In exercise of the powers conferred by section 35 of the Contract Labour (RegulationandAbolition)Act,1970theCentralGovernmentherebymakes thefollowingrules,thesamehavingbeenpreviouslypublishedasrequiredby thesaidsection,namely:—
CHAPTERI RULES
1.Shorttitleandcommencement.—(1)TheserulesmaybecalledtheContract
Labour(RegulationandAbolition)CentralRules,1971.
(2)Theyshallcomeintoforceonthedate2oftheirpublicationintheOfficial
Gazette.
2.Definitions.—Intheserules,unlessthesubjectorcontextotherwise requires,—
(a)“Act”meanstheContractLabour(RegulationandAbolition)Act,1970; (b) “AppellateOfficer”meanstheAppellateOfficerappointedbythe
CentralGovernmentundersub-section(1)ofsection15;
(c)“Board” means the Central Advisory Contract Labour Board constitutedundersection3;
(d)“Chairman”meanstheChairmanoftheBoard;
(e)“Committee”meansaCommitteeconstitutedundersub-section(1)
ofsection5;
(f)“Form”meansaformappendedtotheserules; (g)“Section”meansasectionoftheAct.
CHAPTERII CENTRALBOARD
3.TheBoardshallconsistofthefollowingMembers.—
(a)aChairmantobeappointedbytheCentralGovernment; (b)theChiefLabourCommissioner(Central)—ex-officio;
(c)3[three] persons representing the Central Government, to be appointedbythatGovernmentfromamongstitsofficials;

4.TermsofOffice.—(1)TheChairmanoftheBoardshallholdofficeassuch foraperiodofthreeyearsfromthedateonwhichhisappointmentisfirst
notifiedintheOfficialGazette.
(2)EachofthemembersoftheBoard,referredtoinclauses(c)and(d)of rule3,shallholdofficeassuchduringthepleasureofthePresident.
(3)Eachofthemembersreferredtoinclauses(e)and(f)ofrule3shall holdofficeassuchforaperiodofthreeyearscommencingfromthedateonwhich hisappointmentisfirstnotifiedintheOfficialGazette:
Providedthatwherethesuccessorofanysuchmemberhasnotbeennotified in the Official Gazette on or before the expiry of the said period of three years, such member shall, notwithstanding the expiry of the period of his office, continueto hold such officeuntiltheappointmentof his successor has been notifiedintheOfficialGazette.
(4)IfamemberisunabletoattendameetingoftheBoard,theCentral Governmentorthebodywhichappointedornominatedhimmay,bynoticeinwriting signedonitsbehalfandbysuchmemberandaddressedtotheChairmanofthesaid Board,nominateasubstituteinhisplacetoattendthemeetingandsuchasubstitute membershallhaveallrightsofamemberinrespectofthatmeetingandanydecision takenatthemeetingshallbebindingonthesaidbody.
3[5. Resignation.—(1)AmemberoftheBoard,notbeinganex-officiomember, mayresignhisofficebyaletterinwritingaddressedtotheCentralGovernment.

