Department of Technical Education(DTE) is inviting e-Auction bidding from interested Paper Mills / Reputed old paper trading firms having permission from Paper Mill for recycling (pulp) of (i) VALUED OLD and USED ANSWER BOOKLETS/DRAWING SHEETS(lot-1), (ii) OLD USED FORMATS / WASTE COVERS/ WASTE WRAPPERS(lot2) from Department of Technical Education, Tantrika Shikshana Bhavana, Palace Road, Bangalore – 560 001 “ as is where is” basis.

INSTRUCTIONS TO BIDDERS

TO PULP (1) “VALUED OLD and USED ANSWER BOOKLETS/DRAWING SHEETS” AND (2) “OLD FORMATS/WASTE COVERS/WASTE WRAPPERS” OF DTE THROUGH e –AUCTION PLATFORM OF GOVERNMENT OF KARNATAKA

Bids are invited by The Department of Technical Education(DTE), having its office at “Tantrika Shikshana Bhavana”, Palace Road, Bangalore – 560 001, represented by its Director from Paper Mills / Reputed Trading of old paper firms having permission from Paper Mill for recycling (pulp) of i) VALUED OLD ANSWER BOOKLETS/DRAWING SHEETS(lot-1) ii) OLD USED FORMAT / WASTE COVERS/ WASTE WRAPPERS(lot-2), through e-Auctions. The interested bidders may inspect the above said items, before quoting their bid in e-Auction platform. No dispute shall be entertained after finalization of the e-Auction.

1.  Eligibility CRITERIA:-

a)  The applicant shall be a proprietary / partnership firm / Pvt Ltd Company / Public Ltd Company and invariably be Income Tax Assessee during the last two financial years viz. 2009 – 10 & 2010-11.

b)  Income Tax assessed for the financial year 2009-10, financial year 2010-11. copy of the Return filed shall be provided.

c)  The applicant should compulsorily mention their TIN NUMBER obtained from Department of Commercial Tax, Government of Karnataka.

3. SUPPLY TERMS AND CONDITIONS:-

(i)  Material will be supplied on “as is where is” basis against full payment inclusive of all taxes.

(ii)  Supply will be made as per the supply terms and conditions of the Department and supply terms indicated herein are not negotiable.

(iii)  The successful bidder should pulp the purchased VALUED OLD ANSWER BOOKLETS, DRAWING SHEETS, OLD USED FORMAT, WASTE COVERS and WASTE WRAPPERS in Paper mills in presence of the officer deputed by the Director, Department of Technical Education.

(iv)  Agreement should be made by the successful bidder to do the pulp of the purchased VALUED OLD and USED ANSWER BOOKLETS, DRAWING SHEETS, OLD USED FORMAT, WASTE COVERS and WASTE WRAPPERS in an affidavit of Rs. 200/-

(v) The successful bidder before lifting the Material with in a stipulated period of 15 days from the date of intimation by the paper mill, should weigh empty trucks and then material filled trucks in Electronic weigh bridge in the presence of the officer deputed from DTE.

(vi)  The successful bidder should transport the material intact to the paper mill at their own cost.

4. EARNEST MONEY DEPOSIT [EMD]:-

(a) EMD needs to be paid by the bidder through e-Auction platform as mentioned in para 2 above.

(b) The refund of EMD for unsuccessful bidders will be as per procedure

mentioned in e-Auction Manual.

5. UPLOAD OF BIDDER’S CREDENTIALS / ELIGIBILITY DOCUMENTS

(i) The bidder shall upload the following documents in e-Auction Platform for the purpose of Pre-Qualification to e-Auctions.

·  Certificate confirming proprietary firm (from Bank or Chartered Accountant) / partnership firm (Partnership Deed copy) / private limited company / public limited company (Memorandum & Articles of Association)

·  Income Tax Assessed for the past two assessment years viz 2009-10 and 2010-11 Copies of Assessment Order / copy of Returns filed

·  Copies of K-VAT / CST Registration Certificates

·  PAN registration certificate

·  Bidder Details in Annexure-1 of this Document

·  The bidder is eligible only if Permission letter from Paper mill confirming that the material will be pulped at their mill. In case the permission letter is not obtained from paper mill, then the bidder should produce a proof for having pulped paper in a paper mill earlier.

6. SUBMISSION OF ORIGINAL DOCUMENTS:-

The bidder shall submit the originals of the uploaded documents in case needed for verification, at The Department of Technical Education, “Tantrika Shikshana Bhavana”, Palace Road, Bangalore – 560 001 at the time of Pre-Qualification scrutiny.

7. PRE-QUALIFICATION SCRUTINY

a.  The Pre-Qualification Bids are scrutinized by DTE on .27.03. 2012.

b.  The Pre-Qualification documents shall be evaluated by Auction Scrutiny Committee constituted by the Director, DTE, for confirming eligibility criteria of the applicants.

c.  Thereafter, in respect of confirming bidders, the pre-qualified bidders eligible for participation in e-Auctions would be informed through e-Auction Platform

d.  DTE reserves the right to reject all / any of the bids without assigning any reasons whatsoever.

e.  Interested Bidders are also invited.

