AGE-GRADE RUGBY Disciplinary Procedures
1.Applicability
1.1Theproceduresbelowshallapplytoschool,clubandrepresentativeagegrade rugbyuptoandincludingU18teams.Aschoolorclubmustcarryoutthe disciplinaryprocessbelowfollowingoneoftheiragegradeplayersbeingSentOff orCited. CitingproceduresarecontainedtowardstheendofthisAppendix6.
1.2WhereanU17orU18playerisplayinginanU19match,orisover17and playinginanU20oranadultteam,heshallbesubjecttotheRFUregulations whichapplytoalladultplayers,ascoveredinDisciplineRegulation19.
1.3EachCBRDPinconsultationwiththeirCSUwillappointaCBSchools& YouthDisciplinarySecretary(CBSYDS)fortheseason.
1.4Anyperson(s)appointedinsection1.3shallbeamemberoftheCB DisciplinaryCommitteewithresponsibilityfordisciplinaryissuesrelatingto youthwithintheirCB.TheywillreportonthesetotheCBandtotheRFUas required.Theywillfulfilltheresponsibilitiesasdescribedintheremainderof Appendix6.
2.Jurisdiction
2.1Schoolmatches
IfaplayerisSentOfforCitedinaschoolmatch,thenthatplayer’shead teachershallberesponsiblefortakingdisciplinaryactionagainsthimorher, undertheguidanceoftheCBSYDS.Unlessitisacontestedcitinginwhich casesection4.4applies.
2.2Clubyouthmatches
IfaplayerisSentOfforCitedinaclubyouthmatch,thatplayer'sclub secretary(viatheclubdisciplinarypanel)shallberesponsiblefortaking disciplinaryactionagainsthimorher,undertheguidanceoftheCBSYDS. Unlessitiscontestedcitinginwhichcase4.4applies.
2.3RepresentativeRugby:District,CountyorCBmatchesandtrials
IfaplayerisSentOffinaDistrict,County,CBmatchorDivisionaltrial,then hisCBSYDSwill,inconsultationwiththeNationalSchoolsYouth DisciplinarySecretary(NSYDO),conveneadisciplinarypaneltodealwith thatplayer
2.3.1Anysuspensionimposedwillbebindingonallagegradematches.
2.3.2TheUnionwilladvisetheplayer’sHeadTeacher/ClubSecretaryandthe NSYDOoftheirdecision.

2.3.3IfaplayerisCitedforanincidentoccurringinaDistrict,County,CBmatch orDivisionaltrial,thatplayer'scasewillbeheardbyadisciplinarypanel,set upassoonaspossiblebytheplayer'sCBSYDSorifheconteststhecitingby theNSYDO.
2.4Representativerugby–DivisionalandInternationalmatches
IfaplayerisSentOfforCitedatthisleveltheNSYDOorRFUDisciplinary Managerwillsetupapaneltohearthecase.
2.5CrossBorderFixtureswithinthesixnations–School,CluborCBlevel
2.5.1Ifa visiting player from an age grade team of one of the six nations is Sent Off orCitedinamatch,theRefereemustsendhisreporttotheRFUDiscipline Managerforonwardtransmissiontothevisitor'sUnion.
2.5.2IfanEnglishteam’splayerisSentOfforCitedinamatchagainsta school/club/CBagegradeteamofoneofthesixnationswhetherplayingat homeorawaysection2.1,2.2and2.3asappropriateshouldbeapplied.
2.6Tours:
Schoolsandclubagegradeteamsplayingabroad
2.6.1IfaplayerisSentOfforCitedwhilstontourabroad,thecaseshallbe adjudicatedonassoonaspossible(andinanyeventbeforethenextmatch)by the player’s head teacher/Club Secretary or their nominee, in consultation with arepresentativeoftheHostUnion.
Incomingagegradeteams
2.6.2IfavisitingplayerisSentOffitisexpectedthatthevisitorswillinvokethe proceduresoftheirownUnion,inconsultationwiththeCBSYDSorNSYDO. ThehostschoolorclubmustnotifytheRFUHeadofDisciplineofthedecision takenwithin24hours.Ifthevisitingteam’sownUnionisunableorunwilling toinvoketheirprocedurestheCBSYDSorNSYDOwillmakeappropriate arrangements.
2.7Tours: Representative and National Teams
2.7.1IfamemberofavisitingteamisSentOffhiscaseshall,wheneverpracticable,be adjudicateduponwithin24hours.ThehearingwillbeconvenedbytheNSYDO or RFUHeadofDiscipline. IfthereisanydelayaplayerSentOffmaynottake partorbeselectedforanyfurthergameuntilhiscasehasbeendealtwith.
2.7.2A chairman willbe appointedprior tothe matchbytheIRBorRFU.TheRFU Head ofDiscipline or theNSYDO willmake such anappointment inthe event oftheIRBnotdoingso.
2.7.3TheRefereemustsubmitawrittenreportandiftheplayerisSentOffasaresult ofatouchjudge’sintervention,theTouchJudgemustalsosubmitawritten report.Suchreportsmustbemadeavailabletotheplayerandthepanelassoon aspracticablepriortothehearing.

