MINUTES FOR THE TOWN OF WEST BATH’S

SPECIAL TOWN MEETINGDECEMBER 16, 2009

A legal Special Town Meeting was held at the West Bath Fire Hall in the Town of West Bath, Maine, on 16 December 2009. The meeting was called to order at 6:30 pm by Robert Morris, Town Clerk for the Town of West Bath, who subsequently read the warrant through to Article 2.

Article 1. Roger R. Therriault was nominated as moderator. By way of written ballot, Mr. Therriault was voted as Moderator (8-0) and sworn in by Robert Morris at 6:32 am.

The Pledge of Allegiance was said.

Article 2. To see if the Town will vote to authorize the Selectmen to market, sell and transfer properties designated within the West Bath Wing Farm Business Park under such terms and conditions, and with such restrictions and covenants, as may be deemed in the best interests of the Inhabitants of the Town of West Bath and in accordance with the Economic Development Grant from the Federal Economic Development Agency of the United States Department of Commerce. In carrying out the authority granted under this Article, the Selectmen shall have the authority to utilize the West Bath Development Corporation (the organization of said Development Corporation having been authorized by vote of the 2008 Town Meeting – Article 25), including a transfer of the property to the Development Corporation should the Selectmen deem it to be in the best interests of the Town and to promote effective marketing of the property. Any proceeds from the sale of the property shall inure to the Town of West Bath to be used first for the payment of any debt service or development costs on the property.

Article 3. Shall the Town vote to amend its Land Use Ordinance, Article II, Land Use Districts, Overlay Zones and Requirements, Section A. 5, District 5, Urban Development Park, to change the zoning of Tax Map R-1 Lot 2 from Rural Residential (RR) to Urban Development Park (UDP)?

(Note: This lot is owned by the Town and is located adjacent to the proposed Wing Farm expansion area.)

Article 4. Shall the Town vote to amend its Land Use Ordinance, Article II, Land Use Districts, Overlay Zones and Requirements, Section B1., Table of Uses, C. 3, Resource Utilization, to permit agricultural or horticultural roadside stands in the residential district; and to add language specifying “off-street parking only”.

Article 5. Shall the Town vote to amend its Land Use Ordinance, Article II, Land Use Districts, Overlay Zones and Requirements, Section B1., Table of Uses, E.6, Retail Business and Consumer Service Establishments, as follows:

6. Veterinary establishments, kennels, pet shops or similar establishments provided that animals can be kept wholly indoors except if on a leash and accompanied by staff for short periods of time.

Motion made and seconded, by verbal acclamation, the town voted to adjourn at 6:47 pm. Approved.