8. CRITERIA TO CONSIDER BIDS INVITED THROUGH E-AUCTIONS:-

The sale award of e-Auctions will be decided as under:-

(a)  The highest bidder for lot-1 is allocated the entire quantity of lot-1 and the highest bidder for lot-2 is allocated the entire quantity of lot-2 as indicated in para (2) above. In case if a bidder quotes highest bid for both (lot-1 and lot-2) the sale award of e-Auction is allocated entire quantity of lot-1 and lot-2. No sale quantity of part-lot will be considered.

(b)  The EMD amount will be forfeited, if the successful bidder fails to make the payment within specified period as mentioned in Letter of Intent.

(c)  DTE reserves the right to reject all / any of the bids without assigning any reasons whatsoever.

9. LIFTING 0F MATERIAL:

The successful bidder shall lift and transport the entire material within fifteen days from the date of issue of delivery order at their own cost.

10. RESERVE PRICE: *

The DTE has fixed a reserve price * (i) Rs.12/- (Rupees Twelve only) per Kg for VALUED OLD and USED ANSWER BOOKLETS/DRAWING SHEETS(lot-1) and Rs.8/-(Rupees Eight only) per Kg. for OLD USED FORMATS / WASTE COVERS/ WASTE WRAPPERS(lot-2). The bidder shall quote a price over and above the reserve price. The incremental increase in a bid should be of Rs.0.5/- for VALUED OLD and USED ANSWER BOOKLETS/DRAWING SHEETS(lot-1) and Rs.0.5/- for OLD USED FORMATS / WASTE COVERS/ WASTE WRAPPERS(lot-2) and multiples thereof. Bids equal to or less than the reserve price will not be accepted by e-Auction platform of Government of Karnataka.

Note :“ Reserve Price” is the DTE fixed minimum basic material price as per prevailing market condition. It is excluding royalty, loading charges and other applicable taxes, which shall be paid separately and additionally by the successful bidder at the time of lifting of the material. Quotes equal to or less than reserve price will not be accepted by the e-Auction platform.

11. SALE AWARD:-

The successful bidder shall remit the full value of material before lifting the material. Payment shall be made through by Cash, DD’s from Nationalised Bank, electronic transfer of money (RTGS) from the allottee’s own bank account. to the DTE account at Bangalore. Also the successful bidder has to remit Sales Tax and all other Taxes for full value of the material to the cash section of DTE by cash.

The EMD of the successful bidder will be adjusted towards part of the sale value payable.

12. FORCE MAJEURE CLAUSE: -

In case, the contract could not be fulfilled / cancelled / terminated for any reason arising out of the laws//regulations / restrictions governing natural calamities, war/ hostility, military operation of any character, civil commotions, sabotage, quarantine restriction, acts of Government embargoes, the successful bidder shall not be entitled for any compensation.

13. ARBITRATION:-

Dispute that may arise between the parties, shall be settled through mutual discussion in good faith. The Director, DTE or his designated nominee shall be the sole Arbitrator for the purpose.

14. NON ASSIGNABILITY:-

The Sale Award / Letter of Intent issued to the successful bidder is not transferable or assignable in whatsoever manner. The awardee shall remit value of the material and lift the allotted material himself by following the due procedure prescribed. DTE will not entertain any third party nominee / assignee in what so ever manner on behalf of the awardee.

15. TERMINATION OF THE AGREEMENT:-

a)  In the event of any breach of any of the tender terms and conditions by the successful bidder and of the sale award or against the interest of The Department of Technical Education, DTE shall be free to cancel the Sale Award / Delivery Order, but without prejudice to the claims of The Department of Technical Education. The successful bidder shall have no claim against The Department of Technical Education and the decision of the Director, DTE in this regard shall be final.

b)  If the successful bidder do not lift the material within the specified period or in Extended period either in part or in full, 25% of the value of the un-lifted quantity will be forfeited.

16. PERIOD OF SALE:-

The allotted quantity out of approx. 40,000 Kgs. (VALUED OLD ANSWER BOOKLETS/DRAWING SHEETS) and approx. 10,000 Kgs. (OLD USED FORMAT / WASTE COVERS/ WASTE WRAPPERS) as the case may be shall be lifted within stipulated period (15 days) from the date of issue of delivery order or the extended period as notified by the DTE. In the event of failure to lift the material, within the originally allowed or extended time as the case may be, then 1% of the sale value of the un-lifted material will be charged as ground rent for every month.

a)  DTE will have the powers to extend the delivery period due to unforeseen circumstances at its discretion .

b)  The responsibility of DTE ends once the material is made available to the successful bidder .

17. COMPENSATION TOWARDS NEGLIGENT ACTIONS/DAMAGES AT THE GODOWN:-

Successful bidder / Sale awardee shall be responsible for any claims arising out of negligent actions/ damages on the part of sale awardee on any property belonging to the Company and to their personnel, or in an accident involving any personnel or labour, during loading, transportation and unloading.

18. DISCRETION:-

a) The Director , DTE reserves the right of rejection of all or any of the bids without assigning any reasons thereof.

b) The Director, DTE reserves the right to cancel the bid even after acceptance or during performance of the contract.
