Legislative Issues We Support:

HB 2640 - Rent Vouchers:

The Department is required to evaluate the total project cost and per-unit cost when reviewing Housing Trust Fund applications. The Department must give preference to projects that demonstrate cost-effectiveness compared to similar housing projects constructed or renovated within the same geographic area. (Rep. Norma Smith)

HB 1077 – Repeal of On-Site Property Managers Tax:

We have introduced legislation that will repeal the on-site property tax as it applies to wages and other benefits applied to on-site property managers. The repeal will be implemented when the 1.8% B&O Tax is reduced to 1.5% on services industries. This tax was made permanent in the 2010 legislative session. (Rep. Troy Kelley)

SB 6315/HB 2642 – Tenant Screening:

The bill would require landlords to accept portable screening reports that tenants have purchased (within 30 days) and would allow tenants to take their report around to prospective landlords; thereby saving the multiple screening fees paid. Also, landlords are required to notify prospective tenants of the name and criteria of the screening service they use. (Sen. Dave Frockt & Rep. Derek Stanford)

SB 6292 - Sealing/Vacating of Court Records:

The bill would seal court records on unlawful detainers that were not prosecuted to conclusion as well as DV protection orders, and civil judgments. (Sen. Jeanne Kohl-Welles & Rep. Timm Ormsby)

SB 5019 – Precludes Access to Non-Conviction Records:

The bill would seal nonconviction data from dissemination, including: vacated convictions, S&C, lack of probable cause, etc. (anything but a conviction). (Sen. Debbie Regala)

SB 6351/HB 2677 – Sealing/Vacating of Court Records:

The bill would prevent us from getting public records if the agency said that it would be a hardship to produce. They can file an injunction and refuse to produce them.
Currently only criminals face this issue in getting records. (Sen. Margarita Prentice & Rep. Deb Eddy)

SB 5050 - Taking Interests from Tenant Security Deposits for Other Uses:

The purpose of the bills is to take the interest from tenant deposits to build low-income housing. (Sen. Adam Kline)

HB 1126 – Criminal Street Gangs:

This legislation would declare a property a nuisance without the notification of the property owner after 3 or more unrelated criminal gang offenses occur. This legislation undermines the crime-free legislation passed last year (SB 5742) where landlords are notified via notice from the police regarding the criminal activity an allow the property owner in a good faith effort to deter the activity. (Rep. Charles Ross)

SB 6341 – Carpet Stewardship (Recycling):

The bill will increase the cost of carpet because no carpet producer may sell carpet in the state unless they are participating in an approved carpet recycling program. The program must have systems for financing, collecting, transporting, processing, and recycling discarded carpet. (Sen. Jeanne Kohl-Welles)

HB 1929 - Street Utility Tax/Street Maintenance Tax:

This bill would allow cities, with voter approval, to establish local "street maintenance utilities" (SMU's). City councils would then have the authority to impose charges on residential and commercial users of up to 50 percent of the actual costs for maintenance, operation, and preservation of city streets. Rates would be uniform for the same class of service, and all business and residential properties would be subject to the utility charge. Charges imposed on businesses would be measured by the number of employees and would be prohibited from exceeding the equivalent of $2 per month per full-time employee. Charges imposed against residential owners or occupants could not exceed $2 per month per housing unit (Rep. Marko Liias)

SB 6324/HB 2554 - Carbon Monoxide Requirements:

The bill modifies the RLTA and requires that the landlord include with rental agreement packet education info dangers of CO and that CO detectors must be maintained by the tenant. (Sen. Joe Fain & Rep. Jay Rodne)

SB 6145/HB 2540 – Paint Stewardship (Recycling):

This bill provides for take-back of architectural paint (oil, latex, and acrylic) promoted by the paint manufacturers. Retailer participation is voluntary. While the price of small quantities of architectural paint (5 gallons or less) will likely increase with the application of this bill, that cost is likely much lower than the cost and regulatory requirement if local government were to administer their own programs. All monies collected will go towards the cost of the program and any surplus monies will go towards reducing the future cost of the program. (Sen. Maralyn Chase & Rep. Roger Goodman)
