PC E:I’m PC 469 David Samuels from the Child Protection Unit at Example Police Station. The date is Friday, 9th March 2018, the time is 12.20 and we are in a private interview room at Example Police Station. I am interviewing… Can you just tell me your name and date of birth?

ME:Ms Example.

PC E:Okay, this interview is being tape recorded. It may be given in evidence if your case is brought to trial. Can you just confirm that you saw the seals on the set of tapes broke?

ME:Yeah.

PC E:Yes, also present is my colleague…?

DC E:DC 456Example2.

PC E:You also have your solicitor with you.

MS:Mr Solicitor, solicitor from Example Solicitors.

PC E:Okay. Ms Example, you’re entitled to free and independent legal advice now or at any time during this interview. You have chosen to have Mr Solicitor here representing you, do you feel you have has enough time to consult with him before this interview started?

ME:Yeah.

PC E:Okay, and you’re happy to continue?

ME:Yeah.

PC E:You understand that that right runs all the way; it doesn’t just stop during the interview. If you feel at [inaudible 00:02:34] this interview that you need to talk privately with Mr Solicitor, if you tell us we’ll stop the tapes and you can speak to him. Okay?

ME:Okay.

PC E:Okay, we’re going to talk about two offences and you’re going to be interviewed for those offences. I’m going to tell you that you are under caution so you do not have to say anything, but it may harm your defence if you do not mention, when questioned, something which you later rely on in court. Anything you do say may be given in evidence, and the first part of that, Ms Example, you don’t have to say anything, that’s your right. You don’t have to answer any questions today. The second part, but it may harm your defence if you do not mention, when questioned, something which you later rely on in court… If you [fail? 00:03:42] to answer the questions today or you tell us one account today and it goes to court and you tell them something different, they may draw what they call an inference and they may think the reason you’ve either remained silent or told us a different story is that you’ve made it up in the meantime.

ME:Okay.

PC E:Okay, and the last bit, anything you do say may be given in evidence… It’s being recorded and DC Example2 is going to take some notes

ME:Okay.

PC E:Okay? So, do you have to answer the questions today?

ME:No.

PC E:If it goes to court and you tell the court something different to what you’ve said in here today, what might the court think?

ME:That I’ve made it up.

PC E:Okay, and how will the court know what’s being said in here today?

ME:From the recording.

PC E:Okay. So,Ms Example, you’re being interviewed today for Section 18 wounding with intent and [allow? 00:06:43] a child, namely Miss Example Child, to suffer serious physical harm and during this interview I’m going to speak to you about your knowledge of these offences, your current and past family status, your relationship and knowledge of Miss Example Child, any previous social services involvement and any previous allegations and anything else that we feel becomes relevant, and this interview is about finding out what happened and to give you the opportunity to give your explanation. We will approach it with an open mind, but we will check what you say. Okay?

ME:Yeah.

PC E:Just remember that the audio recordings don’t pick up gestures so don’t nod or shake your head, just say “yes” or “no” or “no comment”. So are you responsible for the offences which you are being interviewed for?

ME:I think I am for the child’s arm, yeah.

PC E:Tell me everything you know about it and don’t miss anything out.
