NIT NO. 55 /2006-07 TED-BSR
The Executive Engineer (Elec.), BSNL Electrical Division, Bhubaneswar invites on behalf of the Bharat Sanchar Nigam Limited sealed item rate tenders for the following work from the contractors satisfying the under mentioned eligibility conditions: -

Eligibility Criteria: -
Firms who have carried out at least 3 works of maintenance in Central Govt, State Govt., Central/State PSUs comprising of central or package Air Conditioning plant or window and split AC units as part of scope of work. Cost of each work shall not be less than 75% of the estimated cost. Satisfactory completion certificate from the dept. concerned obtained from an officer not below the rank of EE/GM.
OR
Manufacturers of Window / Split Air Conditioning unit who are in the current approved list of BSNL approved DGS&D Rate Contract.
OR
Authorized service centers of above manufacturers whose turnover for last three years shall not be less than 5 times of estimated amount.
OR
Manufacturers of package AC units who are in the current approved list of BSNL Rate Contract.
Also firm’s turnover for last 3 years shall not be less than 5 times of estimated amount.
Valid Registration Certificate with PF / ESI.
Attested copies of the documentary proof of satisfying above conditions are to be furnished along with application
Conditions and tender forms can be had from division on payment of Rs.500/-. (Non- refundable).

Validity of tender shall be for 90 days from the date of opening of tender.
The tenderer shall submit the tenders in 2 sealed covers marked as cover Ist and 2nd inscribing the name of work. Both should be separate & they should not be enclosed in a common 3rd cover. The first cover should contain the earnest money deposited in the shape of Demand Draft / Pay Order of a scheduled Bank or Nationalized Bank / State Bank guaranteed by Reserve Bank of India drawn in favour of A.O. BSNL Electrical Division, Bhubaneswar. In case of submitting the tender down loading from web site the 1st cover should contain D.D towards cost of tender document & EMD drawn in favour of A.O. BSNL Electrical Division, Bhubaneswar along with attested copy of eligible criteria, the second cover should contain the tender documents. If the Ist cover is not annexed in proper form, the 2nd cover containing tenders will not be opened at all.
Note: (i) The company or firm or any other person is not permitted to tender for works in BSNL unit in which his near relative(s) is (are) posted.
(ii)The tender documents shall not be sent through Courier /Post. The tender Documents received through Courier/ Post shall not be opened / Considered at all.

Near relative(s) of BSNL employee not permitted to tender:
The company or firm or any other person is not permitted to tender for works in BSNL Unit in which his near relative(s) is (are) posted. The unit is defined as SSA/Circle/Chief Engineer/Chief Arch./Corporate office for non-executive employees and all SSA in a circle including circle office/Chief Eng./Chief Arch./Corporate office for executive employees (including those called as Gazetted officers at present).
Therefore, it has been decided by the competent authority that a clause must be added in the tender and other related documents that the tenderer should give a certificate that none of his/her such near relative is working in the units as defined above where he is going to apply for tender work. In case of proprietorship firm certificate will be given by the proprietor, for partnership firm certificate will be given by all the partners and in case of limited company by all the Directors of the company.
Any breach of these conditions by the company or firm or any other person, the tender/work will be cancelled and earnest money/security deposit will be forfeited at any stage whenever it is so noticed. The department will not pay any damages to the company or firm or the concerned person. The company or firm or the person will also be debarred for further participation in the concerned unit.

