TO THE CHARTER SCHOOL ADMINISTRATOR ADDRESSED

Subject: 2009-2010 Annual Governance Reporting Formfor Open-Enrollment Charter Schools

The Texas Education Agency is required by Texas Education Code (TEC), §12.119(b) and 19 Texas Administrative Code (TAC) §100.101 to obtain information each year to ensure the fiscal and academic accountability of entities holding charters. The 2009-2010 Annual Governance Reporting Formfor Open-Enrollment Charter Schools will be used to gather the required information and must be submitted to the Division of Charter School Administration no later than November 2, 2009. Failure to submit the required information on time may affect any requests to amend your charter. Additionally, you must meet this deadline in order to ensure that your school information will be updated in the upcoming release of the AskTED School Directory.

In order to confirm that each annual submission of charter holder board member information submitted to TEA matches the information currently registered with the Secretary of State (SOS), staff in the Division of Charter School Administration will compare each submission with the charter holder management information currently registered with the SOS. Prior to submission, please review the management information on file with the SOS. You can locate this information by entering the SOSDirect website at creating an account, clicking on the heading labeled Business Organizations, and reviewing the names under the section titled Management. If any charter holder board information does not match the information registered with the SOS, include, with the submission of the governance reporting forms, the approved minutes from the charter holder board meeting, held in compliance with the Texas Open Meetings Act, where action was taken to make the board member change.

A copy of the 2009-2010 Annual Governance Reporting Formfor Open-EnrollmentCharter Schools and instructions are attached. Please note that one form must be completed, signed, and dated for each individual board member and officer for each charter school. TEC§12.119(a) also requires that a charter file with the State Board of Education (SBOE) a copy of its articles of incorporation and bylaws, or comparable documents if the charter holder does not have articles of incorporation or bylaws on file. If a copy of articles of incorporation and bylaws are already on file with the Division of Charter School Administration, a copy of any amendments or changes must be submitted.
