SOL Accommodations for LEP Students in Henry County Schools

Document exemption from testing where permitted with an explanation for the exemption. Decisions about how an LEP student will be tested should be made for each

individual content area assessed by the SOL tests. Consideration should be given to the student’s level of English proficiency, the level of previous schooling in the home language, and the amount of schooling the student has received in the United States. Questions about how to determine the English proficiency of LEP students should be directed to the ELL Coordinator. In determining how the student is to be tested on each test, the committee should consider the following questions:

1. Is this the student’s first year of enrollment in a United States school

(applicable for the reading, mathematics, tests)?

• If “NO,” go to question 3.

• If “YES,” should the student take the Plain English Mathematics test (available for grades 3 through 8 and Algebra I), recognizing that the student is in the first year of enrollment in a United States school?

§  Note: LEP students may not take the plain English mathematics test for more than three consecutive years.

2. Is the student’s level of proficiency in English sufficient for the student to take the test? Information on the student’s English language proficiency may be derived from school division assessments designed to determine English language proficiency, reading inventories, writing samples, teacher observations, and teacher-made tests.

• If “YES,” the committee should consider question 3 in determining the student’s need for testing accommodations.

• If “NO” for the science test, the student must take the science test

• If “NO” for the writing (grades 5 or 8 only) or history and social science tests, determine whether the student has already used the one-time exemption from testing for these content areas.

§  If the answer is “NO,” the student may be exempted from testing. See Section V, Exempting LEP Students from the SOL Assessments, for a description of the procedures to be followed in exempting LEP students from the SOL assessments.

§  If the answer is “YES,” go to question 3.

• If “NO” for the mathematics test and the student is at level 1 or level 2 of English language proficiency, the committee may consider the use of the “Plain English” mathematics test accommodation for the student. This accommodation is

available for the SOL mathematics tests in grades 3 through 8 and for Algebra I. Student may not take the plain English mathematics test for more than three consecutive years.

• If “NO” for the reading test and the student is at level 1 or level 2 of English language proficiency, the committee may consider the use of the VGLA reading assessment for the student. LEP students may not participate in the VGLA for reading for more than three consecutive years.

3. Does the student typically receive accommodations during instruction or during classroom assessments in the content area covered by the test?

• If “YES,” the committee should review Testing Accommodations for LEP Students to determine the LEP student’s need for testing accommodations.

• If “NO,” the student should take the test without accommodations.

§  If an LEP student is also identified as having a disability under the Individuals with Disabilities Education Improvement Act of 2004 (IDEIA), P.L. 105-17, or is identified as an “otherwise qualified handicapped” student under Section 504 of the Rehabilitation Act of 1973, then decisions about the student’s participation in the SOL assessments must be made by the IEP or 504 committee and documented in the student’s IEP or 504 Management Plan. If a student utilizes a non-standard accommodation, the record of that score will be accompanied by a notation explaining that the score resulted from a non-standard administration. A student with an identified disability or identified as limited English proficient who has passed an SOL utilizing any accommodation, including a non-standard accommodation, has passed for all purposes. Check accommodation with testing supervisor at your school.

LEP students in grades 3 through 8 may exercise a one-time exemption from SOL assessments in the content areas of History/Social Science and Writing (grades 5 or 8 only).

LEP students may NOT be exempted from the reading, mathematics, and science tests. Plain English mathematics test is available to Level 1 students, Level 2 students and students in the first year in the United States. (available for grades 3 through 8 and Algebra I)

Si un estudiante utiliza adaptaciones que no son estándares, el registro de su califiación será acompañado por una nota que explica que la calificación ha resultado de una administración que no fue estándar.
