Intention to Declare a Special Charge Scheme to construct roads in the Hillmartin Lane area, Diamond Creek

Nillumbik Shire Council proposes to declare a Special Charge Scheme under section 163 of the Local Government Act 1989 (the Act) for road construction in the Hillmartin Lane area, Diamond Creek.
The road construction involves the sealing of Hillmartin Lane, Sutherland Road (between Larch Crescent and Diamond Creek Road), Larch Crescent, Fielding Road and Starling Road, Diamond Creek. The total project cost is $773,303.31. The levied amount is $773,303.31 with a benefit ratio of ‘one’ (100 per cent).
The apportionment of costs for road construction is based on 75 per cent benefit cost and 25 per cent abuttal cost to each property. The special charge for this scheme will remain in force for ten (10) years.
Submissions regarding Council’s proposal to declare a Special Charge Scheme will be considered in accordance with section 223 of the Act. Submissions should be made in writing to Council within 28 days after the date of this notice.
A person who has made a submission may also speak in support of the submission or be represented by someone else. Submissions are expected to be considered at Council’s Policy and Services Committee meeting on 6 September 2016. It is anticipated that the scheme would then be declared at the Council meeting on 13 September 2016.
In addition to the right to make a submission outlined above, any person who will be liable to pay the special charge has the right to lodge an objection under section 163B of the Act. Objections should be made in writing to Council within 28 days of the date of this notice.

Copies of the proposed declarations are available for inspection at the Civic Centre in Civic Drive, Greensborough, for 28 days after the date of publication of this notice. A copy of the Council Report for the Hillmartin Lane Area Special Charge Scheme is available on Council’s website www.nillumbik.vic.gov.au.
