SUMMARY RECORD OF THE FOURTH MEETING OF STATE LEVEL EXPERT APPRAISAL COMMITTEE, CHHATTISGARH

The fourth meeting of State Level Expert Appraisal Committee, Chhattisgarh was held on 3rd May 2008 at State Level Expert Appraisal Committee, Secretariat at 02.00 P.M. Dr. Harendra Kumar, Chairperson, SEAC, Chhattisgarh chaired the meeting. The following members of SEAC were present in the meeting:-

At the outset, the Nodal Officer, SEAC, Chhattisgarh welcomed the Chairman and Members of State Level Expert Appraisal Committee, Chhattisgarh. Agenda-wise discussions were carried out with details as follows:-

Agenda Item No.1:- M/S Mahavir Coal Washery Private Limited, Village- Bhelai, Distt- Janjgir-Champa (Continued Discussion- TOR)-

Due to paucity of time in third meeting, committee asked the project proponent to submit the information regarding distance of proposed coal washery from the Korba area and the details of coal linkages / commitments/ MoUs/ agreements including raw coal supply sources from customers of whose coal would be washed. In the third meeting, committee decided that after receipt of the information from project proponent, adequate decision would be taken in the next meeting. Project proponent submitted the information regarding distance of village Bhelai from the boundary of Korba district and photocopy of offer letters from M/s Bharat Aluminum Company Limited, Korba, M/s Gitanjali Ispat and Powers Limited, Bilaspur, M/s Airan Steel and Power Private Limited, Bilaspur, M/s Shri Radhe Industries Limited, Bilaspur, M/s Kalindi Ispat Private Limited, Bilaspur, M/s Aryan Ispat & Power Private Limited, Sambalpur, M/s API Ispat & Powertech Private Limited, Raipur etc. regarding washing of coal. It is mentioned in the offer letter of respective industry that they have linkage of coal from various mines of SECL. Accordingly, discussions in this case were continued. After detail deliberation, Committee was in opinion that at present Korba area is the main source of coal supply for industries of the Chhattisgarh State. These industries are distributed in whole of the State, and even most of the industries situated out the State are also procuring coal from Korba area. To meet the increasing demand of coal from Korba area, the mines of Korba area are also expanding their capacity, for which respective coalmines are seeking Environmental Clearance considering all environmental aspects and impacts on various environmental parameters including transportation. Therefore, each and every industry procuring coal from Korba area (situated in the vicinity or away from Korba area) may not be considered as Category-A project, even if the proposed unit falls in Category-B and belongs to another district/ state; merely on the grounds that the indirect source of coal supply is Korba and much of the air pollution problem in Korba is due to mineral transportation by road. The committee further held that in such cases where the project proponent is not involved in direct additional coal mining from Korba area through its own operations, the project proponent cannot be held responsible for such mining operations. In the present case the project proponent is just offering coal washing services to its clients for which sufficient proof has been provided. The Committee was unanimously of the opinion that as per the certificate from District Land Record Department, District:Janjgir-Champa and toposheet of the area village- Bhelai, District- Janjgir-Champa is situated more than 10km away from the boundary of Korba District. Hence, general condition of Schedule of EIA Notification, 2006, would not be applicable for proposed project, therefore; the screening, scoping and appraisal of proposed project would be done at State level.

The Committee was unanimously of the opinion that the study area should cover an area of 10 km radius around the proposed site and surface water, ground water, soil, noise and ambient air quality should be monitored at-least at eight locations around the proposed site.

The proposed project does not fulfill the criteria as mentioned in general condition of Schedule of EIA Notification, 2006, hence falls under Category ‘B’. Based on the consideration of the documents submitted, the presentation made by the project proponent and discussion held, the Committee decided that the proposed project should be considered as ‘B1’ category and prescribed the Terms of Reference (TOR) for preparing draft EIA report for the above-mentioned project. The prescribed Terms of Reference (TOR) for preparing draft EIA report is enclosed as Annexure-I.

Agenda Item No.2:- Discussion On The Proposals Received For TOR/EC As Per Provisions Of The Environment Impact Assessment Notification, 2006-

(1) M/s Central Cement Industries, Post- Sarona, Teh- Tilda, District – Raipur.

The Project proponent submitted application (Form-I and Feasibility Cum Detailed Project Report) for prescribing Terms of Reference (TOR) for preparing draft EIA report. The Project Proponent has proposed to establish cement manufacturing plant by vertical shaft kiln technology. The brief of the project is as follows:

After deliberation, following decisions were taken:

·  In application form PP has mentioned that the site is located at industrial area at various places, whereas, PP has not submitted the details of industrial area. PP has also not submitted the land allotment letter issued from Industrial Area Management. It seems that the site is located in the private land. Accordingly revision of the Form-I is required.

·  The information mentioned in Form-I at points: 1.1, 1.2, 1.3, 1.4, 1.5, 1.6, 1.7, 1.8, 1.13, 1.14,1.18,1.20,1.24,2.1,3.4,4.2,5.2,5.3,9.1,III (5,8,9) are incomplete/ in adequate. Accordingly revision of the Form-I is required.

·  PP should be asked to submit the layout plan and area map of 10 km radius showing major topographical features such as land use, drainage, location of habitats, major construction including railways, highways, pipelines, major industries / mines and other polluting sources etc,; details of raw materials source.

·  PP has mentioned that State boundary falls within 10 km from proposed project location. Accordingly verification /rectification of the statement are required.

The Committee decided that PP should be asked to submit the above information along-with properly filled Form-I, so that application could be considered by the Committee. PP should be intimated accordingly.