(2)Theofficeofsuchamembershallfallvacantfromthedateonwhich his resignationis acceptedby the CentralGovernment, or on the expiry of thirty daysfromthedateofreceiptoftheletterofresignationbythatGovernmentwhichever isearlier.]
6.Cessationofmembership.—IfanymemberoftheBoard,notbeinganex- officio member,failstoattendthreeconsecutivemeetingsoftheBoard,without obtainingtheleaveoftheChairmanforsuchabsence,heshallceasetobeamember oftheBoard:
ProvidedthattheCentralGovernmentmay,ifitissatisfiedthatsuchmember waspreventedbysufficientcausefromattendingthreeconsecutivemeetings of the Board, direct that such cessation shall not take place and on such direction beingmade,suchmembershallcontinuetobeamemberoftheBoard.
7.Disqualificationformembership.—(1)Apersonshallbedisqualifiedfor beingre-appointed,andforbeingamemberoftheBoard,—
(i)ifheisofunsoundmindandstandssodeclaredbyacompetent court;or
(ii) ifheisanundischargedinsolvent;or
(iii) ifhehasbeenorisconvictedofanoffencewhich,intheopinionof theCentralGovernment,involvesmoralturpitude.
(2)Ifaquestionarisesastowhetheradisqualificationhasbeenincurred undersub-rule(1),theCentralGovernmentshalldecidethesame.
8.Removal from membership.—The Central Government may remove from office any member of the Board, if in its opinion such a member has ceased to representtheinterestwhichhepurportstorepresentontheBoard:
Provided that nosuchmembershallberemovedunlessareasonableopportunity isgiventohimofmakinganyrepresentationagainsttheproposedaction.
9.Vacancy.—Whenavacancyoccursorislikelytooccurinthemembershipof the Board the Chairman shall submit a report to the Central Government and on receiptofsuchreporttheCentralGovernmentshalltakestepstofillthevacancyby makinganappointmentfromamongstthecategoryofpersonstowhichtheperson vacatingmembershipbelongedandthepersonsoappointedshallholdofficeforthe remainderof thetermof officeof thememberinwhose placeheisappointed.
10.Staff.—(1)(i)TheCentralGovernmentmayappointoneofitsofficialsas Secretary to the Board and appoint such other staff as it may think necessary to enable the Board to carry out its functions.
(ii) Thesalariesandallowancespayabletothestaffandtheother conditionsofserviceofsuchstaffshallbesuchasmaybedecided bytheCentralGovernment.
(2)TheSecretary—
(i)shallassisttheChairmaninconveningmeetingsoftheBoard;
TheContractLabour(RegulationandAbolition)CentralRules,1971
(ii)mayattendthemeetingsbutshallnotbeentitledtovoteatsuch meetings;
(iii) shall keep a record of the minutes of such meetings; and
(iv)shalltakenecessarymeasurestocarryoutthedecisionstakenat themeetingsoftheBoard.
11.Allowancesofmembers.—(1)Thetravellingallowanceofanofficialmember shall be governed by the rules applicable to him for journey performed by him on officialdutiesandshallbepaidbytheauthoritypayinghissalary.(2) Thenon- official members of the Board shall be paid travelling allowance for attending the meeting of the Board at such rates as are admissible to Grade I Officers of the CentralGovernmentanddailyallowancesshallbecalculatedatthemaximumrate admissibletoGradeIofficersoftheCentralGovernmentintheirrespectiveplaces.
12.Disposalofbusiness.—EveryquestionwhichtheBoardisrequiredtotake intoconsiderationshallbeconsideredatameeting,or,iftheChairmansodirects,by sendingthenecessarypaperstoeverymemberforopinion,andthequestionshallbe disposedofinaccordancewiththedecisionofthemajority:
Providedthatinthecaseofequalityofvotes,theChairmanshallhaveasecond oracastingvote.
Explanation.—”Chairman”forthepurposesofthisRuleshallincludetheChairman nominatedunderrule13topresideoverameeting.
13.Meetings.—(1)TheBoardshallmeetatsuchplacesandtimesasmaybe specifiedbytheChairman.
(2)TheChairmanshallpresideovereverymeetingoftheBoardatwhich he is present and in his absence nominate a member of the Board to preside over suchmeeting.
14.Noticeofmeetingandlistofbusiness.—(1)Ordinarilysevendays’notice shallbegiventothemembersofaproposedmeeting.
(2)No business which is not on the list of business for a meeting shall be consideredatthatmeetingwithoutthepermissionoftheChairman.
15.Quorum.—Nobusinessshallbetransactedatanymeetingunlessatleast fivemembersarepresent:
Providedthat ifatanymeetinglessthanfivemembersarepresent,theChairman may adjourn the meeting to another date informing members present and given notice to the other members that he proposes to dispose of the business at the adjourned meeting whether there is prescribed quorum or not, and it shall thereupon be lawful for him to dispose of the business at the adjourned meeting irrespectiveofthenumberofmembersattending.
16.CommitteesoftheBoard.—(1)(i)TheBoardmayconstitutesuch committeesandforsuchpurposeorpurposesasitmaythinkfit.
(ii) WhileconstitutingtheCommitteetheBoardmaynominateoneof its members to be the Chairman of the Committee.
1[(2)(i)TheCommitteeshallmeetatsuchtimesandplacesasthe
ChairmanofthesaidCommitteemaydecide.
(ii) Theprovisionsofrules12,13(2),14and15shallapplytothe Committeefortransactionofbusinessatitsmeetingsastheyapply totheBoard,subjecttotheModificationthatthequorumspecified inrule15 shallbeone-thirdof themembersinsteadof ‘five members’.]
(3)Theprovisionsofrule 11shallapplytothemembersoftheCommittee forattendingthemeetingsoftheCommitteeastheyapplytothemembersoftheBoard.
CHAPTERIII REGISTRATIONANDLICENSING
17.Mannerofmakingapplicationforregistrationofestablishments.—(1)
Theapplicationreferredtoinsub-section(1)ofsection7shallbemadeintriplicate inFormItotheregisteringofficeroftheareainwhichtheestablishmentsoughtto beregisteredislocated.
(2)Theapplicationreferredtoinsub-rule(1)shallbeaccompaniedbya
2[demanddraft]showingpaymentofthefeesfortheregistrationoftheestablishment.
(3)Everyapplicationreferredtoinsub-rule(1)shallbeeitherpersonally deliveredtotheregisteringofficerorsenttohimbyregisteredpost.
(4)Onreceiptoftheapplicationreferredtoinsub-rule(1),theregistration officershall,afternotingthereonthedateofreceiptbyhimoftheapplication,grant anacknowledgementtotheapplicant.
18.Grantofcertificateofregistration.—(1)Thecertificateofregistration grantedundersub-section(2)ofsection7shallbeinFormII.
(2)Everycertificateofregistrationgrantedundersub-section(2)ofsection
7shallcontainthefollowingparticulars,namely:—
(a)thenameandaddressoftheestablishment;
(b)themaximumnumberofworkmentobeemployedascontractlabourin theestablishment;
(c)thetypeofbusiness,trade,industry,manufactureoroccupationwhich iscarriedonintheestablishment;
(d)suchotherparticularsasmayberelevanttotheemploymentofcontract labourintheestablishment.

