ORDINANCE NO. 2002-131

AN ORDINANCE MODIFYING AND CONFIRMING THE BOUNDARIES OF THE WARDS FROM WHICH FIVE MEMBERS OF COUNCIL SHALL BE ELECTED; AND DECLARING AN EMERGENCY

WHEREAS, the City Charter, in Article III, Section 3.01, divides the City into five wards from which five members of Council are elected; and

WHEREAS, the population of the City has grown and the areas of population have shifted since the last time the boundaries of the wards were defined (in the early 1990s); and

WHEREAS, City Council wishes to insure that all citizens of the City of Blue Ash benefit from a fully representative government; and

WHEREAS, City Council has the authority by ordinance to change the boundaries of the ward from time to time as described in Section 3.01 of Article III of the Charter of the City of Blue Ash.

Be it ordained by the Council of the City of Blue Ash, Ohio, not less than five (5) members thereof concurring,

SECTION I.

The boundaries of the five wards shall be defined as follows:

Ward 1: All of the City lying (i) south of Cooper Road and east of Kenwood Road and, (ii) between Blue Ash Road and Kenwood Road south of Alpine Avenue and, (iii) north of Cooper Road and south of a straight line immediately south of and parallel to Myrtle Avenue (excluding any property on Myrtle Avenue) and east of a straight line immediately east of and parallel to Monroe Avenue (excluding any property on Monroe Avenue); and (iv) the area bounded as follows: beginning at the intersection of Cooper Road and Kenwood Road, thence north on Kenwood Road to Catalpa Creek Drive, thence west to the western border of the C.L.&N/Conrail railroad right-of-way; thence north along the railroad right-of-way to Glendale-Milford Road; thence west to Reed Hartman Highway; thence directly south to and along Alliance Road; thence west on Malsbary Road to Reed Hartman Highway; thence south on Reed Hartman Highway to Cooper Road; thence east on Cooper Road to the undedicated Highland Avenue (adjacent to the Blue Ash Recreation Center); thence south on the undedicated Highland Avenue; thence east on Brown Avenue to a straight line immediately west of West Avenue immediately south of Ridgeway Avenue; thence south on said line running parallel to West Avenue (including all properties on West Avenue) to Hunt Road; thence east on Hunt Road to Conklin Avenue; thence north on Conklin Avenue to Perry Avenue; thence east on Perry Avenue to the fully dedicated Highland Avenue; thence south on Highland Avenue to Hunt Road; thence east on Hunt Road to Blue Ash Road; thence south on Blue Ash Road to Alpine Avenue; thence east on Alpine Avenue to Kenwood Road; thence north on Kenwood Road to the intersection of Cooper Road, the original point of beginning.

Ward 2: All of the City lying (i) east of Reed Hartman Highway north of Cornell Road, (ii) east of Kenwood Road north of Creek Road, and the area bounded as follows: beginning at the intersection of Kenwood Road and Creek Road, thence south on Kenwood Road to the western border of the CL&N/Conrail railroad right-of-way; thence south along the railroad right-of-way to a point in the railroad right-of-way; thence east (in alignment with Catalpa Creek Drive) to Kenwood Road; thence south on Kenwood Road to a point on Kenwood Road in alignment with a straight line immediately south of and parallel to Myrtle Avenue (including all properties on Myrtle Avenue); thence east along that parallel line to a point east of Monroe Avenue; thence north in a straight line parallel to Monroe Avenue (including all properties on Monroe Avenue) to the corporation line; thence following the corporate line generally north to Creek Road; thence west on Creek Road to Kenwood Road, the original point of beginning.

Ward 3: All of the City lying (i) north of Creek Road, east of Kenwood Road and south of Cornell Road, (ii) north of Cornell Road west of Reed Hartman Highway; and the area bounded as follows: beginning at the intersection of Kenwood Road and Creek Road, thence south on Kenwood to the western border of the CL&N/Conrail railroad right-of-way; thence south along the railroad right-of-way to Glendale-Milford Road; thence west on Glendale-Milford Road to Reed Hartman Highway; thence south on Reed Hartman Highway to Alliance Road; thence south on Alliance Road to Malsbary Road; thence west on Malsbary Road to Reed Hartman Highway; thence south on Reed Hartman Highway to Cooper Road; thence east on Cooper Road to a point immediately west of the undedicated Highland Avenue (next to the Blue Ash Recreation Center); thence south following a line parallel to the undedicated Highland Avenue (excluding properties on the undedicated Highland Avenue) to a point south of Brown Avenue; thence following a parallel line south of Brown Avenue (excluding Brown Avenue properties) to a point between Lansford Drive and West Avenue; thence south along a line parallel to West Avenue (excluding West Avenue properties but including Lansford Drive properties) to Hunt Road; thence west on Hunt Road to Plainfield Road; thence north on Plainfield Road to Creek Road; thence east on Creek Road to Kenwood Road, the original point of beginning.

Ward 4: All of the City lying (i) west of Blue Ash Road and south of Hunt Road, and (ii) between Conklin Avenue and Highland Avenue south of Perry Avenue, and (iii) all of the property on Georgetown Road presently known as the Walnut Creek development and the Kroger/K-Mart shopping area and other commercial properties at the northwest corner of Plainfield Road and Hunt Road.

Ward 5: All of the City lying (i) north of Hunt Road and west of Plainfield Road, excluding the property on Georgetown Road presently known as the Walnut Creek development and the Kroger/K-Mart shopping center and other commercial properties at the northwest corner of Plainfield Road and Hunt Road.

Except as otherwise noted, all street references are to be centerline of the street. Incorporated in this ordinance is the map attached hereto as Exhibit A.

SECTION II.

This ordinance is hereby declared to be an emergency measure necessary for the preservation of the public peace, health, safety, and welfare of the citizens of the City of Blue Ash; the reason for the emergency being the need to preserve the right of the citizens of Blue Ash to equal representation by their elected representatives. Therefore, this ordinance shall take effect and be in force from and after its passage.
