CONSENT, WAIVER AND RELEASE
YOU ARE GIVING UP YOUR RIGHT TO SUE
PLEASE READ CAREFULLY
I, ______wish to visit facilities and premises (“the Facilities”) owned in whole or in part or operated by Husky Oil Operations Limited, its subsidiaries, affiliates, related companies, successors and assigns (together called “Husky”) and participate in other activities related to Husky’s business or organized by Husky (“Visit and Participation”).
I know that the Facilities are working facilities and as such contain potentially dangerous machinery, equipment, tools, vehicles, chemicals, petroleum products, hydrocarbons and other items (together called “Items”). They may also contain Husky employees, contractors, agents and representatives who are occupied with the operations of the Facility, along with other students or visitors. I know there is a potential for accidents or incidents to occur during or in connection with my Visit and Participation and the presence and use of Items, and for me to suffer personal injury, property damage, death or other loss as a direct or indirect result of such accidents or incidents.
I agree to comply with all safety procedures and instructions given to me by Husky personnel before and during my Visit and Participation. These requirements may include wearing or using appropriate safety equipment, following specific procedures when handling Items, and avoiding certain safety sensitive areas of the Facilities. I am responsible for asking Husky personnel for assistance or information before handling any Items or conducting any procedure when I am unsure of the safety requirements. I agree to conduct myself with reasonable care for my own safety and for the safety of others at all times.
I ACCEPT AND ASSUME THE RISKS, DANGERS AND HAZARDS of my Visit and Participation. I know that Husky will not permit me to enter the Facilities unless I sign this form, and in consideration of Husky permitting me to access the Facilities:
I HEREBY WAIVE ANY AND ALL CLAIMS I may have at any time against Husky and its directors, officers, employees, contractors, agents and representatives (together called “Husky’s Representatives”), arising out of or related to any personal injury, property damage, death or other loss I suffer that is caused or contributed to by any cause whatsoever, INCLUDING NEGLIGENCE ON THE PART OF HUSKY OR HUSKY’S REPRESENTATIVES.
I HEREBY ASSUME LIABILITY FOR, AND AGREE TO INDEMNIFY HUSKY and Husky’s Representatives for:
(1) any losses or damages suffered by Husky or Husky’s Representatives; and
(2) any claims made against Husky or Husky’s Representatives by any third party arising our of or related to any personal injury, property damage, death or other loss suffered by any third party;
that are caused or contributed to by the negligence, or other act or omission, of myself.
I HEREBY RELEASE HUSKY AND HUSKY’S REPRESENTATIVES FROM ANY AND ALL LIABILITY arising from or connected in any way with such personal injury, property damage, death or other loss. If I commence legal action against a third party arising from or in connection with such personal injury, property damage, death or other loss, and that third party involves Husky or Husky’s Representatives in the legal action; or if any third party brings action against Husky or Husky’s Representatives for injury, damage or other loss to it which I negligently or otherwise caused or contributed to, I agree to indemnify Husky and Husky’s Representatives for all expenses, losses or damages they incur in connection with their involvement in the action, including any judgment awarded against them, and their legal fees.
I confirm that I have had the opportunity to read this Waiver and Release and to consult a lawyer about its meaning and effect on my legal rights, and that I have freely chosen to sign it without pressure or representations from Husky or any other entity. This Waiver and Release binds my heirs, executors, administrators, estate, assigns and next of kin.
