The Governor in Council makes the following Regulations:

Part 1—Preliminary

1Objective

The objective of these Regulations is to amend theProfessional Boxing and Combat Sports Regulations 2008—

(a)to update the prescribed fees including converting the monetary units to fee units; and

(b)to amend the definition of National Police Certificate following the merger of CrimTrac and the Australian Crime Commission.

2Authorising provision

These Regulations are made under section 22 of the Professional Boxing and Combat Sports Act1985.

3Commencement

(1)These Regulations, except Part 3, come into operation on the day on which they are made.

(2)Part 3 comes into operation on 1 January 2017.

4Principal Regulations

In these Regulations, the Professional Boxing and Combat Sports Regulations 2008[1] are called the Principal Regulations.

Part 2—Amendments relating toCrimTracchanges

5Definitions

In regulation 4 of the Principal Regulations—

(a)in the definition of National Police Certificate, for "CrimTrac"substitute"theAustralian Crime Commission";

(b)insert the following definition—

"Australian Crime Commission means theAustralian Crime Commission (bywhatever name described) established by the Australian Crime Commission Act 2002 of the Commonwealth;".

6New regulation 19 inserted

After regulation 18 of the Principal Regulations insert—

"19 National Police Certificate—CrimTrac References

On and from 1 July 2016, a National Police Certificate or copy of a National Police Certificate from the Australian Crime Commission that is provided to the Board under regulation 5(2)(b), 5(5)(c), 7(2)(b) or7(5) is taken to be a valid National Police Certificate or copy of a valid National Police Certificate for the purposes of these Regulations.".

Part 3—Other amendments

7Promoter's licence

In regulation 5(2)(a) of the Principal Regulations, for "$225"substitute"34·43 fee units".

8Promotion permit

For regulation 6(1)(b) of the Principal Regulations substitute—

"(b) the prescribed fee is—

(i)wherethe attendance of the promotionis estimated to be 500 orless, 60·98 fee units; or

(ii)wherethe attendance of the promotionis estimated to be between 501 and 2000, 143·47 fee units; or

(iii)wherethe attendance of the promotionis estimated to be in excessof 2000, 358·68 fee units.".

9Licence to act as a trainer, match-maker, referee, judge or timekeeper

(1)In regulation 7(2) of the Principal Regulations—

(a)in paragraph (a)(i), for "$70"substitute"7·17 fee units";

(b)in paragraph(a)(ii), for "$70"substitute"34·43 fee units";

(c)in paragraph(a)(iii), for "$100"substitute"7·17 fee units";

(d)in paragraph(a)(iv), for "$50; and"substitute"7·17 fee units; or";

(e) after paragraph (a)(iv) insert—

"(v)a timekeeper is 7·17 fee units; and".

(2)The note at the foot of regulation 7(2)(a)(iv) of the Principal Regulations is revoked.

10Registration as a professional contestant

In regulation 8(1)(b) of the Principal Regulations, for "$50"substitute"7·17 fee units".

11Schedule—Form 1 Application for promoter's licence

(1) In Form 1 of the Schedule to the Principal Regulations, after clause 7 insert—

"8.I acknowledge that I am required to pay the prescribed fee set out in regulation 5(2)(a) of theProfessional Boxing and Combat Sports Regulations 2008at the time of submitting this
form.

Note

The prescribed fee is payable by cheque, money order, credit/debit card.

Cash payment is not accepted.".

(2) In Form 1 of the Schedule to the Principal Regulations omit—

"The licence fee for a promoter is $225.

Credit card/Debit card

NOTE: Cash payment is not accepted.".

12Schedule—Form 2 Application for a promotion permit

(1) In Form 2 of the Schedule to the Principal Regulations, after clause 13 insert—

"14.I acknowledge that I am required to pay the prescribed fee set out in regulation 6(1)(b) of theProfessional Boxing and Combat Sports Regulations 2008at the time of submitting this
form.

Note

The prescribed fee is payable by cheque, money order, credit/debit card.

Cash payment is not accepted.".

(2) In Form 2 of the Schedule to the Principal Regulations omit—

"Promotion permit fee: $100

Payable by:

Cheque

Money Order

Credit card/Debit card

NOTE: Cash payment is not accepted.".

13Schedule—Form 3 Application for licence as trainer, matchmaker, referee, judge or timekeeper

(1)In Form 3of the Schedule to the Principal Regulations, after clause 12 insert—

"13.I acknowledge that I am required topaythe requisiteprescribed fee set out in regulation7(2)(a) ofthe Professional Boxing and Combat SportsRegulations2008 at the time ofsubmittingthis form.

Note

The prescribed fee is payable by cheque, money order, credit/debit card.

Cash payment is not accepted.".

(2)In Form 3 of the Schedule to the Principal Regulations omit—

"Licence fees:

Trainer: $70.00

Match-maker: $70.00

Referee: $100.00

Judge: $50.00

Timekeeper: No fee required

NOTE: Cash payment is not accepted.

Payable by *cheque/money order/credit card/debitcard".

14Schedule—Form 4 Application for registration as a professional contestant

(1)In Form 4of the Schedule to the Principal Regulations, after clause 9 insert—

"10.I acknowledge that I am required to pay the prescribed fee set out in regulation 8(1)(b) of theProfessional Boxing and Combat Sports Regulations 2008 at the time of submitting this
form.

Note

The prescribed fee is payable by cheque, money order, credit/debit card.

Cash payment is not accepted.".

(2)In Form 4 of the Schedule to the Principal Regulations omit—

"Registration fee: $50

Payable by:

Cheque

Money Order

Credit card/Debit card

NOTE: Cash payment is not accepted.".

Fee Units

These Regulations provide for fees by reference to fee units within the meaning of the Monetary Units Act 2004.

The amount of the fee is to be calculated, in accordance with section 7 of that Act, by multiplying the number of fee units applicable by the value of a fee unit.

The value of a fee unit for the financial year commencing 1 July 2016 is $13.94. The amount of the calculated fee may be rounded to the nearest 10cents.

The value of a fee unit for future financial years is to be fixed by the Treasurer under section 5 of the Monetary Units Act 2004. The value of a fee unit for a financial year must be published in the Government Gazette and a Victorian newspaper before 1 June in the preceding financial year.