(3)TheregisteringofficershallmaintainaregisterinFormIIIshowingthe particulars of establishment in relation to which certificates of registration have beenissuedbyhim.
(4)If,inrelationtoanestablishment,thereisanychange,intheparticulars specifiedinthecertificateofregistration,theprincipalemployeroftheestablishment shallintimatetotheregisteringofficer,withinthirtydaysfromthedatewhensuch changetakesplace,theparticularsof,andthereasonsfor,suchchange.
19.Circumstancesinwhichapplicationforregistrationmayberejected.— (1)Ifanyapplicationforregistrationisnotcompleteinallrespects,the registeringofficershallrequiretheprincipalemployertoamendtheapplicationsoas
tomakeitcompleteinallrespects.
(2)Iftheprincipalemployer,onbeingrequiredbytheregisteringofficerto amendhisapplicationforregistration,omitsorfailstodoso,theregisteringofficer shallrejecttheapplicationforregistration.
20.Amendmentofcertificateofregistration.—(1)Where,onreceiptofthe intimation under sub-rule (4) of rule 18, the registering officer is satisfied that an amount higher than the amount which has been paid by the principal employer as feesfortheregistrationoftheestablishmentispayable,heshallrequiresuchprincipal employerto 1[pay] a sum which, togetherwith theamountalreadypaidby such principal employer, would be equal to such higher amount of fees payable for the registrationoftheestablishmentandtoproducethe^demanddraft]showingsuchdeposit.
(2)Where,onreceiptoftheintimationreferredtoinsub-rule(4)ofrule18, theregisteringofficerissatisfiedthattherehasoccurredachangeintheparticulars oftheestablishment,asenteredintheregisterinFormIII,heshallamendthesaid registerandrecordthereinthechangewhichhasoccurred:
Provided thatno such amendmentshallaffectanythingdoneor anyaction taken or any right, obligation or liability acquired or incurred before such amendment:
Providedfurtherthattheregisteringofficershallnotcarryoutanyamendment intheregisterinFormIIIunlesstheappropriatefeeshavebeendepositedby theprincipalemployer.
21.Applicationforalicence.—(1)Everyapplicationbyacontractorforthe grantofalicenceshallbemadeintriplicateinFormIV,tothelicensingofficerofthe areainwhichtheestablishment,inrelationtowhichheisthecontractor,islocated.
(2)Everyapplicationforthegrantofalicenceshallbeaccompaniedbya certificate by the principal employer in Form V to the effect that the applicant has been employed by him as a contractor in relation to his establishment and that he undertakestobeboundbyalltheprovisionsoftheActandtherulesmadethereunder insofarastheprovisionsareapplicabletohimasprincipalemployerinrespectof theemploymentofcontractlabourbytheapplicant.
(3)Everysuchapplicationshallbeeitherpersonallydeliveredtothelicensing officerorsenttohimbyregisteredpost.
(4)Onreceiptoftheapplicationreferredtoinsub-rule(1),thelicensing officer shall, after noting thereon the date of receipt of the application, grant an acknowledgmenttotheapplicant.
(5)Everyapplicationreferredtoinsub-rule(1)shallalsobeaccompanied bya1[demanddraft]showing—
(i) thedepositofthesecurityattheratesspecifiedinrule24,and
(ii) thepaymentofthefeesattheratesspecifiedinrule26.22.Matters to be taken into account in granting or refusing a licence.—In granting or refusing to grant a licence, the licensing officer shall takethefollowingmatterintoaccount,namely:—
(a)whether the applicant— (i) isaminor,or
(ii) isofunsoundmindandstandssodeclaredbyacompetentcourt;or
(iii)isanundischargedinsolvent,or
(iv) has been convicted (at any time during a period of five years immediatelyprecedingthedateofapplication)ofanoffencewhich, intheopinionoftheCentralGovernment,involvesmoralturpitude;
(b)whetherthereisanorderoftheappropriateGovernmentoranaward orsettlementfortheabolitionofcontractlabourinrespectoftheparticular typeofworkintheestablishmentforwhichtheapplicantisacontractor;
(c)whetheranyorderhasbeenmadeinrespectoftheapplicantunder sub-section(1)ofsection14,and,ifso,whetheraperiodofthreeyears haselapsedfromthedateofthatorder;
(d)whetherthefeesfortheapplicationhavebeendepositedattherate specifiedinrule26;and
(e)whethersecurityhasbeendepositedbytheapplicantattherates specifiedinrule24.
23.Refusaltograntlicence.—2[(1)Onreceiptoftheapplicationfromthe contractor,andassoonaspossiblethereafter,thelicensingofficershallinvestigate or cause investigationto be madeto satisfy himselfaboutthecorrectnessof the factsandparticularsfurnishedinsuchapplicationandtheeligibilityoftheapplicant foralicence.]