2.7.4TheReferee,andifappropriatetheTouchJudge,shouldattendthehearing.The playerSentOffandamemberofhisteam’smanagementmustattendthe meeting.
2.7.5Thepanelshallhavefulldiscretionastoprocedureandastowhatevidenceis required,butitmustheartheevidenceoftherefereeand,ifappropriatethetouch judge.TheplayerSentOffshallhavetherighttobeheardandtoberepresented. Itisthedutyofthehomeuniontoprovideaninterpreterifnecessary.
2.7.6Videoevidenceshouldbepresentedimmediatelyifavailable.Itshouldbe notedthatnowitnessesarecalledandnocharacterreferencesarenecessary.
2.7.7Thepanelmaysuspendorimposeanappropriatesanctionontheplayer.
2.7.8Thepanelshallconveyitsfindingstotheplayerandhismanager,andnotify theRFUHeadofDisciplinewhowillarrangeforanyrelevantpartiestobe notified,particularlyinthecaseofatourtothenextUniontobevisited.
2.7.9Theplayerhastherighttoappealagainsttheverdictofthepanel.Theappeal mustbelodgedwiththeRFUHeadofDisciplinewithintwenty-fourhoursof theoriginalverdict.
2.7.10Anyappealwillbeheardbyasingleseniorofficialappointedbythehome Union.Ifcircumstancesaresuch,thentheseniorofficialofthenexthome Unionwillconsidertheappeal.Wherethecaseinvolvesthelastmatchofatour theplayer'sappealwillbeheardbytheplayer'shomeUnion.
2.7.11Thepersonconductingtheappealshallreceiveallthewrittenevidence, includingthereferee’sreportandthetouchjudge’sreportifapplicable,plusthe verdictoftheoriginaldisciplinaryhearing.Heshallheartheappellant'splea and(s)heshallthenconfirmornot,theoriginalverdict,andconsiderincreasing ordecreasingtheoriginalsentence.Hisverdictisfinal.
2.8Tournaments, Festivals, and Competitions
2.8.1Incertaintournaments,festivalsandcompetitions,itmaybethatbeingSent Offwillbanaplayerfromfurtherparticipationinsomeorallofthesubsequent matchesinthatevent.OnlyaCSU,aCBRDP,aDivisionortheERFSUmay sanctionsuchregulations.Wheresuchregulationexiststheeventorganiserwill stillinformtheSentOffplayer’sCBSYDSandHeadTeacher/ClubSecretary oftheSendingOffsofurtherdisciplinaryactioncanbeconsideredbythemif merited.
2.8.2IfaplayerisSentOffinatournament,festivalorcompetitionforanoffence whichissoseriousthatitwouldnormallyattractasanctionof4matches suspensionormore,(seetariff)theeventorganiserwillinformtheplayer’s CBSYDSandHeadTeacher/ClubSecretarywithin7dayssoasadditional punishmentcanbeconsideredbythem.
2.8.3IfaplayerisCitedinatournament,festivalorcompetition,thenthatplayer's headteacherorclubdisciplinarypanelshouldconsideranddealwiththematter unlessitisacontestedmatterinwhichcasesection4.4applies.

2.8.4IfaplayerisSentOffinaninternationaltournamentorfestival,thedisciplinary regulationspertainingtothateventshallbefollowedandifnonethensection 2.4or2.7willapply.
3.Referee’sReport
3.1Inagegradematchesrefereesshouldreport,inwriting,anysendingoffwithin 48hourstotheplayer’sheadteacher/Clubsecretarywithacopytothe CBSYDS.Wherepossible,thisshouldbedonebeforetheRefereeleavesthe ground,passinghiswrittenreporttotheplayer’sheadteacher/clubsecretary viahisorherteacher/coach.
3.2TheHeadteacher/ClubSecretary/CBSYDSshouldreceivetheReferee’s Reportbeforeheorshetakesanyfurtheraction.However,thelackofa referee’sreportshouldnotpreventacasebeingheard,norshoulditdelaythe casebymorethan72hours,asdelaysinproceedingsshouldbekepttoan absoluteminimum.
4.Contestedhearing
SendingOff(playerdeniestheoffence)
4.1WhilsttheRefereeisthesolejudgeoffactduringagame,indisciplinary proceedingshisdecisionmaybechallenged.
4.2IfaplayerdisputeshisSendingoff,ahearingmustbeconvenedassoonas possible.
4.3ThehearingwillbeheardbyaPanelconvenedbytheheadteacherasin2.1, clubdisciplinarypanelasin2.2inconsultationwiththeCBSYDS;orifina representativematchbyhisCB/Union’spanelsetupasin2.3or2.4as appropriate.
Citing(playerdeniestheoffence)
4.4AdisputedCitingwillbeheardbyahearingconvenedunderarrangements madebytheCBSYDSortheNSYDO.Ifthecitingtookplaceinrepresentative rugbythenthepanelwillbeconvenedbytheNSYDO.
ConductofHearings
4.5Panelsincontestedcasesshouldnormallyconsistofthreepeople.
4.6Theplayermustbeheardandcanberepresented.
4.7ThehearingshallbeconductedinaccordancewiththeRFUDisciplinary Regulationssetoutabove,adaptedasnecessaryinthecircumstances.
4.8Thepanelwilldecide,onthebalanceofprobabilities,whethertheyfindthe caseprovenornot.Theyshouldprovidetheplayerwithreasonsfortheir finding.

4.9Theirpowerstoimposesanctionwillbethesameasthoseofahead teacher/clubdisciplinarypanel,hadtheplayerpleadedguiltyfromtheonset. Thepanelhasnopowertolevyafine,butmayawardreasonabletravelcosts incurredbywitnessesagainsttheplayer'sschool/club.
4.10Theprinciplesofnaturaljustice,astheyapplytoRFUdisciplinarymatters, shouldbeapplied.Theplayermustbeadvisedofhisrighttoappealany decisiontotheNSYDOandthat(s)hemustdothiswithin7daysofthehearing.
5.Sanctions
5.1Sanctionsimposedonagegradeplayersshouldapplytoalltheirrugby matches.Ifaplayerissubjecttosanctionswhichresultfrommisconductina CBorclubyouthmatch,headteachersarerequestedtohonourandenforce thosesanctions,andviceversa.TheCBSYDSshouldencouragemutual enforcementofsanctions.
5.2Theheadteacherordisciplinarypanelmaydecidethat:
a)thesendingoffwasinitselfsufficientpunishment;
isgiven,layingdownexpectationsaboutfuture
c)theplayerisgivenaperiodofsuspensionfromplayingrugbymatches.
5.3Anyplayingsuspensionshouldbebasedonthesanctiontariffforagegrade rugbyat,onadvicefromtheCBSYDS.Thosedecidinguponasanctionmust decideontheappropriateentrypointfortheoffenceinthetariff.
5.4Theheadteacherordisciplinarypanelshould,inmakingtheirdecision,take intoaccount:
a)theplayer’sage,experienceanddisciplinaryrecord;
b)thecircumstancesoftheoffence;
c)anymitigationandtheremorseshown.
5.5Inparticular,aplayer’speriodofplayingsuspensionshouldbeforaspecified numberofmatches,andshouldtakeintoaccount:
a)theplayer’sprogramme,includingboththeirschoolandclubmatches;
festivalsortournamentsandanyrepresentativetrialsormatches(s)hewas likelytoplay;and
b)thatthesanctionshouldnotbesosevereastodiscourageplayersfrom
continuingtoplay;and
c)thatifaSendingoffoccursattheendofthetermortheseason,anymatch
banscanextendtomatchesatthestartofthenextterm/season.

