant has failed to satisfy the judgment either in whole or in part.

2. The Fair Debt Collection Act permits any consumer reporting agency to furnish a consumer credit report in response to the order of a court having jurisdiction to issue such an order, 15 U.S.C. §1681b(a)(1). In addition, a consumer reporting agency may furnish a consumer credit report to a person which it has reason to believe intends to use the information in connection with, inter alia, collection of an account, 15 U.S.C. §1681b(a)(3)(A).

3. Plaintiff believes and therefore avers that information contained in Defendant’s credit report may assist Plaintiff in discovering assets which can be used to satisfy the judgment entered herein. Plaintiff therefore requests that this Court enter an Order authorizing and directing any consumer reporting agency to disclose Defendant’s credit report to Plaintiff’s counsel. Consumer reporting agencies upon which such an Order may be served include the following: Equifax Credit Information Services, Inc., (Equifax), Trans Union LLC (Trans Union), and Experian Information Solutions, Inc. (Experian).

WHEREFORE, Plaintiff respectfully requests that this Court enter an order which authorizes and directs the above named consumer reporting agencies to disclose Defendant’s credit report to Plaintiff’s counsel, in the form annexed hereto, and for such other and further relief as justice may require.