2. M/s Mopar Lime Stone Mine, Village- Mopar, Tehsil- Bhatapara, District- Raipur.

The Project proponent submitted application (Form-I, Mining Plant and Project Report) for prescribing Terms of Reference (TOR) for preparing draft EIA report. The Project Proponent has proposed to establish Lime Stone Mine of capacity 3000 Tonnes Per Annum. The brief of the project is as follows:

After deliberation, following decisions were taken:

·  The Mining Plan submitted was approved by Indian Bureau of Mines, Nagpur on dated 16/07/2002. Normally, the Mining Plans approved for 05 years. PP should be asked to submit the duly approved progressive Mine Closure Plan along-with financial assurance as per prevailing relevant Mining Acts / Rules.

·  The information mentioned in Form-I at points: 1.1, 2.6, 4.2, 9.4 are incomplete/ in adequate. Accordingly revision of the Form-I is required.

·  PP should be asked to submit the layout plan and area map of 10 km radius showing major topographical features such as land use, drainage, location of habitats, major construction including railways, highways, pipelines, major industries, mines and other polluting sources etc.

The Committee decided that PP should be asked to submit the above information along-with properly filled Form-I, so that application could be considered by the Committee. PP should be intimated accordingly.

3. M/S Ambuja Reality, Village- Saddu, Tehsil- Raipur, Distt. Raipur.

The Project proponent submitted application (Form-I, Form-I A) for obtaining Environmental Clearance for Shopping Mall, Multiplex, Hotel, Clubs and Office Buildings. The brief of the project is as follows:

After deliberation, following decisions were taken:

The Committee came to know that PP has already submitted the application to Ministry of Environment and Forests, Government of India for Environmental Clearance. The case is being considered in the 60th meeting of Expert Appraisal Committee for New Construction and Industrial Estates Projects to be held on 1st -3rd May, 2008 as per Ministry of Environment and Forests, Government of India letter No. 19-9/2008-IA-III, dated 16/04/2008.

As the case is already being considered at Ministry of Environment and Forests level, the Committee decided that this case could be considered by SEAC, Chhattisgarh after receipt of the case from MoEF. Accordingly, Project Proponent may be intimated.

4. M/S. K. L. Energy and Coal Benification Private Limited, Works: Village- Dehjari, Kharsiya, District – Raigarh.

The Project proponent submitted application (Form-I, Project Report) for prescribing Terms of Reference (TOR) for preparing draft EIA report for Coal Beneficiation & Power Plant. The brief of the project is as follows:

After deliberation, following decisions were taken:

The Committee came to know that PP has already submitted the application to Ministry of Environment and Forests, Government of India for prescribing Terms of Reference (TOR) for preparing draft EIA report. As per Ministry of Environment and Forests, Government of India vide letter No. J-11015/17/2008-IA.II(M), dated 17/03/2008, the case was considered in the EAC (T&C) meeting held on 26th – 27th February,2008 at New Delhi. In this letter it is mentioned that the proposal is for an integrated project of setting up a coal washery and a linked coal rejects based Thermal Power Plant. Since this would be considered by the EAC(T&C) in the meeting to consider thermal power project, it was decided to transfer the file to the Thermal Division of the MoEF for consideration of the proposal in that meeting and further action on the matter.

As the case is already being considered at Ministry of Environment and Forests level, the Committee decided that this case could be considered by SEAC, Chhattisgarh after receipt of the case from MoEF. Accordingly, Project Proponent may be intimated.

5. M/S. Sarda Energy & Minerals Limited, Village- Karvahi & Khamhariya, District- Raigarh.

The Project proponent submitted application (Form-I and Pre Feasibility Project Report) for prescribing Terms of Reference (TOR) for preparing draft EIA report. The Project Proponent has proposed Coal Washery of capacity 0.96 Million Tonnes per year. The brief of the project is as follows:

After deliberation, following decisions were taken:

·  The information mentioned in Form-I at points: 1.1, 1.3, and 1.5 are incomplete/ in adequate. Accordingly revision of the Form-I is required.

·  Location of the proposed coal washery is not clear from the application submitted. PP should be asked whether the proposed site of coal washery is within the lease area of existing coal mine. PP should be asked to submit the exact location details of the proposed coal washery.

·  PP should be asked to submit the coal allocation letter showing the details of coal to be used from existing coal mine.

·  PP should be asked to submit the copy of Environmental Clearance and compliance statement of Environment Clearance issued for exiting coal mine.

·  PP should be asked to submit the details regarding use of washed coal (name of industry and purpose).

·  PP should be asked to submit the layout plan and area map of 10 km radius showing major topographical features such as land use, drainage, location of habitats, major construction including railways, highways, pipelines, major industries / mines and other polluting sources etc.

The Committee decided to ask the PP to present the case along-with above information and issues like site details, existing condition, land document, permission from concerned authority (power supply, water supply), materials balance, manufacturing process / flow sheet, water source, consumption with water balance and effluent generation, treatment and reuse, emission sources and emission control systems with specification, solid waste / hazardous waste management, DG set and noise pollution control, greenbelt, fugitive emission, storage yards, proposed monitoring stations details along-with justification for selection, proposed EMP along-with community welfare/eco development works to be carried out and other relevant issues along-with proposed TOR. PP should be intimated accordingly.

6. M/S.Saini Industries Limited, Plot No.80 A,B,C, 82-B & C, Phase-Ii, Siltara Industrial Area, Distt. Raipur.

The Project proponent submitted application (Form-I and Pre Feasibility Report) for prescribing Terms of Reference (TOR) for preparing draft EIA report. The Project Proponent has proposed Induction Furnace Unit and expansion in existing TMT Bar Rolling Mill. The brief of the project is as follows:
