Afterconsultinginaccordancewithparagraph28(1)ofSchedule5totheTribunals,CourtsandEnforcementAct2007([a]),theTribunalProcedureCommitteehasmadethefollowingRulesinexerciseofthepowersconferredbysections22and29(3)and(4)of,andSchedule5to,thatAct.
TheLordChancellorhasallowedtheRulesinaccordancewithparagraph28(3)ofthatSchedule.

10.—(1)TheTribunalmaymakeanorderforcostsonanapplicationoronitsowninitiative.
(2)Anyorderunderparagraph(1)—
(a)mayonlybemadeinaccordancewiththeconditionsorinthecircumstancesreferredtoinparagraphs(3)to(6);
(b)must,inacasetowhichsection4ofthe1961Act([c])applies,beinaccordancewiththeprovisionsofthatsection.
(3)TheTribunalmayinanyproceedingsmakeanorderforcosts—
(a)undersection29(4)ofthe2007Act(wastedcosts)andforcostsincurredinapplyingforanorderforsuchcosts;
(b)iftheTribunalconsidersthatapartyoritsrepresentativehasactedunreasonablyinbringing,defendingorconductingtheproceedings;or
(c)inthecircumstancestowhichparagraph(14)refers.
(4)Exceptinproceedingstowhichparagraph(5)or(6)apply,theTribunalmay—
(a)withtheconsentoftheparties,or
(b)wherethereisadisparityofinterestorresourcesbetweentheparties,

(8)Inproceedingstowhichparagraph(6)applies,theTribunalmusthaveregardtothesizeandnatureofthemattersindispute.
(9)Apersonmakinganapplicationforanorderforcosts,oradirectionregardingcosts—
(a)mustsendordeliverawrittenapplicationtotheTribunalandtothepersonagainstwhomitisproposedthattheorderbemade;
(b)mustincludeintheapplication,whereitisforadirectionregardingcosts,theperson’sreasonswhytheconditionsorcircumstancesrelevanttomakingsuchadirectionunderparagraph(4)or(7)apply;and
(c)maysendordeliverwiththeapplicationascheduleofthecostsclaimedinsufficientdetailtoallowsummaryassessmentofsuchcostsbytheTribunal.
(10)Anapplicationforanorderforcostsmaybemadeatanytimeduringtheproceedingsbutmaynotbemadelaterthan14daysafterthedateonwhich—
(a)theTribunalsendsadecisionnoticerecordingthedecisionwhichfinallydisposesofallissuesintheproceedings;
(b)theTribunalsendsnoticeunderrule20(withdrawal)thatawithdrawalwhichendstheproceedingshastakeneffect;or
(c)noticeofwithdrawalissenttotheTribunalwiththeconsentofallparties.
(11)TheTribunalmaynotmakeanorderforcostsagainstaperson(the“payingperson”)withoutfirstgivingthatpersonanopportunitytomakerepresentations.
(12)Theamountofcoststobepaidunderanorderunderthisrulemaybedeterminedby—
(a)summaryassessmentbytheTribunal;
(b)agreementofaspecifiedsumbythepayingpersonandthepersonentitledtoreceivethecosts(the“receivingperson”);or
(c)detailedassessmentofthewholeoraspecifiedpartofthecosts(includingthecostsoftheassessment)incurredbythereceivingperson—
(i)onthestandardbasis;or
(ii)ontheindemnitybasis,ifsospecifiedinthecostsorder,bytheTribunalorbytheSeniorCourtsCostsOfficeorbyacountycourt;
andtheCivilProcedureRules1998([e])shallapply,withnecessarymodifications,tothatapplicationandassessmentasiftheproceedingsintheTribunalhadbeenproceedingsinacourttowhichtheCivilProcedureRules1998apply.
(13)TheTribunalmayorderanamounttobepaidonaccountbeforethecostsareassessed.
(14)TheTribunalmayorderapartytopaytoanotherpartycostsofanamountequaltothewholeorpartofanyfeepaid(whichhasnotbeenremittedbytheLordChancellorundertheUpperTribunal(LandsChamber)FeesOrder2009([f]))intheproceedingsbythatotherpartythatisnototherwiseincludedinanawardofcosts.

