NOTICE OF CONFIRMATION OF MODIFICATION ORDER

WILDLIFE AND COUNTRYSIDE ACT 1981, SECTION 53

THE NOTTINGHAMSHIRE (AREA 5) DEFINITIVE MAP AND STATEMENT

THE NOTTINGHAMSHIRE COUNTY COUNCIL (OWTHORPE FOOTPATH NOS. 11, 12, 13, 14 & 15 AND KINOULTON FOOTPATH NO.22)

MODIFICATION ORDER 2005

On the 18th February 2016 the Secretary of State for Environment, Food and Rural Affairs confirmed part of the above Order made under Section 53 of the Wildlife and Countryside Act 1981

The effect of that part of the Order that is confirmed is to modify the Definitive Map and Statement for the above Area by adding the following paths as shown on the Order Maps:

Owthorpe Footpath No.11- Commencing from a point, SK 6706 3346, at the junction with Village Street and proceeding for a distance of approximately 250 metres in a generally north-westerly direction to a point, SK 6688 3365, at the junction with Owthorpe Footpath No.10.

Owthorpe Footpath No.12 – Commencing from a point, SK 6699 3351, at the junction with Owthorpe Footpath No.11 and proceeding for a distance of approximately 120 metres in a generally south-westerly direction to a point, SK 6693 3340, at the junction with Cotgrave Road.

Owthorpe Footpath No.13 – Commencing from a point, SK 6697 3301, at the junction with Kinoulton Lane and proceeding for a distance of approximately 400 metres in a generally southerly direction to a point, SK 6701 3260 at the junction with Kinoulton Lane.

Owthorpe Footpath No.14 – Commencing from a point, SK 6696 3293, at the junction with Owthorpe Footpath No.13 and proceeding for a distance of 240 metres in a south-south-westerly direction to a point, SK 6690 3268, at the junction with Kinoulton Lane.

Owthorpe Footpath No.15 – Commencing from a point, SK 6791 3229, at the junction with Swabbs Lane and proceeding for a distance of approximately 880 metres in a south-south-easterly, south westerly and finally southerly direction to a point, SK 6781 3145, at the junction with Kinoulton Footpath No.22.

Kinoulton Footpath No.22 – Commencing from a point, SK 6781 3145, at the junction with Owthorpe Footpath No.15 and proceeding for a distance of approximately 25 metres in a southerly direction to a point, SK 6781 3141, at the junction with Owthorpe Lane.

A copy of the Order as confirmed and the Order Map may be seen free of charge at my Office at the address below between the hours of 9.00 am and 4.30 pm Mondays to Fridays inclusive, at the offices of Rushcliffe Borough Council, Civic Centre, Pavilion Road, West Bridgford, Nottingham, NG2 5FE and at Cotgrave Public Library, Cotgrave Shopping Centre, Cotgrave, Nottingham, NG12 3JQ and Keyworth Public Library, Church Drive, Keyworth, Nottingham NG12 5FF during the respective normal opening hours until the 10th October 2016. Copies of the Order and Map may be purchased from my Office at the address below at a cost of £5 per copy.

The Order came into force on the 18th February 2016, but if a person aggrieved by the Order wants to question its validity, or any provisions contained in it, on the grounds that it is not within the powers of the Wildlife and Countryside Act 1981 or on the grounds of any requirement of the Act or of any regulations made under the Act has not been complied with in relation to the Order, he or she may, under Paragraph 12 of Schedule 15 to the Act, within 6 weeks from the 29th August 2016 make an application to the High Court.
