STATE LICENSING BOARD FOR CONTRACTORS

RESIDENTIAL BUILDING COMMITTEE MEETING MINUTES

August 1, 2012

The regular monthly meeting of the Residential Building Committee was called to order by the Chairman at 9:30 a.m. in Conference Room of the Board’s offices, Baton Rouge, Louisiana.

Members of the Committee present: Lloyd “Chip” Badeaux, Vice Chairman

Dana Dugas

Karon “Kay” Gibson

William “Billy” Ward, Jr.

Mr. Victor Weston and Mr. Michael Penn were absent.

There being a quorum, the regular order of business was called.

Also attending the meeting were: Michael McDuff, Executive Director; Judy Dupuy, Board Administrator; Judge Darrell White, Retired, Hearing Officer; Stephanie Laborde, Board Attorney; and from the staff, Emma Payne, Bobbie Hughes, Lori Guthrie, Brent Templet, Michelle Lemoine, John Dixon, Kelli Prudhomme, Nathan Rawls and Sharon Fabre; Compliance Investigators, Carl Bourque, Marianne Sullivan; and Keri Dupont, recording the Minutes.

The Pledge of Allegiance was led by Mr. Badeaux.

Judge Darrell White gave the invocation and asked for a moment of silent prayer.

A Motion was made by Mr. Dugas and seconded by Ms. Gibson to accept the Minutes of the July 11th, 2012 Residential Building Committee Meeting. The Motion passed.

NEW BUSINESS

C. INSURANCE HEARING(S):

1. Home Improvement Workers' Compensation – Consideration of an alleged violation by the following State registered home improvement contractors for failure to maintain a current certificate of insurance on file with the Board for workers’ compensation coverage. Section 1503 (D) Rules and Regulations of the Board.

Benbrook Contracting, LLC

No representative was present. Ms. Emma Payne appeared on behalf of the Board. Ms. Payne stated that the Board had not received proof of Worker’s Compensation coverage. A Motion was made by Mr. Dugas which was seconded by Mr. Ward to suspend the license of Benbrook Contracting, LLC and to issue a cease and desist, but gave the staff the authority to reinstate the license if the proper proof of insurance is provided. The Motion passed.

Brian Sinclair

No representative was present. Ms. Emma Payne appeared on behalf of the Board. Ms. Payne stated that the Board had not received proof of Worker’s Compensation coverage. A Motion was made by Mr. Dugas which was seconded by Mr. Ward to suspend the license of Brian Sinclair and to issue a cease and desist, but gave the staff the authority to reinstate the license if the proper proof of insurance is provided. The Motion passed.

Concrete Placement, LLC

No representative was present. Ms. Emma Payne appeared on behalf of the Board Ms. Payne stated that the Board had not received proof of Worker’s Compensation coverage. A Motion was made by Mr. Dugas which was seconded by Mr. Ward to suspend the license of Concrete Placement, LLC and to issue a cease and desist but gave the staff the authority to reinstate the license if the proper proof of insurance is provided. The Motion passed.

Eds Home Improvements, LLC

No representative was present. Ms. Emma Payne appeared on behalf of the Board. Ms. Payne stated that the Board had not received proof of Worker’s Compensation coverage. A Motion was made by Mr. Dugas which was seconded by Mr. Ward to suspend the license of Eds Home Improvements, LLC and to issue a cease and desist, but gave the staff the authority to reinstate the license if the proper proof of insurance is provided. The Motion passed.

Franklin Pavement Management, LLC

No representative was present. Ms. Emma Payne appeared on behalf of the Board. Ms. Payne stated that the Board had not received proof of Worker’s Compensation coverage. A Motion was made by Mr. Dugas which was seconded by Mr. Ward to suspend the license of Franklin Pavement Management, LLC and to issue a cease and desist, but gave the staff the authority to reinstate the license if the proper proof of insurance is provided. The Motion passed.

