[MODEL CELL PHONE USE POLICY]

It is the policy of the Company to provide communication technology capabilities for drivers to help them perform their duties in a safe and secure manner. When drivers are entrusted with cell phones, it is their responsibility to utilize them in a safe, prudent manner that does not jeopardize their safety or that of other employees, passengers and the motoring public, or our equipment, facilities and other materials. It is essential that when a conflict exists between safety and the utilization of a cell phone, safety must receive top priority. Violation of this policy will result in disciplinary actions.

Personal cell phones are not permitted to be powered on/operational if in Company vehicles. In the event that the Company reimburses employees for cell phone expenses in exchange for expectation of personal cell phone use for business purposes, personal cell phones may only be used for Company business while in Company vehicles.

Do not use cellular phones while driving unless it is absolutely necessary. Social calls are not permitted while you drive. The phone is only for communication with company representatives for company purposes.

The Company will take reasonable steps to attempt to limit communication attempts to times when employees are not operating a vehicle. If you are contacted by the Company on the cell phone while driving, do not answer unless it is safe to do so. If a call is missed, return the call at the next opportunity when you are stopped and it is safe to do so. If it is possible to answer, indicate to the caller that you are driving and will call back when safe to do so.

Under no circumstances are employees permitted to use the cell phone to text message while operating Company vehicles.

If you must use the cell phone for communication:

1. Obey all state and local laws regarding in-vehicle cell phone use.

2. Always use hands-free devices, such as ear/mike accessory and phone cradle.

3. Position the cell phone within easy reach.

4. Let the person you are speaking with know you are driving. Suspend conversations during hazardous situations, including congested traffic or bad weather.

5. Never take notes or look up information while driving.

6. Do not engage in stressful or emotional conversations that may divert your attention from the road or your responsibilities.

7. Keep any necessary conversations brief.

8. Hang up without warning in precarious traffic situations. You can always explain later why you disconnected.

In accordance with State and Federal Regulations, commercial vehicle operators are expressly prohibited from using hand-held cell phones while operating their vehicles except in emergency situations.
