- This statement made by me accurately sets out the evidence which I would be prepared, if necessary, to give in court as a witness. The statement is true to the best of my knowledge and belief and I make it knowing that, if it is tendered in evidence, I shall be liable to prosecution if I have wilfully stated in it anything which I know to be false, or do not believe to be true.
- I am ** years of age.
- I am a registered user of the online auction site My registered username is ******. I have been using the site for approximately **years/**months. I am familiar with the rules and policies of trading on eBay and have never had any problems purchasing online through eBay.
- I have conducted more than ** transactions in the past, where I have received the items that I paid for.
- Approximately (time & date), I was checking the eBay website looking for an (describe the item), when I saw item number (list the item number). It was a (describe the item – brand new Apple Book Mac Air laptop computor) which was the subject to bidding. A seller using the username Hybrid Concepts was auctioning the item. The seller had (list how many if more than one – several of) these laptops up for auction at this time. I checked the seller’s previous feedback. They were positive and did not have any complaints or adverse comments. This made me believe that I was dealing with a genuine seller. Since the auction price was good, I decided to bid for the item. I entered a bid of (state the price - $1,500). I retained a copy of this item on my computer which I have printed.

- About (time & date), I received an email from the eBay-automated service informing me that I had won the auction for the (describe item). It also informed me that I now had to transfer money into the sellers nominated bank account. Details of the account were; hybrid Digitals National Bank of Australia BSB 082 024 Account no. 812 191 623.
- Other contact details of the seller per the email included the following(give details of his contact details etc. This may differ from what is listed below.)EG:
– name of seller: Hybrid Concepts, Hybrid Digital etc

–address: 233 Victoria Avenue, Chatswood NSW 2067
Annexure 2: Copy of e-mail from dated on (list the date) detailing sellers account details.
- About (time & date), I accessed my (Bank, branch, BSB & account details) by accessing the banks website on the Internet and entered my secure log-on details. I then transferred ($enter amount) into sellers bank account in the name of Hybrid Digitals National bank of Australia BSB 082 024 Account No191 623. I then entered into the transfer description field the words ( ********, being my eBay username and a description of the item). The transfer was confirmed by receipt number ************ issued by my bank almost immediately after I completed the transaction.

- About (time & date), I sent an email to the person that I know as the seller by the name of hybrid Concepts on email address where I informed the seller that I had transferred the money into the nominated bank account. I also provided my postal address where the (described item purchased) could be sent by post to.

- About (time & date), I received an e-mail from the seller, Hybrid Concepts. In that email, he acknowledged my postal address and informed me that the item would be shipped in the next couple of days.
Annexure 5: Copy of the above e-mail sent by Hybrid Concepts
- On (time & date), I contacted the seller Hybrid Concepts via e-mail () to ask when the item would be delivered. He responded on the same day advising there would be a delay due to massive order.
- On (time & date), I again contacted the seller Hybrid Concepts via the same e-mail address to ask when the item would be delivered. I received no response.
- On (time & date), I again forwarded a message via e-mail to the Hybrid Concept email address and received no response.
- I tried contacting him on mobile phone number 0404 366 692 on (time & date), and left a message/could leave no message as the message bank was full.
- On the same day/list date, I noticed that he had changed his feedback to ‘private’, meaning no one could read feedback comments, and the eBay username had changed to “hybrid.no.paypal” (or other name he used) and he had deregistered as a user on eBay.
- I contacted an eBay online agent on (date), and asked what actions I should take. I was advised to contact the Police, as the seller had deregistered, eBay would not be able to take any action against him. Nevertheless, I filed a dispute report against the seller on (date). To date the seller had not responded to the dispute.(this paragraph may differ for you particular case)
- I have also contacted the National Bank of Australia to ask for advice. I was told to open a dispute against the transfer of money and the bank will investigate.
Annexure 6: Copy of above emails I sent to the seller and a copy of the online advice obtained from eBay agent.
- When I transferred ($amount) to Hybrid Concepts (or other company name) bank account, I believed that I was paying for a genuine seller who did have a (describe item) for sale, and that on receiving of my money, he would send the item to me. I would not have paid this money if I had known that I would not receive the (describe item). To date, I have not received either the (item) or my money back.
- I have not been paid compensation by eBay as a result of my report to them. I could not leave feedback on the sellers account at eBay. I wish to claim compensation in the amount of $ enter amount)