Jacob M. Chapman

No representative was present. Ms. Emma Payne appeared on behalf of the Board. Ms. Payne stated that the Board had not received proof of Worker’s Compensation coverage. A Motion was made by Mr. Dugas which was seconded by Mr. Ward to suspend the license of Jacob M. Chapman and to issue a cease and desist, but gave the staff the authority to reinstate the license if the proper proof of insurance is provided. The Motion passed.

KBC Remodeling & Renovations, LLC

KBC Remodeling & Renovations provided the proper proof of Worker’s Compensation coverage and Ms. Laborde asked that it be removed from the agenda.

Lona Company, LLC

No representative was present. Ms. Emma Payne appeared on behalf of the Board. Ms. Payne stated that the Board had not received proof of Worker’s Compensation coverage. A Motion was made by Mr. Dugas which was seconded by Mr. Ward to suspend the license of Lona Company, LLC and to issue a cease and desist, but gave the staff the authority to reinstate the license if the proper proof of insurance is provided. The Motion passed.

TM Nola, LLC

No representative was present. Ms. Emma Payne appeared on behalf of the Board Ms. Tracy Mai appeared on behalf of TM Nola, LLC and was sworn in. A Motion was made by Mr. Dugas which was seconded by Mr. Ward to give TM Nola, LLC 30 days to provide the proper proof of Worker’s Compensation coverage with no lapses. The Motion passed.

Wells Systems, Inc.

No representative was present. Ms. Emma Payne appeared on behalf of the Board. Ms. Payne stated that the Board had not received proof of Worker’s Compensation coverage. A Motion was made by Mr. Dugas which was seconded by Mr. Ward to suspend the license of Wells Systems, Inc. and to issue a cease and desist, but gave the staff the authority to reinstate the license if the proper proof of insurance is provided. The Motion passed.

2. a) Residential Building General Liability – Consideration of an alleged violation by the following State licensed residential building contractors for failure to maintain a current certificate of insurance on file with the Board for general liability coverage. Section 1503 (D) Rules and Regulations of the Board.

Accu-Builders, Inc.

No representative was present. Ms. Emma Payne appeared on behalf of the Board. Ms. Payne stated that the Board had not received proof of General Liability coverage. A Motion was made by Mr. Dugas which was seconded by Mr. Ward to suspend the license of Accu-Builders, Inc., fine court costs and issue a cease and desist, but gave the staff the authority to reinstate the license if the proper proof of insurance is provided. The Motion passed.

Ms. Payne informed Ms. Laborde that the she had received the proper proof of insurance. A Motion was made by Mr. Ward which was seconded by Ms. Gibson to remove the previously assessed penalty due to Accu-Builders, Inc. providing the proper proof of General Liability coverage. The Motion passed.

D&S Enterprise General Contractor, LLC

No representative was present. Ms. Emma Payne appeared on behalf of the Board. Ms. Payne stated that the Board had not received proof of General Liability coverage. A Motion was made by Mr. Dugas which was seconded by Mr. Ward to suspend the license of D&S Enterprise General Contractor, LLC, fine court costs and issue a cease and desist, but gave the staff the authority to reinstate the license if the proper proof of insurance is provided. The Motion passed.

Doucette & Associated Contractors, Inc

No representative was present. Ms. Emma Payne appeared on behalf of the Board. Ms. Payne stated that the Board had not received proof of General Liability coverage. A Motion was made by Mr. Dugas which was seconded by Mr. Ward to suspend the license of Doucette & Associated Contractors, Inc, fine court costs and issue a cease and desist, but gave the staff the authority to reinstate the license if the proper proof of insurance is provided. The Motion passed.

Emile A. Van Haelen VI

Ms. Laborde asked that Emile A. Van Haelen, VI be removed from the agenda.

No representative was present. Ms. Emma Payne appeared on behalf of the Board. Ms. Payne stated that the Board had not received proof of General Liability coverage. A Motion was made by Mr. Dugas which was seconded by Mr. Ward to suspend the license of Kojis Construction, LLC, fine court costs and issue a cease and desist, but gave the staff the authority to reinstate the license if the proper proof of insurance is provided. The Motion passed.