PERFORMANCE GUARANTEE: -
The firm has to submit before award of work performance guarantee for 10% of the estimated cost for 12 months i.e. Rs 25,025/-. This amount is to be given either in the form of Bank Guarantee or any other acceptable form. No security Deposit shall be deducted from the running bills. This amount shall be refunded after successful completion of maintenance period. The EMD deposited along with tender shall be adjusted against this.
GENERAL CONDITIONS
Scope of Maintenance
The maintenance of A.C. units as included in the schedule of work are to be carried out on comprehensive basis. No material will be supplied by BSNL.
Methodology
a) Before starting the work, the new agency will depute his supervisor who in consultation with the authorized representative of BSNL as well as with the supervisor of old agency, if any, will prepare the list of defects including identification of defective parts, whatsoever within 15 days from the date of award of the work. The responsibility of rectification / removal of the defects will rest with BSNL.
b) After the completion period is over, the Agency will handover the installation in a healthy and free from defects condition.
c) A complaint book as per Annexure-I shall be kept at sub-division office by the firm and the firm shall update the same by submission of service reports. Necessary complaints will be registered by JTO(E) concerned and entries will be made by him according to the service reports with due verification.
d) At the start of each month, the firm in consultation with SDE(E) concerned shall prepare a tentative programme for preventive maintenance to be carried out during the month and date on which he may carry out the maintenance.
e) The firm shall depute only those persons who are trained in air conditioning.
TOOLS & PLANTS
All tools and plants required for carrying out various tasks relevant to maintenance are to be arranged by agency at his own cost.
COMMERCIAL
1. The tenderer must obtain himself at his own expenses, all the information necessary for the purpose of tendering. Inspect the site and acquaint himself with all the local conditions, means of access to work and nature of work etc. No claim shall be entertained on this account.
2. Payments shall be made bi-monthly. It is mandatory to attach Annexure II (containing details of periodical maintenance done every month) with the bill. This certificate has to be signed by the SDE(E).
3. The rates quoted must be full and final inclusive of all central, state, local taxes exclusive of service tax. Nothing extra shall be payable other than the quoted rates.
PENALTY CLAUSE
1) Any damage to the installation(s)/building due to the carelessness on the part of firm's staff shall be the responsibility of firm and shall be replaced/rectified without any extra cost.
2) Any accident or damage will be the responsibility of agency and the department will not entertain any claim, compensation, penalty etc on this account or on account of non-observance of any other requirement of law relevant to this.
3) If the agency fails to rectify any fault, within reasonable time, the department reserves the right to carry out the work at the risk and cost of the agency. In case the fault is of emergency nature, which may affect, the normal functioning of the services, and the firm fails to take immediate necessary action, the work shall be carried out at the risk and cost of the firm without giving any notice. The decision of the EE(E) shall be final.
4) In case of a major accident/loss on account of negligence on the part of the contractor, the contract shall be terminated and 10% of the estimated cost shall be recovered. Decision of Superintending Engineer(E) shall be final and binding on the contractor.
CURRENCY OF CONTRACT
The currency of contract shall be 12 months.
The Department reserves the right to terminate the contract by giving show cause notice of one month duration at any time during the currency of the contract.
The Department reserves the right to extend the contract for a maximum period of six months (three months at a time) at the same rates & conditions without the consent of the firm.
MISCELLANEOUS
The workers engaged by the firm should maintain proper discipline and good behaviour with occupants. The firm shall remove such workers from the site whose behaviour is found improper, Executive Engineer's decision shall be final.
The agency will provide the workers with Testing and safety equipments.
Agency has to observe all the labour rules and regulations in force and indemnify BSNL against any claims whatsoever, either from this clause or any other clause in the contract.
Firm shall issue ID card to their workforce whenever they enter premises for bonafide work. Nobody shall be allowed to enter without work .
Dismantled materials shall be returned to the BSNL except those items for which the replacement is supplied by the agency.
The firm can utilize the services of specialized agencies for specific work.
While working inside the premises, the agency shall be responsible to provide necessities to them as per labour law.
Contractor has to keep all the electro-mechanical equipments and plants and clean to avoid any accident or fire hazards.
Fire services are of critical nature, the firm will ensure that the labourers engaged are well trained to take responsibility and initial steps under emergency situation.
In case of Emergency, contractor or his authorized supervisor shall be available at site on short notice from engineer-in-charge and make all efforts to make the situation normal at the earliest.
Firm is responsible to keep workable spares and consumables for due performance of the contract. For critical spare parts, firm shall have arrangement with dealers for prompt supply.
The material used/replaced by the firm for the work shall have same specification. Alternate Make shall be allowed only after prior approval of the Engineer-in-Charge.
Firm shall ensure energy conservation by switching - on the air-conditioner units only when required.
