Employer claim process

Introduction

The following process sets out the key steps that need to be taken by an employer of the Wiltshire Pension Fund to claim against the Fund’s ill health liability insurance (IHLI) via Legal & General. This process is in addition to your normal processes when dealing with ill health retirements in your organisation. In the event, you have any questions regarding the

Important note: IHLI applies only in cases where an active scheme member is awarded either tier 1 or tier 2 ill health retirement. It does not apply in cases of tier 3 ill health awards or the early release of deferred benefits on the grounds of permanent ill health.

Process

Scheme Employer - On confirmation of stage 1 or 2 ill health retirement:

•Start preparing the referral pack for your occupational health adviser, collating all data and completing appropriate section of the relevant Wiltshire Pension Fund ill health certificate.

•At the same time, complete Part A of the L&G Ill Health Liability Claim Form and ensure the Employer Declaration is signed and dated.

•Assist the scheme member complete Part B of the Ill Health Liability Claim Form, ensuring the Access to Medical Reports Act declaration is completed and the member signs and dates the Member Declaration and Consent.

•Add the completed Ill Health Liability Claim Form and relevant occupational health reports to

referral pack prior to referral of claim to L&G.

•Send a copy of the referral pack to L&G (inc. L&G consent form) – this form MUST be submitted SECURELY to L&G within 90 days of the member’s retirement date, or the date when the final decision was made to ill health early retire the member, if later – FAILURE TO MEET THIS DEADLINE MAY RESULT IN THE CLAIM BEING REJECTED BY L&G

Legal & General - On receipt of claim from Wiltshire Pension Fund:

•Assess the claim and, if approved, request the financial Claim Form and strain costs from Hymans’ Ill Health Liability Insurance Team

Hymans’ Ill Health Liability Insurance Team -On receipt of L&G request:

•Request completed financial Claim Form and strain costs from Wiltshire Pension Fund

Wiltshire Pension Fund – on request from Hymans’ Ill Health Liability Insurance Team: Complete Ill Health Liability Insurance Financial Claim Form

•Email completed Form to Hymans’ Ill Health Liability Insurance Team at

Hymans’ Ill Health Liability Insurance Team –on receipt of completed financial Claim

Form from Wiltshire Pension Fund

•Forward Claim Form to L&G

Legal & General –on receipt of financial Claim Form from Hymans’ Ill Health Liability Insurance Team

•Finalise claim assessment and make payment to Wiltshire Pension Fund

Wiltshire Pension Fund –on receipt of payment from L&G

•Ensure Scheme Employer is credited with receipt of Ill Health Liability Insurance payment in the Pension Fund