(2)(i)Wherethelicensingofficerisofopinionthatthelicenceshouldnot be granted, he shall, after affording reasonable opportunity to the applicantto be heard,makeanorderrejectingtheapplication.
(ii)Theordershallrecordthereasonsfortherefusalandshallbecommunicatedto theapplicant.
24.Security.—(1)Beforealicenceisissued,anamountcalculatedattherateof Rs. 1[90]foreachoftheworkmantobeemployed ascontract labour,inrespectof whichtheapplicationforlicencehasbeenmade,shallbedepositedbythecontractor for due performance of the conditions of the licence and compliance with the provisionsoftheActortherulesmadethereunder:
2Providedthat wherethecontractorisaco-operativesociety,theamount deposited as security shall be at the rate of 1[Rs. 15] for each other of the workmentobeemployedasacontractlabour.]
3[(1A)Wheretheapplicantforthelicencewasholdingalicenceinregard to another work and that licences had expired, the licensing officer, if he is of the viewthatanyamountoutofthesecuritydepositedinrespectofthatlicenceistobe directedtoberefundedtotheapplicantunderrule31,may,onanapplicationmade forthatpurposeinFormVAbytheapplicantadjusttheamountsotoberefunded towards the security required to be deposited in respect of the application for the newlicenceandtheapplicantneeddeposit,insuchacase,onlythebalanceamount, ifany,aftermakingsuchadjustment.]
(2)3[Theamountofsecurity,orthebalanceamount,requiredtobedeposited undersub-rule(1)or,asthecasemaybe,undersub-rule(1A)]shallbepaidinthe localtreasuryundertheHeadof Account“SectionT—Deposits& Advances— PartIIDepositsbearinginterest—(c)OtherDeposit Accounts—Departmental andJudicialDeposits—CivilDeposits—Deposits,underContractLabour(Regulation andAbolition)Act,1970(Central).”
25.Formsandtermsandconditionsoflicence.—(1)Everylicencegranted undersub-section(1)ofsection12shallbeinFormVI.
(2)Everylicencegrantedundersub-rule(1)orrenewedunderrule29shall besubjecttothefollowingconditions,namely:—
(i) thelicenceshallbenon-transferable;
(ii) thenumberofworkmenemployed as contractlabourin the establishmentshallnot,onanyday,exceedthemaximumnumber specifiedinthelicence;
(iii)saveasprovidedintheserules,thefeespaidforthegrant,orasthe casemaybe,forrenewalofthelicenceshallbenon-refundable;

(iv)theratesofwagespayabletotheworkmenbythecontractorshall notbelessthantheratesprescribedundertheMinimum Wages Act,1948(11of1948),forsuchemploymentwhereapplicableand wheretherateshavebeenfixedbyagreement,settlementoraward, notlessthantheratessofixed;
(v) (a)incaseswheretheworkmanemployedbythecontractorperform thesameorsimilarkindofworkastheworkmendirectlyemployed by the principal employer of the establishment, the wage rates, holidays, hours of work and other conditions of service of the workmen of the contractor shall be the same as applicable to the workmen directly employed by the principal employer of the establishmentonthesameorsimilarkindofwork:
Providedthatinthecaseofanydisagreementwithregardtothetypeofwork thesameshallbedecidedby 1[theDeputyChiefLabourCommissioner (Central)]2[***];
(b)inothercasesthewagerates,holidays,hoursofworkandconditionsof service of the workmen of the contractor shall be such as may be specified in this behalf by 1[theDeputy Chief Labour Commissioner (Central)];
Explanation.—Whiledeterminingthewagerates,holidays,hoursofworkandother conditions of services under (b) above, Hthe Deputy Chief Labour Commissioner (Central)shallhavedueregardtothewagerates,holidays,hoursofworkandother conditionsofserviceobtaininginsimilaremployments;
(vi) (a) in every establishment where twenty or more women are ordinarilyemployedascontractlabour,thereshallbeprovidedtwo roomsofreasonabledimensionsfortheuseoftheirchildrenunder theageofsixyears,
(b)oneofsuchroomsshallbeusedasaplayroomforthechildrenandthe otherasbedroomforthechildren,
(c)thecontractorshallsupplyadequatenumberoftoysandgamesinthe playroomandsufficientnumberofcotsandbeddingsinthesleepingroom,
(d)thestandardofconstructionandmaintenanceofthecrechesshallbe such as may be specified in this behalf by the Chief Labour Commissioner(Central);(vii)thelicenseeshallnotifyanychangeinthe numberofworkmenortheconditionsofworktothelicensingofficer;
3[(viii)thelicenseeshall,withinfifteendaysofthecommencementand completionofeachcontractworksubmitareturntotheInspector,

2[x)nofemalecontractlabourshallbeemployedbyanycontractor before6.00a.m.orafter7.00p.m.:
Providedthat thisclauseshallnotapplytotheemploymentofwomeninpithead baths, creches and canteens and so to midwives and nurses in hospitals and dispensaries.]
3[26. Fees.—(1) The fees to be paid for the grant of a certificate of registration undersection7shallbeasspecifiedbelow.—
Ifthenumberofworkmenproposedtobeemployedoncontractonanyday:— (a) is 20 Rs.60
(b)exceeds20butdoesnotexceed50Rs.150 (c)exceeds50butdoesnotexceed100 Rs.300 (d)exceeds100butdoesnotexceed200 Rs.600 (e)exceeds200butdoesnotexceed400 Rs.1200 (f)exceeds400 Rs.1500
(2)The feestobepaid forthe grant ofalicence undersection 12shall be asspecifiedbelow:
If the number of workmen employed by the contractor on any day— (a) is 20 Rs.15
(b)exceeds20butdoesnotexceed50Rs.37.50 (c)exceeds50butdoesnotexceed100 Rs.75
(d)exceeds100butdoesnotexceed200Rs.150 (e)exceeds200butdoesnotexceed400 Rs.300 (f)exceeds400 Rs.375.]
27.Validityofthelicence.—Everylicencegrantedunderrule25orrenewed underrule29shallremaininforcefortwelvemonthsfromthedateitisgranted orrenewed.
28.Amendmentofthelicence.—(1)Alicenceissuedunderrule25orrenewed underrule29 may, for good andsufficientreasons, beamendedby the LicensingOfficer.