Professional Construction and Restoration, LLC

No representative was present. Ms. Emma Payne appeared on behalf of the Board. Ms. Payne stated that the Board had not received proof of General Liability coverage. A Motion was made by Mr. Dugas which was seconded by Mr. Ward to suspend the license of Professional Construction and Restoration, LLC, fine court costs and issue a cease and desist, but gave the staff the authority to reinstate the license if the proper proof of insurance is provided. The Motion passed.

Seventh District Pavilion, Inc.

No representative was present. Ms. Emma Payne appeared on behalf of the Board. Ms. Payne stated that the Board had not received proof of General Liability coverage. A Motion was made by Mr. Dugas which was seconded by Mr. Ward to suspend the license of Seventh District Pavilion, Inc., fine court costs and issue a cease and desist, but gave the staff the authority to reinstate the license if the proper proof of insurance is provided. The Motion passed.

A Motion was made by Mr. Dugas which was seconded by Mr. Ward to suspend the license of Doucette & Associated Contractors, Inc. and fine administrative costs, but gave the staff the authority to reinstate the license if the proper proof of insurance is provided. The Motion passed.

Dakmak-Colomb Construction Company, Inc.

Ms. Laborde asked that Dakmak-Colomb Construction Company Inc. be removed from the agenda.

KBI Construction Company, Inc.

No representative was present. Ms. Emma Payne appeared on behalf of the Board. Ms. Payne stated that the Board had not received proof of Worker’s Compensation coverage. A Motion was made by Mr. Dugas which was seconded by Mr. Ward to suspend the license of KBI Construction Company, Inc and fine administrative costs, but gave the staff the authority to reinstate the license if the proper proof of insurance is provided. The Motion passed.

No representative was present. Ms. Emma Payne appeared on behalf of the Board. Ms. Payne stated that the Board had not received proof of Worker’s Compensation coverage. A Motion was made by Mr. Dugas which was seconded by Mr. Ward to suspend the license of James S. Kot Remodeling Contractor, LLC and fine administrative costs, but gave the staff the authority to reinstate the license if the proper proof of insurance is provided. The Motion passed.

Professional Construction and Restoration, LLC

No representative was present. Ms. Emma Payne appeared on behalf of the Board. Ms. Payne stated that the Board had not received proof of Worker’s Compensation coverage. A Motion was made by Mr. Dugas which was seconded by Mr. Ward to suspend the license of Professional Construction and Restoration, LLC and fine administrative costs, but gave the staff the authority to reinstate the license if the proper proof of insurance is provided. The Motion passed.

Seventh District Pavilion, Inc.

Ms. Emma Payne appeared. Ms. Payne stated that the Board had not received proof of Worker’s Compensation coverage. A Motion was made by Mr. Dugas which was seconded by Mr. Ward to suspend the license of Seventh District Pavilion, Inc. and fine administrative costs, but gave the staff the authority to reinstate the license if the proper proof of insurance is provided. The Motion passed.


Solemnity Builders, LLC

No representative was present. Ms. Emma Payne appeared on behalf of the Board. Ms. Payne stated that the Board had not received proof of Worker’s Compensation coverage. A Motion was made by Mr. Dugas which was seconded by Mr. Ward to suspend the license of Solemnity Builders, LLC and fine administrative costs, but gave the staff the authority to reinstate the license if the proper proof of insurance is provided. The Motion passed.

Emile A. Van Haelen VI

Ms. Laborde asked that Emile A. Van Haelen, VI be removed from the agenda.

3. Mold Remediation Workers’ Compensation – Consideration of an alleged violation by the following State licensed mold remediation contractors for failure to maintain a current certificate of insurance on file with Board for workers’ compensation and general liability coverage. La. R.S. 2150–2192, 2186 (B) (6) and 2189 (A) (7).
