PARISH COUNCIL REPRESENTATION ON ROUTH WIND FARM COMMUNITY FUND DECISION PANEL

The constitution of Routh Wind Farm Community Fund states that the Parish Council can appoint one representative from the parish of Routh and one representative from the parish of Tickton to be members of the Fund Decision Panel.

The constitution does not state whether relevant parish council distinguishes Tickton and Routh as 2 councils or as only one

Q1 Does the council want to restrict ‘relevant’ to Routh councillors for Routh representative and Tickton councillors for Tickton representative or for all to agree both representatives?

The constitution does not state that the representative has to be a councillor

Q2Does the council want to restrict membership to councillors only? If so is it by residence or representation? And if so do they cease to be representatives immediately if they resign from council or are not re-elected?

Q2 If the representative does not need to be a councillor how will they be nominated and do they need to be resident in the parish concerned?

The constitution states that the term of office for a Panel member shall be three years normally and no Panel member may serve more than two consecutive terms

Q3Does the PC agree to this term of office or do we want to state our own (ie must be compatible with constitution)?

The constitution states that a Panel member ceases to be a panel member if he or she

(a)Resigns in writing

(b)Is removed by a majority vote of the panel for conduct prejudicial to the Fund

(c)Ceases to qualify for membership as representative of parishes

(d)Is absent without good reason for three consecutive panel meetings

Q4Under which circumstances would the representatives cease to have the mandate of the PC? Would there be a different rationale at the annual review?

The ongoing relationship between the‘representative’ and the PC is not stated in the constitution - indeed what does the word ‘representative ‘mean? It is beneficial for both the PC and the candidates to have this in writing.

Q5Does the ‘representative’ have totally autonomy in decision making?

Q6What is the ‘representative’ required to feedback to the PC?

Q7What role does the ‘representative’ have in relation to any PC application to Rouththe Wind Farm Community Fund?

All Parish Councillors appointed to the Routh Wind Farm Community Fund Decision Panel must declare this as a non-pecuniary nomination by the Parish Council to anoutside body.