(2)Thecontractorwhodesirestohavethelicenceamendedshallsubmitto thelicensingofficeranapplicationstatingthenatureoftheamendmentandreasonstherefor. (3) (i)Ifthelicensingofficerallowstheapplicationheshallrequirethe
applicanttofurnisha^demanddraft]fortheamount,ifany,bywhichthefeesthat
would have been payableif the licencehad been originallyissued in the amended formexceedsthefeesoriginallypaidforthelicence.
(ii) Ontheapplicantfurnishingtherequisite1[demanddraft]thelicence shallbeamendedaccordingtotheordersofthelicensingofficer.
(4)Wheretheapplicationforamendmentisrefused,thelicensingofficer shallrecordthereasonsforsuchrefusalandcommunicatethesametotheapplicant.
29.Renewaloflicence.—(1)Everycontractorshallapplytothelicensingofficer forrenewalofthelicence.
(2)EverysuchapplicationshallbeinFormVIIintriplicateandshallbe madenotless thanthirtydays beforethedateon which thelicenceexpires,and if theapplicationissomade,thelicenceshallbedeemedtohavebeenreneweduntil suchdatewhentherenewedlicenceisissued.
(3)Thefeeschargeableforrenewalofthelicenceshallbethesameasfor the grant thereof:
Provided thatiftheapplicationfor renewalis notreceivedwithinthetime specified in sub-rule (2), a fee of 25 per cent, in excess of the fee ordinarily payableforthelicenceshallbepayableforsuchrenewal:
Provided further that in case where the licensing officer is satisfied that the delay in submission of the application is due to unavoidable circumstances beyond the control of the contractor, he may reduce or remit as he thinks fit the paymentofsuchexcessfee.
30.Issueofduplicatecertificateofregistrationorlicence.—Wherea certificateofregistrationoralicencegrantedorrenewedundertheprecedingrules has been lost, defaced or accidentallydestroyed, a duplicatemay be granted on paymentoffeesofrupeesfive.
31.Refundofsecurity.—(1)(i)Onexpiryoftheperiodoflicencethecontractor may, ifhedoes notintendtohavehis licencerenewed,makeanapplicationtothe licensingofficerfortherefundofthesecuritydepositedbyhimunderrule24.
(ii) If theLicensingOfficeris satisfiedthatthereis no breachof the conditions of licenceor there is no order under section 14 for the forfeiture of I security or any portion thereof, he shall direct the refundofthesecuritytotheapplicant.
(2)Ifthereisanyorderdirectingtheforfeitureofanyportionofthesecurity, Itheamounttobeforfeitedshallbedeductedfromthesecuritydeposit,andbalance, ifany,refundedtotheapplicant.

32.Grantoftemporarycertificateofregistrationandlicence.—(1)Where conditions arise in an establishment requiring the employment of contract labour immediatelyand such employmentis estimatedto last for not more than fifteen days,thePrincipalEmployeroftheestablishmentorthecontractor,asthecasemay be,mayapplyforatemporarycertificateofregistrationorlicencetotheRegistering Officeror theLicensingOfficer, as thecasemaybe, havingjurisdictionover the areainwhichtheestablishmentissituated.
(2)Theapplicationforsuchtemporarycertificateofregistrationorlicence shallbemadeintriplicateinFormsVIIIandXrespectivelyandshallbeaccompanied bya1[demanddraftdrawninfavourofthePayandAccountsOfficer,Officeofthe ChiefLabourCommissioner(Central)NewDelhi]showingpaymentofappropriate feesandinthecaseoflicencetheappropriateamountofsecurityalso.
(3)Onreceiptoftheapplication,completeinallrespects,andonbeing satisfiedeitheronaffidavitbytheapplicantorotherwisethattheworkinrespectof which the application has been made would be finished in a period of fifteen days andwasofanaturewhichcouldnotbutbecarriedoutimmediately,theRegistering OfficerortheLicensingOfficer,asthecasemaybe,shallforthwithgrantacertificate ofregistrationinFormIXoraLicenceinFormXI,asthecasemaybe,foraperiod ofnotmorethanfifteendays.
(4)Whereacertificateofregistrationorlicenceisnotgranted,thereasons therefor shall be recorded by the Registering Officer or the Licensing Officer, as thecasemaybe.
(5)Ontheexpiryofthevalidityoftheregistrationcertificatethe establishmentshallceasetoemployintheestablishmentcontractlabourinrespect ofwhichthecertificatewasgiven.
(6)Thefeestobepaidforthegrantofthecertificateofregistrationunder sub-rule(3)shallbeasspecifiedbelow:

