VIRGINIA EASEMENT AGREEMENT

THIS EASEMENT AGREEMENT, made this ___ day of ____ , 2015 between ______ (“owner”), and Elite Power and Energy Corporation (Elite).

WITNESSETH:

That, for the sum of One Dollar ($1.00), and other valuable consideration, the receipt whereof is hereby acknowledged, Owner grants unto Elite as successors and assigns, the perpetual right, privilege and easement to install and maintain a propane gas storage tank, together with all attachments, equipment, accessories and appurtenances desirable in connection therewith, on the property of Owner in City/County, Virginia, the location of such tank to be as follows: ______ .

Owner further grants unto Elite, its successors and assigns, the perpetual right, privilege, and easement of the right of way to install and maintain gas pipes or tubing, together with all accessories and appurtenances desirable in connection therewith, upon and across property of Owner to connect such underground storage tank with the building on the property.

The underground storage tank, pipes, tubing, attachments, equipment, accessories, and appurtenances, installed hereunder shall at all times remain the property of Elite, which shall have the right to inspect, remove, repair, improve, relocate the same, and make such changes, alterations, substitutions, and additions in and to such facilities as Elite may from time to time deem advisable, but in no event shall Elite be obligated to refill any hole, re-landscape, or reseed the Owner’s property.

For the purpose of constructing, installing, maintaining, repairing, or operating its facilities, Elite shall have the necessary right of ingress and egress over, to, from and through the property of Owner.

Elite shall at all times have the right to keep the easement granted hereby clear of all buildings, structures, trees, roots, undergrowth and other obstructions. Elite shall have complete and total access to the aforesaid easements and Owner shall execute such further assurances thereof as may be required.

IN WITNESS WHEREOF, the parties have executed and delivered this Agreement to the duty executed and delivered, effective as of the day and year first above written.