d)Suspensionsfromplayingextendtorepresentativetrials,butdonot
preventaplayerfromtraining,orparticipatingininternalnon-competitive matches.
5.6A playermayappealhissentenceifheconsidersittoosevere.(seesection7)
5.7Insomesituationstogiveaneffectivepunishment,anon-rugbysanctionmay needtobeimposedontheplayer.Schoolswillhavetheirowndisciplinary procedure,butinrugbyclubsthismayinclude:
a)inextremesituations,banningaplayerfrommembership;or
b) in lessserioussituations,banningaplayer fromtheclubhouseandallsocial
activities,inoroutoftheseason.
5.8TheCBSYDSmayreviewsanctionsimposedbyschoolsorclubsonhisown motion.Ifaschoolorclubimposeswhatappearstobeanundulylenient sanction,theywillbeaskedtoreviewthisandthenjustifyittotheCBSYDS.
5.9Iftheschool/clubdonotrevieworadjustthesanctionaspersection5.9the CBSYDSmayreferthecasetotheNSYDOwhomay:
a)re-openthecaseandinstructtherelevantCBSYDStocreateapanelto
reviewthematterinconsultationwiththeCBDisciplinarySecretary;or
b)re-openthecaseandinstructanindependentpaneltoreviewthematter;
or
c)refer the casetotheRFUDisciplinaryOfficerforactionunderregulation
19.12.2.
TheNSYDOmayinitiatereviewofsanctiononhisownmotionandapply(a),
(b),or(c).
6.Reportingtheoutcomeofdisciplinaryproceedingsandhearings
6.1Theheadteacher/clubsecretaryshouldinformtheCBSYDSofanydecision taken,within7daysofthesendingoff/citingincidentincludinganyreasonfor adelayindealingwiththeplayer.
6.2IfthecaseisadjournedforacontestedhearingtheCBSYDSmustbeadvised ofthisandthennotifiedoftheoutcomewith48hoursoftheconclusionofthe hearing
6.3The CBSYDS will notify any Referee Society that may be involved and others asappropriateofanysanctionsimposedonaplayertoensurethatany suspensionimposedisenforced.
6.4WhereaplayerisCitedinarepresentativematch,theUniondealingwiththis caseshouldadvise:
a)theplayer'sheadteacherorclubsecretary;and
b)theNSYDOortheRFUDisciplinaryManageroftheirdecision.

6.5Afailurebyaschoolorclubtoreporttheresultsofdisciplinarycasesmaylead toactionbeingtakenagainstthatschoolorClubbytheCBSYDSorNSYDO beforeadisciplinarypanelwhowouldhavepowertosuspendthemfromany CBornationalcompetition,orreprimandtheclub/school/individuals,orthey mayimposefinancialpenaltiesand/orcostsagainstthem.
7.Appeals
7.1AplayercanappealhisSchoolorClub’sdecisionbyeitherfollowinghis school’sgrievanceprocessorwritingtohisCBSYDSwithin7daysofbeing notifiedofhissanctionoutliningthenatureoftheappeal.TheCBSYDSwill createanappealhearingwhosedecisionisfinal.
7.2A playermayappealagainstahearingarrangedbyaCBSYDSinacontested CitingorinaSendingoffinrepresentativerugby,bygivingnoticeinwriting, settingoutthegroundsforappeal,serveduponandreceivedbytheNSYDO within7daysofbeingnotifiedofhissanction.TheNSYDOwillconvenean appealhearingwhosedecisionisfinal.Anappealfeeof£100payabletothe RFU mustbelodgedwiththenotice.Thismaybereturnedinfullorpartifthe appealisallowed.
7.3TheRefereemaybeinvitedtoattendanyappealhearingorbeaskedtobe availableforconsultationbytelephone.Anyappealpanelmaychoosetocall witnessesorproceedbysubmissions,astheyseefitdependinguponthecase.
7.4Anappealpanel'sverdictwillbebinding.Iftheyfindtheplayerguiltythey mayvary the original sentence up or down.Theyhave no power to levy a fine, butmayawardreasonabletravelcostsincurredbywitnessesagainstthe player'sunion,schoolorclub,butnotagainsttheplayer.
8.Misconductbyadultsinvolvedwithyouthrugby
8.1ComplaintscanbemadetoaCBSYDSortotheNSYDOallegingabreachof thisappendix,oroftheSchoolsandYouthPlayingRegulations,including playingoutofseasonandtouringwithoutpermission,againstanindividual, School, Club, orUnion.These complaints will be investigated andif sufficient evidenceexistsand,unlesstheCBSYDS/NSYDOconsideritvexatious,they wouldnormallypresentachargebeforeaCB’sDisciplinaryPaneloraRFU panel.
8.2.A CBSYDS ortheNSYDOmayinitiateRule5.12actionsagainstanySchool, Club, coach, manager, parent or supporter for ill discipline on thetouchline, or forbreachesreferredtoin8.1,andforbreachingsafeguardingregulationsor forgeneralmisconductintheyouthgame,suchasrefereeabuseontheirown motion.