CHAPTERIV APPEALSANDPROCEDURE
33.(1)(i)Everyappealundersub-section(1)ofsection15shallbepreferredin
the form of a memorandum signed by the appellantor his authorised agent and presented to theAppellate Officer in person or sent to him by registered post.
(ii) Thememorandumshallbeaccompaniedbyacertifiedcopyofthe orderappealedfromanda1[demanddraft]forrupees10.
(2)Thememorandumshallsetforthconciselyandunderdistinctheadsthe grounds of appeal to the order appealed from.
34.(1)Wherethememorandumofappealdoesnotcomplywiththeprovisionsof sub-rule(2)ofrule33itmayberejectedorreturnedtoappellantforthepurposeof beingamendedwithinatimetobefixedbytheAppellateOfficer.
(2)WheretheAppellateOfficerrejectsthememorandumundersub-rule(1) heshallrecordthereasonforsuchrejection,andcommunicatetheordertotheappellant. (3) WherethememorandumofappealisinordertheAppellateOfficer
shalladmittheappeal,endorsethereonthedateofpresentationandshallregister
the appealin a book to be kept for the purpose calledthe Register ofAppeals.
(4)(i)Whentheappealhasbeenadmitted,theAppellateOfficershallsend the notice of the appeal to the Registering Officer or the Licensing Officer as the case may be, from whose order the appeal has been preferred and the Registering OfficerortheLicensingOfficershallsendtherecordofthecasetotheAppellateOfficer.
(ii) Onreceiptoftherecord,theAppellateOfficershallsendanotice totheappellanttoappearbeforehimatsuchdateandtimeasmay bespecifiedinthenoticeforthehearingoftheappeal.
35.Ifonthedatefixedforhearing,theappellantdoesnotappear,theAppellate
Officermaydismisstheappealfordefaultofappearanceoftheappellant.
36.(i)Whereanappealhasbeendismissedunderrule35theappellantmayapply totheAppellateOfficerforthere-admissionoftheappeal,andwhereitisproved thathe was prevented by any sufficient cause from appearing when the appeal was calledonforhearing,theAppellateOfficershallrestoretheappealonitsoriginalnumber.
(ii)Suchanapplicationshall,unlesstheAppellateOfficerextendsthetime forsufficientreason,bemadewithin30daysofthedateofdismissal.

WELFAREANDHEALTHOFCONTRACTLABOUR
40.(1)Thefacilitiesrequiredtobeprovidedundersections18and19oftheAct, namelysufficientsupplyofwholesomedrinkingwater,asufficientnumberoflatrines andurinals,washingfacilitiesandfirst-aidfacilitiesshallbeprovidedbythecontractor inthecaseoftheexistingestablishmentswithinsevendaysofthecommencement of these rules and in the case of new establishments within seven days of the commencementoftheemploymentofcontractlabourtherein.
(2)Ifanyofthefacilitymentionedinsub-rule(1)isnotprovidedbythe contractorwithintheperiodprescribedthesameshallbeprovidedbytheprincipal employerwithinsevendaysoftheexpiryoftheperiodlaiddowninthesaidsub-rule.
41.RestRooms.—(1)Ineveryplacewhereincontractlabourisrequiredtohalt atnightinconnectionwiththeworkingoftheestablishmenttowhichtheActapplies and in which employmentof contractlabour is likelyto continuefor 3 months or more,thecontractorshallprovideandmaintainrestroomsorothersuitablealternative accommodationwithinfifteendaysofthecomingintoforceoftherulesinthecase of existing establishments, and within fifteen days of the commencement of the employmentofcontractlabourinnewestablishments.
(2)Iftheamenityreferredtoinsub-rule(1)isnotprovidedbythecontractor withintheperiodprescribedtheprincipalemployershallprovidethesamewithina periodoffifteendaysoftheexpiryoftheperiodlaiddowninthesaidsub-rule.
(3)Separateroomsshallbeprovidedforwomenemployees.
(4)Effectiveandsuitableprovisionshallbemadeineveryroomforsecuring andmaintainingadequateventilationbythecirculationoffreshairandthereshall alsobeprovidedandmaintainedsufficientandsuitablenaturalorartificiallighting. (5) Therest-roomorroomsorothersuitablealternativeaccommodation
shallbeofsuchdimensionssoastoprovideatleastafloorarea1.1sq.metrefor
eachpersonmakinguseoftherestroom.
(6)Therest-roomorroomsorothersuitablealternativeaccommodation shallbesoconstructedastoaffordadequateprotectionagainstheat,wind,rainand shallhavesmooth,hardandimperviousfloorsurface.
(7)Therest-roomorothersuitablealternativeaccommodationshallbeata
convenient distance from the establishment and shall have adequate supply of wholesomedrinkingwater.

