SHOW CAUSE NOTICE

Sub:- Commercial Taxes Department – Revision of finalized seniority in the

cadre of DCTOs – Consequent on inclusions at Zonal level – Revision of

State wide integrated seniority list of DCTOs proposed in view of

including the names of Sri Md.Jawahar Ali Khan, DCTO (Retd),

SriMd.Sharjahan, DCTO, (Retd) and Sri M. Ramalinga Sastry,

DCTO (Retd) – Show cause notice issued to the affected persons

– Written objections called for -Regarding.

Ref:- 1. A.P. Gazette No331 dated 20.8.2004 wherein seniority list of DCTOs

of all Zones finalized and published from the panel year 1975-76 to

1996-97.

3. A .P. Gazette No. 103 B dated 24.2.2006., wherein the seniority list of

DCTOs of Zone-VI revised and finalized from the panel year 1975-76 to

1996-97 consequent on changes made in lower cadre in Zone-VI

seniority list of DCTOs from the panel yeatr 1975-76 to 1996-97

published consequent on certain inclusion made in Zone V and revision

of Zone VI to the A.P.Gazette No.331 dt 20.8.2004.

ORDER:

In the reference Ist cited the final integrated seniority list and zonal seniority list of DCTOs of all Zones was finalized and published from the panel year 1975-76 to 1996-97

In the reference 2nd cited, state wide integrated seniority list of DCTOs for the period from 1997-98 to 2002-03 was finalized.

Due to certain changes made in the integrated seniority list of ACTOs of Zone VI the seniority list in the cadre of DCTO was revised and finalized for the period from 1975-76to 1996-97 vide Reference 3rd cited.

In view of certain changes made in Zoanl wise seniority list of DCTOs of Zone V and VI, the state wide integrated seniority list of DCTOs from 1975-76 to 1996-97 has been revised and finalized vide A.P. Gazette No. 260 dated 5.5.2006 vide reference 4th cited.

The seniority list of DCTOs of all zones for the period from 1997-98 to 2004-05 was prepared and finalized Vide A.P. Gazette No.303 dt 30.5.2006 in the reference 5th cited.

In the reference 6th cited, the state wise Integrated seniority list of DCTOs of all zones was revised after inclusion of the names of S/Sri G. Rathnagiri Babu, D.Yadagiri, B.Surya Rao and B.Bhaskar in the panel year 1993-94 vide A .P. Gazette No. 180 dated 09.5.2008.

In the reference 7th cited, the Govt have issued orders to Sri Mohd Jawahar Ali Khan, DCTO (Retd.)was included in the panel year 1984-85 of ACTOs of Zone VI in the light of the orders of the Government vide G.O.Rt.No.1505 Rev(CT.I) Dept dt 23.7.2008 Consequent on inclusion in the cadre of ACTOs, of Zone-VI, a show cause notice was issued by proposing the name of the individual to include at Sl.No. 231 A i.e. the below the name Sri G. Ravinder Reddy, above the name G. Madhusudhan Rao, in the finalized seniority list of ACTO vide A.P. Gazette No. 823 dt 2.12.2008.

In the reference 8th cited, the Govt have issued orders to Sri Md. Sharjana DCTO(Retd) was included in the panel year 1984-85 of ACTOs of Zone – VI in the light of the orders of the Government vide G.O.Ms.No. 1526 Rev., (CT.I) Dept. dt 18.12.2008. Consequent on inclusion in the cadre of ACTOs of Zone-VI, a show cause notice was issued by proposing the name of the individual to include at Sl.No. 231-B, below the name Sri Md. Jawahar Ali Khan, DCTO (Retd.) at Sl.No.231-A and above the name of Sri G. Madhusudhan Rao, at Sl.No.232 in the finalized seniority list of ACTO vide A.P. Gazette No. 823 dt 2.12.2008.

In the reference 9th cited, the Govt have issued orders to include the name of Sri M.Ramalinga Sastry, DCTO (Retd) in the panel year 1983-84 of ACTOs of Zone – III at Sl.No.88-A below Sri T. Raja Rao and above Sri G. Ramprasad Rao In pursuance to the seniority given in the cadre of ACTO, the individual was given notional seniority in the cadre of DCTO and included in the panel year 1992-93 at Sl.No.133-A in the seniority list of DCTO i.e. above the name of Sri G. Ramprasad Rao and below the name of Sri T. Rajarao vide Reference 10th cited.

In the reference 11th cited, a show cause notice was issued to include their names in the finalized seniority list of DCTOs of Zone-VI in the panel year 1995-96 at Sl. No. 292A and 292B, i.e below the name of Sri G. Ravinder Reddy at Sl.No. 292 and above the name of Sri G. Madhusudan Rao at Sl.No. 293 in the finalized seniority list of DCTOs of Zone VI which was published in A.P. Gazette No. 103 B dt 24.2.2006 duly deleting the names of the individuals at Serial Nos. 65 and 67 respectively in the finalized seniority list of Zone-VI for the period from 1997-98 to 2004-05 published in A.P. Gazette No. 303 dt 30.5.2006. No objections have been received from the affected persons. Therefore the seniority list of DCTOs of Zone VI was finalized after the inclusion of the above names in the panel year 1995-96 and confirmed vide reference 12 cited.

In view of the above inclusions the names of Sri M.Ramalinga Sastry in the panel year 1992-93 and the inclusions of Sri Md. Jawahar Ali Khan, DCTO (Retd), Sri Md. Sharjahan, DCTO, (Retd) in the panel year 1995-96, the state Wide Integrated seniority list of DCTOs of all Zones is accordingly to be revised as annexed to this proceedings up to the panel year 2002-03.

Hence, the persons who are affected by this proposed inclusions in the State wide finalized integrated seniority list of DCTOs may file their written objections, if any, within (15) days of publication of this notice failing which it would be construed that they have no objection to the proposed inclusions in the seniority and orders will be passed without further notice and time.

The proposed seniority list will be subject to the out come of SLPs / WPs / OAs, if any pending before Hon’ble Supreme Court/ High Court/ APAT as well as appeals pending before the Government.
