ANNOUNCEMENT ABOUT OUR NEW MULTI ENTERPRISE AGREEMENT

TAB Agencies in NSW believe the time is right to introduce a more beneficial package of employment conditions for you. So we can secure certainty over our working conditions with TAB Agencies in NSW, [insert employer name]and other NSW TAB Agencies are seeking to negotiate an Enterprise Agreement (“Agreement”) with you and your fellow employees.

What is an Enterprise Agreement?

An Enterprise Agreement is an agreement about the terms and conditions of your employment that is negotiated and between employees and their employer. In this instance [insert employer name] is negotiating collectively with other TAB Agencies in NSW for one agreement that will cover all NSW TAB Agencies that sign up to the Agreement, and whose employees validly approve the Agreement.

This agreement will cover most employees at NSW TAB Agencies who approve the Agreement.

Why do TAB Agents want an Agreement?

NSW TAB Agents want an agreement to:

  • Secure certainty over our working conditions
  • Have one clear set of working conditions across NSW TAB Agencies who approve the Agreement
  • Allow us to have a closer relationship and direct dialogue with you
  • Ensure the terms and conditions that apply to us, reflect the working arrangements that suit our employees and our business

Can I get somebody to represent me?

Yes, If you are a member of a union that is entitled to represent your industrial interests, such as the New South Wales Local Government, Clerical, Administrative, Energy, Airlines and Utilities Union (“USU”), the union will be your default bargaining representative, and you do not have to do anything to appoint anyone else to represent you if you do not want to. However you can also appoint a different person (including yourself) if you want to.

Any appointed bargaining representative will have to comply with the “good faith bargaining” obligations that are set out in the Act. These obligations include:

  • Attending and participating in scheduled meetings;
  • Responding to proposals made by other bargaining representatives for the agreement, including the TAB Agents Association of NSW, in a timely manner; and
  • Considering proposals of other representatives and giving reasons for their responses to those proposals in a timely way.

If you choose to appoint a bargaining representative who is not the default union, you must appoint that person in writing. You must also provide a copy of the written appointment to the bargaining representative you have appointed and also to [insert employer name]

For further information, we have also encloseda copy of your Notice of Representational Rights with this letter.