42.Canteens.—(1)IneveryestablishmenttowhichtheActappliesandwherein workregardingtheemploymentofcontractlabourislikelytocontinueforsixmonths andwhereincontractlabournumberingonehundredormoreareordinarilyemployed anadequatecanteenshallbeprovidedbythecontractorfortheuseofsuchcontract labourwithinsixtydaysofthedateofcomingintoforceoftherulesinthecaseof the existing establishments and within 60 days of the commencement of the employmentofcontractlabourinthecaseofnewestablishments.
(2)Ifthecontractorfailstoprovidethecanteenwithinthetimelaiddown thesameshallbeprovidedbytheprincipalemployerwithinsixtydaysoftheexpiry ofthetimeallowedtothecontractor.
(3)Thecanteenshallbemaintainedbythecontractororprincipalemployer, asthecasemaybe,inanefficientmanner.
43.(1)Thecanteenshallconsistofatleastadininghall,kitchen,storeroom, pantryandwashingplacesseparatelyforworkersandforutensils.
(2)(i)Thecanteenshallbesufficientlylightedatalltimeswhenanyperson hasaccesstoit.
(ii) The floor shall be made of smooth and impervious materialand insidewallsshallbelimewashedorcolour-washedatleastoncein eachyear:
Providedthattheinsidewallsofthekitchenshallbelime-washedeveryfourmonths.
(3)(i)Theprecinctsofthecanteenshallbemaintainedandinacleanand sanitarycondition.
(ii) Waste water shall be carried away in suitable covered drains and shallnotbeallowedtoaccumulatesoastocauseanuisance.
(iii)Suitablearrangementsshallbemadeforthecollectionanddisposal ofgarbage.
44.(1)Thedininghallshallaccommodateatatimeatleast30percent,ofthe contractlabourworkingatatime.
(2)Thefloorareaofthedininghall,excludingtheareaoccupiedbythe servicecounterandanyfurnitureexcepttablesandchairsshallbenotlessthanone squaremetreperdinertobeaccommodatedasprescribedinsub-rule(1).
(3)(i)Aportionofthedininghallandservicecountershallbepartitioned offandreservedforwomenworkers,inproportiontotheirnumber.
(ii) Washingplacesforwomenshallbeseparateandscreenedtosecure privacy.
(4)Sufficienttables,stools,chairsorbenchesshallbeavailableforthe number of diners to be accommodated as prescribed in sub-rule (1).
45.(1)(i)Thereshallbeprovidedandmaintainedsufficientutensils,crockery, cutlery,furnitureandanyotherequipmentnecessaryfortheefficientrunningofthecanteen.
(ii) Thefurniture,utensilsandotherequipmentshallbemaintainedina cleanandhygieniccondition.
(2)(i)Suitablecleanclothesfortheemployeesservinginthecanteenshall alsobeprovidedandmaintained.
(ii) Aservicecounter,ifprovided,shallhavetopofsmoothand imperviousmaterial.
(iii)Suitablefacilitiesincludinganadequatesupplyofhotwatershallbe providedforthecleaningofutensilsandequipment.
46.Thefoodstuffsandotheritemstobeservedinthecanteenshallbeinconformity withthenormalhabitsofthecontractlabour.
47.Thechargesforfoodstuffs,beveragesandanyotheritemsservedinthe canteenshallbebasedon‘no-profit,noloss’andshallbeconspicuouslydisplayedin thecanteen.
48.Inarrivingatthepricesoffoodstuffsandotherarticlesservedinthecanteen thefollowingitemsshallnotbetakenintoconsiderationasexpenditurenamely:—
(a)therentforthelandandbuilding;
(b)thedepreciationandmaintenancechargesforthebuildingandequipment providedforinthecanteen;
(c)the cost of purchase, repairs and replacement of equipments includingfurniture,crockery,cutleryandutensils;
(d)thewaterchargesandotherchargesincurredforlightingandventilation; (e) theinterestontheamountsspentontheprovisionandmaintenanceof
furnitureandequipmentprovidedforinthecanteen.
49.Thebooksofaccountsandregistersandotherdocumentsusedinconnection withtherunningofthecanteenshallbeproducedondemandtoanInspector.
50.Theaccountspertainingtothecanteenshallbeauditedonceevery12months byregisteredaccountantsandauditors:
Provided that the Chief Labour Commissioner (Central) may approve of any other person to audit the accounts, if he is satisfied that it is not feasible to appointaregisteredaccountantandauditorinviewofthesiteorthelocation ofthecanteen.
51.LatrinesandUrinals.—Latrinesshallbeprovidedineveryestablishment comingwithinthescopeoftheActonthefollowingscale,namely:—
(a)wherefemalesareemployed,thereshallbeatleastonelatrinefor every25females;
(b)wheremalesareemployed,thereshallbeatleastonelatrineforevery
25males;
Provided thatwherethenumberofmalesorfemalesexceeds100,itshallbe sufficientifthereisonelatrineforevery25malesorfemales,asthecasemay be,uptothefirst100,andoneforevery50thereafter.

52.Everylatrineshallbeundercoverandsopartitionedoffastosecureprivacy, andshallhaveaproperdoorandfastenings.
53.(1)Whereworkersofbothsexesareemployedthereshallbedisplayedoutside eachblockoflatrineandurinalanoticeinthelanguageunderstoodbythemajority oftheworkers“ForMenonly”or“ForWomenonly”asthecasemaybe.
(2)Thenoticeshallalsobearthefigureofamanorofawoman,asthe casemaybe.
54.Thereshallbeatleastoneurinalformaleworkersupto50andoneforfemale workersuptofiftyemployedatatime:
Providedthatwherethenumberofmaleorfemaleworkmen,asthecasemay be, exceeds 500 it shall be sufficient if there is one urinal for every 50 males or femalesuptothefirst500andoneforevery100orpartthereofthereafter.
55.(1)Thelatrinesandurinalsshallbeconvenientlysituatedandaccessibleto workersat all times at the establishment.
(2)(i)Thelatrinesandurinalsshallbeadequatelylightedandshallbe maintainedinacleanandsanitaryconditionatalltimes.
(ii)Latrinesandurinalsotherthanthoseconnectedwithaflushsewage systemshallcomplywiththerequirementsofthepublichealthauthorities.
56.Watershallbeprovidedbythemeansoftaporotherwisesoastobe convenientlyaccessibleinornearthelatrineandurinals.
57.WashingFacilities.—(1)Ineveryestablishmentcomingwithinthescopeof theActadequateandsuitablefacilitiesforwashingshallbeprovidedandmaintained fortheuseofcontractlabouremployedtherein.
(2)Separateandadequatescreeningfacilitiesshallbeprovidedfortheuse ofmaleandfemaleworkers.
(3)Suchfacilitiesshallbeconvenientlyaccessibleandshallbekeptinclean andhygieniccondition.
58.First-AidFacilities.—Ineveryestablishmentcomingwithinthescopeof theActthereshallbeprovidedandmaintainedso,astobereadilyaccessibleduring allworkinghoursfirst-aidboxesattherateofnotlessthanoneboxfor150contract labourorpartthereofordinarilyemployed.
59.(1)Thefirst-aidboxshallbedistinctivelymarkedwitharedcrossonawhite groundandshallcontainthefollowingequipment,namely:—
A.Forestablishmentsinwhichthenumberofcontractlabouremployed doesnotexceedfifty—

