MINUTES OF THE PLANNING AND ZONING COMMISSION MEETING, HELD AT 7:00 P.M., SEPTEMBER 27, 2010, 711 NORTH GALLOWAY AVENUE, MESQUITE, TEXAS

Chairman Cruce called the meeting to order and declared a quorum present.

I.  APPROVAL OF THE MINUTES OF THE SEPTEMBER 13, 2010, MEETINGS

A motion was made by Mr. R. Allen and seconded by Ms. Dunn to approve the minutes of September 13, 2010. The motion passed unanimously.

II.  PUBLIC HEARING - REPLAT

A.  Consider a Preliminary Replat of El Rosa Addition, Block 1, Lots 18 and 19, submitted by Keeton Surveying Co., located at 301 & 303 W. Grubb Drive (El Rosa Addition, Block 1, Lot 19R).

Liz Butler briefed the Commission on the case summarizing Staff’s recommendations. Beatriz Velasquez presented the request on behalf of the applicant stating they had received and are in agreement with Staff recommendations. Chairman Cruce opened the public hearing. No one appeared and Ms. Cruce closed the public hearing.

A motion was made by Mr. R. Allen and seconded by Mr. Potter to approve the request with Staff recommendations 1 through 11. The motion passed unanimously.

III.  PUBLIC HEARINGS – ZONING

A.  Consider an application for an amendment to Planned Development (3933) Commercial to allow the property to permit and establish stipulations for Temporary Exposition Facilities, submitted by Kent Jones, Kent Jones, Inc., on property described as Big Town Addition, located at the southwest corner of U.S. Highway 80 and Big Town Blvd. (Zoning File No. 261-31A-2010).

This request was withdrawn by the property owner prior to the start of the meeting.

IV.  PUBLIC HEARINGS – ZONING TEXT AMENDMENT

B.  Consider amendments to 3-203, 3-600, and 6-100 of the Mesquite Zoning Ordinance pertaining to restrictions on the use, location and appearance of outdoor vending machines (Zoning Text Amendment File No. 2010-3).

Liz Butler briefed the Commission on the case summarizing Staff’s recommendations. Staff and Commissioners discussed the square footage limitations, restrictions for multi-tenant buildings and window coverage limitations in regard to placement of outdoor vending machines. Chairman Cruce opened the public hearing. No one appeared and Ms. Cruce closed the public hearing.

A motion was made by Mr. Akin and seconded by Ms. Adams to approve the request with changes to Staff recommendations as follows: C.2. adding “except where the primary façade is greater than 50% transparency in which case one vending machine may be placed in front of a window” and; E.3. adding “except where a suite in the multi-tenant building is 45,001 square feet or greater, in which case outdoor vending machines will be allowed according to the table above”. The motion passed unanimously.

V.  DIRECTOR’S REPORT

A.  Report on recent City Council action.

Jeff Armstrong reported on recent and upcoming Planning and Zoning items.

There being no further business for the Commission, Chairman Cruce adjourned the meeting at 7:50 P.M.