EXPLANATORYNOTE
(ThisnoteisnotpartoftheRules)
TheseRules(“theamendingrules”)amendtheTribunalProcedure(UpperTribunal)(LandsChamber)Rules2010(S.I.2010/2600)(“theLandsChamberRules”)whichapplyintheLandsChamberoftheUpperTribunal.
Rule4oftheamendingrulessubstitutesanewRule10(ordersforcosts)intheLandsChamberRules.Thechangesintroducedbythesubstitutedrule10andthosemadebyamendingrules5and8implementrecommendationsrelevanttotheLandsChambermadeintheReportoftheCostsReviewGrouptotheSeniorPresidentofTribunals(
ThechangesrelatemainlytolimitingtheproceedingsinwhichtheLandsChamberoftheUpperTribunalmayawardcoststobepaidbythelosingpartytothesuccessfulparty.OtherchangesareconsequentialupontheconferralofadditionaljurisdictionontheUpperTribunalbytheTransferofTribunalFunctionsOrder2013(S.I.2013/1036).ThetypesofproceedingsinrelationtowhichtheLandsChamber’spowertoawardcostsismaintainedare—
—judicialreview;
compulsorypurchase;
injuriousaffectionofland;
dischargeormodificationofrestrictivecovenantsaffectingland;
appealsfromtheValuationTribunalforEnglandortheValuationTribunalforWales.
TheRulescontinuetoreflectthepowerconferredbysection29(2)ofthe2007Acttomakeanorderregardingwastedcosts,andrule10(3)(a)specifiesthatanawardofwastedcostsmayincludethecostsofseekingthosewastedcosts.
TheLandsChambermayorderpaymentofthewinningparty’scostsinanytypeofproceedingsifitconsidersthatthelosingpartyoritsrepresentativehasbehavedunreasonablyintheTribunalproceedings(rule10(3)(b)).
IncertaincircumstancestheLandsChambermaygivedirectionsastowhatcostsitwillsubsequentlyorder.Ifthepartiesconsent,orifthereisadisparitybetweentheparties,theTribunalmaymakeadirectionliftingtherulepreventingtheTribunalfromawardingcostsincurredsubsequenttothedateofthatdirection(rule10(4)).
Inthetypesofproceedingsreferredtoinrule10(6),theLandsChambermaydirectthatnoawardmaybemadeinrespectofcostsincurredsubsequenttothedateofthedirection(rule10(7)).TheTribunalmustalso,insuchproceedings,haveregardtothesizeandnatureofthemattersindispute(rule10(8)).
Rule10(10)makesclearerprovisionregardingthedatefromwhichthetimelimitforapplyingforcostsrunsafteracaseiswithdrawn.
Rule10(12)(c)specifiesthatadetailedassessmentofcostsmayincludethecostsofthatassessment.
Rule10(13)enablestheLandsChambertoorderaninterimpaymentofcostsonaccountbeforecostsareassessed.
TheRulesalsoincludeamendmentsconsequentialupontheconferralofnewjurisdictiononboththeFirst-tierTribunalandtheUpperTribunal.Rule7oftheamendingrulesinsertsrule44AintotheLandsChamberRules.WhereacaseistransferredbydirectionundertheTribunalProcedure(First-tierTribunal)(PropertyChamber)Rules2013,thoseRuleswillcontinuetoapplytothecasewhenitisproceedingintheUpperTribunalinsteadoftheLandsChamberRules.
Rule8oftheamendingrulesinsertsanewrule51AintotheLandsChamberRulestoclarifythepoweroftheLandsChambertoawardinterestonsumspayablebyvirtueofadecisionoftheTribunal,includingsumsawardedbywayofcosts.Itappliestheprovisionsgoverninginterestwhichapplytocourts.
OtherchangestotheLandsChamberRulesreflectamendmentspreviouslymadetotheruleswhichapplyinotherchambersoftheFirst-tierTribunalandoftheUpperTribunal.
Rule4oftheamendingrulesextendsthepowertowithdrawacasetocircumstancesinwhichacasehasbeenadjournedpartheard.
Rule9oftheamendingrulesintroducesprovisionthatpreliminaryissuesaretobetreatedinthesamewayasdecisionswhichdisposeofalltheissuesintheproceedings,inrelationtohearings,theprovisionofreasonsandtherulesonappeals.
Rule10oftheamendingrulesmakestransitionalprovisionforcaseswhichhavestartedintheLandsChamberbefore1stJuly2013whentherulescomeintoforce.