61.TheFirst-AidBoxshallbekeptinchargeofaresponsiblepersonwhoshall alwaysbereadilyavailableduringtheworkinghoursoftheestablishment.
62.ApersoninchargeoftheFirst-AidBoxshallbeapersontrainedinFirst-Aid treatment,inestablishmentwherethenumberofcontractlabouremployedis
150ormore.

CHAPTERVI WAGES
63.Thecontractorshallfixwageperiodsinrespectofwhichwagesshallbe
payable.
64.No wage period shall exceed one month.
65.Thewagesofeverypersonemployedascontractlabourinanestablishment or by a contractor where less than one thousand svich persons are employed shall bepaidbeforetheexpiryoftheseventhdayandinothercasesbeforetheexpiryof tenthdayafterthelastdayofthewageperiodinrespectofwhichthewagesarepayable.
66.Wheretheemploymentofanyworkeristerminatedbyoronbehalfofthe contractor the wages earned by him shall be paid before the expiry of the second workingdayfromthedayonwhichhisemploymentisterminated.
67.Allpaymentsofwagesshallbemadeonaworkingdayattheworkpremises andduringtheworkingtimeandonadatenotifiedinadvanceandincasethework is completed before the expiry of the wage period, final payment shall be made within48hoursofthelastworkingday.
68.Wagesduetoeveryworkershallbepaidtohimortootherpersonauthorised byhiminthisbehalf.
69.Allwagesshallbepaidincurrentcoinorcurrencyorinboth.
70.Wagesshallbepaidwithoutanydeductionsofanykindexceptthosespecified bytheCentralGovernmentbygeneralorspecialorderinthisbehalforpermissible underthePaymentofWagesAct,1936(4of1936).
71.Anoticeshowingthewageperiodandtheplaceandtimeofdisbursementof wagesshallbedisplayedattheplaceofwork andacopysentbythecontractorto theprincipalemployerunderacknowledgement.
72.Theprincipalemployershallensurethepresenceofhisauthorisedrepresentative attheplaceandtimeofdisbursementofwagesbythecontractortoworkmenandit shall be the duty of the contractor to ensure the disbursement of wages in the presenceofsuchauthorisedrepresentative.
73.Theauthorisedrepresentativeoftheprincipalemployershallrecordunderhis signatureacertificateattheendoftheentriesintheRegisterofWagesorthe

CHAPTERVII
REGISTERSANDRECORDSANDCOLLECTIONOFSTATISTICS
74.Registerofcontractors.—Everyprincipalemployershallmaintaininrespect ofeachregisteredestablishmentaregisterofcontractorsinFormXII.
75.Registerofpersonsemployed.—Everycontractorshallmaintaininrespect of each registered establishment where he employs contract labour a register in FormXIII.
76.EmploymentCard.—(i)Everycontractorshallissueanemploymentcardin
FormXIVtoeachworkerwithinthreedaysoftheemploymentoftheworker.
(ii) The card shall be maintained upto date and any change in the particularsshallbeenteredtherein.
77.ServiceCertificate.—Onterminationofemploymentforanyreason whatsoever the contractor shall issue to the workman whose services have been terminatedaServiceCertificateinFormXV.
78.MusterRoll,WagesRegisters,DeductionRegisterandOvertime Register.—1[(l)(a) Every contractor shall in respect of each work on which he engagescontractlabour,—
(i) maintainaMusterRollandaRegisterofWagesinFormXVIand
FormXVIIrespectively:
ProvidedthatacombinedRegisterofWage-cum-MusterRollinFormXVIIIshall bemaintainedbythecontractorwherethewageperiodisaFortnightorless;
(ii) maintain a Register of Deduction for damage or loss, Register of FinesandRegisterofAdvancesinFormXX,FormXXIandForm XXIIrespectively;
(iii)maintain a Register of Overtime in Form XXIII recording therein thenumberofhoursof,andwagespaidfor,overtimework,ifany;
(b)Everycontractorshall,wherethewageperiodisoneweekormore, issuewageslipsinFormXIX,totheworkmenatleastadaypriortothe disbursementofwages;
(c)Everycontractorshallobtainthesignatureorthumbimpressionofthe workerconcernedagainsttheentriesrelatingtohimontheRegisterof Wages or Muster Roll-cum-Wages Register, as thecase maybe, and theentriesshallbeauthenticatedbytheinitialsofthecontractororhis authorisedrepresentativeandshallalsobedulycertifiedbytheauthorised representativeoftheprincipalemployerinthemannerprovidedinrule73.
