  4. What is the extent of the backlog of “pot hole” repair in the North West Province,
  5. Have there been any claims from public and/ or any other body on the department due to damage sustained as alleged due to “pot hole” related events,
  6. If so how many, and,
  7. What is the monetary extent of the claims and outstanding claims against the department?

The bridge over the Elands River, on road D1913 between Lichtenburg and Rosmincol, partially washed away some 12 months back.

  1. What was the extent of the damage to the bridge,
  2. Has the bridge been repaired or re-built,
  3. If not,
  1. Why not,
  2. What are the plans to repair the bridge and when,
  3. What are the safety conditions of the bridge as it stands, and does this comply with accepted safety standards,
  4. Have any accidents been recorded at this damaged bridge
  5. If so, give full details
  1. What would the cost be to repair this bridge?

With regard to Gr 12 without I.D Books, will the MEC please indicate:

(i)What programs does the department have in place to ensure that learners have their ID Books by Grade 12;

(ii)What does the department do if a learner in Grade 12 does not have an ID Book due to failure to apply or delays at the Department of Home Affairs;

(iii)Whether there is a widespread problem in North West of learners in Grade 12 not having ID Books, thus being unable to write matric exams; and

(iv)Does the department have any plans to invite the Department of Home Affairs to assist with this problem?

With regards to police brutality, will the MEC please indicate:

(i)How many cases have been reported of Police Officers who assaulted people in North West the past year since April 2010,

(ii)Please list Police Officer’s name and station,

(iii)Please list the kind of assault which took place,

(iv)Date of assault; and

(v)What corrective steps have been taken by the station commander or superintendent?

With regards to the cell phones paid by the department, will the MEC please indicate:

(i)How many new cell phones has the department and all its entities

(ii)Purchased in the last twelve months

(iii)How may have been reported stolen, damaged or misplaced by staff;

(iv)How many staff members buy their phones if they move to alternative employment;

(v)How many staff members remain on the cell phone contract of the department after they have been employed elsewhere;

(vi)Why has the department paid the cellular phone account of any employee after termination of employment for any reason;

(vii)What has this cost the department;

(viii)How many does the department and all its entities spend per annum on cellular phone accounts of employees; and

(ix)How many employees does the department provide paid cellular phones to?

(iii)Please supply a list of people’s names/board that conducted the interview of candidates, and their relevant positions/authority to conduct said interviews.

(iv)How many candidates were shortlisted for the interviews

(v)Kindly provide the criteria list of necessary qualifications that the candidate needed for this position.

(vi)Please indicate whether the successful candidate complies with all the necessary criteria for this position.

that received a pass rate of less that 30% in 2009.

A tar road D3527, was upgraded / being upgraded, under contract NWTR60/08a between Tosca and Donnybrook, in the Tosca Local Municipality,

  1. What were the specifications to which this road was to

be built, please attach a copy of specifications,

  1. Was this specification adhered to,
  2. If not, what actions were taken against the contractor,
  3. If no actions was taken, why not.

The construction of the building in Vryburg, known as the “Mini Garona” was stopped some 12 + months back;

  1. To who was the original contract awarded,
  2. Has this contractor been awarded any other contracts

by your Department in the North West Province,

  1. If so, which, and what is the state of each of these

contracts, in detail, as below,

  1. Why was the contract terminated,
  2. What was the estimated completion percentage

achieved at termination of the contract,

  1. What was the original tender price awarded,
  2. What was paid to the original contractor at termination,
  3. Is there any litigation due and / or in process relative to

the contract,

  1. What is the Department’s plan to complete the project,
  2. What is the expected cost to completion and will there

be any additional costs over and above the original

estimated / tender value,

  1. If so, what is the reason for any cost, ie “new tender”

and / or some inflation, and what will be the extent of

each of these categories.

QUESTION POSED BY HON. FRANZSEN TO THE MEMBER OF EXECUTIVE COUNCIL RESPONSIBLE FOR PUBLIC SAFETY [20100518-W17]

Background;

  1. A lease agreement was signed between your

Department and “Hemco Ondernemings BK”

on or about the 24 November 2004 for implementation,

on or about the 1st November 2004, for a period

36 months, for the operating of a weighbridge in the

Brits area,

  1. On 20 July 2007, “Hemco Ondernemings BK” requested

an extension to this contract / lease agreement of 60

months, no reply was received,

  1. Thus it was presumed that the original lease agreement

was still valid and in place, as,

  1. The weighbridge remained operational, and operated

by officers of the North West Traffic Department in Brits,

till +- October 2009, and the required rental had been

paid to this date,

  1. Since October 2009 no rentals has been paid to

“Hemco Ondernemings BK”.

  1. Instructions were then apparently given within the

Department to stop referring trucks to this weighbridge,

date unknown,

  1. The “Lessor – Hemco Ondernemings” has been

submitting invoices for rental due every month, and

paying the required VAT over the Receiver of Revenue

every months, without receiving any revenue from the

Department, to date.

QUESTION TO THE MEC

  1. Is the Member responsible for Safety, and or his senior

management aware of this contract and its contractual implications,

  1. If not, why not,
  2. If yes, why is the Department not acknowledging it’s

Contractual obligations,

  1. Is the Department receiving invoice for rental for the of

this weighbridge form “Hemco Ondernemings BK”,

  1. If yes, why are they not being paid,
  2. If not, has any correspondence been forwarded to

“Hemco Ondernemings BK” to inform them as to why

they should not be paid, and / or to cancel the rental

agreement,

  1. Lastly, who is operating, and / or assisting to operate the

“Hemco Ondernemings BK” weighbridge, and for what

Purpose,

  1. If not, is any other weighbridge in the area

Supplementing the “Hemco Ondernemings BK” for the

Same purpose,

  1. If so, where is this weighbridge, and who owns it, and
  2. Why is any other weighbridge being utilized while a

Contract exists between the Department and

“Hemco Ondernemings BK”?

1