GUIDELINE
AgeGradeSinBinProtocol
1.1TheSinBinispartoftheLawsoftheGameandappliestoalllevels,including Schools andClubYouth RugbyintheagegradesU13-U18, includingseven-a-siderugby.
1.2TheRefereewillcautionaplayerandshowhimayellowcardthensendhim totheSinBiniftheplayer:
a)Commitsanactcontrarytogoodsportsmanship;
b)CommitsFoulPlaywhichwarrantsacaution;
c)Deliberatelyoffends;or
d)Isamemberofateamthathasbeenrepeatedlyoffending.
1.3Being sentto theSin Bin isonly onestage belowbeing sentoff andshould not betreatedlightly.Teachersandcoachesshouldnotcondoneanyactionwhich resultsinaplayerbeingsenttotheSinBinorSentOff.
1.4DuringtimeintheSinBin,aplayer:
a)mustnotbeisolatedandshouldifappropriatebegivenprotective
clothing;
b)muststandout ofthe fieldof play, inthe vicinityofthehalfwayline,ata
placereadilyidentifiabletotheReferee;and
c)mustbeunderthecontroloftheteachers/coachesandbemadetorealise
theyareservingapunishmentforcontraveningtheLawsoftheGame.
1.5Iftheplayer’stimeintheSinBinspansthehalftimeinterval,theplayermay goontothefieldandbepartoftheteamtalk.
1.6TheactualplayingtimeaplayerwillspendintheSinBinshallbeasfollows:
a)Inthefifteen-a-sidegame,10minutes;or
b)Intheseven-a-sidegame,2minutes.
1.7Thereferee shallbe the solejudgeof the time a player hasspent in theSin Bin andwhenhecanrejoinplay.

1.9.ACitingoccurswhereaplayerallegedlycommitsanactoffoulplaywhichhas
notbeendetectedorpunishedbytheMatchOfficial(s).ASchool,Clubor Union,ortheaggrievedplayer,orhisparents/guardiancancitetoshowwhy that player shouldn’t be punished as if hehadbeenSentOff.Aciting may also bemadebyaRefereeadvisororassessorofficiallyappointedtothematch.

1.10Thecitingshouldnormallybeinwriting,signedandsenteithertothehead teacheroftheplayer’sschool,thesecretaryoftheplayer’sClub,ortothe DisciplineSecretaryoftheplayer’sUnion,CB,theERFSUorRFUwithin14 daysofthematch,andcopiedastotheCBSYDSorinrepresentativerugbyto theNSYDO.
1.11CitingsreceivedoutoftimemaystillbepermittedbytheNSYDOifheorshe decidesthatintheinterestsofrugbyorintheinterestsofjusticethereisaprima facie casetoanswer.
1.12Forthepurposesoftheseregulations,agameinan AgeGradesevensortens tournamentisregardedasan AgeGradematch.
1.13Citings made by a School, Club or Union must be signed by the HeadTeacher, Club Secretary or a CSU/CBRDP/ Divisional Officer and not just by the Team Manager.InDistrict,CountyandCBmatchesandtrialsthisshouldbesentto theNSYDO.
1.14IntheeventofaDivisionaloranInternationalmatch,itwouldnormallybe signedbytheManageroftheteamandsenttotheRFUHeadofDiscipline.
1.15IntheeventofanInternationalFestival/Tournament,theDisciplinary Regulationspertainingtothateventshallbefollowed.
1.16Aplayerwhoiscitedmustbegiventheopportunitytoadmitordenythe allegation.
1.17Ifheorsheadmitstheallegation,heorshewillbedealtwithasifheorshe hadbeenSentoffbyadisciplinarypanelasinsection2.3above
1.18Ifaplayerdeniestheoffence,thenitwillbehandledasacontestedhearingas insection4.4 above.Theonusshall beon the complainant to provethe case.It isexpectedthatthesehearingswillbeheardpromptly.
1.19Aplayerwhoiscitedispresumedinnocentuntiltheyadmitorareprovenguilty andmaycontinuetoplayuntilthehearing.
1.20IfthechairmanofaDisciplinaryPanelconsidersthecitingtobefrivolousor vexatious,heshalladvisethecomplainantofthatdecision.Thecomplainant mayreferthematterinwritingwithin7daysofsuchnotificationtothe NSYDO(orRFUHeadofDisciplineiftheincidentoccurredinan Internationalmatch)whosedecisionshallbefinal.
1.21ForRepresentativeRugbyatDistrict,County,CBandDivisionlevelaplayer whoisCitedwillbedisciplinedbyapanelconvenedasinsection2.3
