Victorian Energy Efficiency Target Amendment Regulations 2014
The Lieutenant-Governor as the Governor's deputy with the advice of the Executive Council makes the following Regulations:

1Objective
The objective of these Regulations is to amend the Victorian Energy Efficiency Target Regulations 2008—
(a)to modify the way that the consumer price index is referenced; and
(b)to modify, as a consequence of the Environment Protection and Sustainability Victoria Amendment Act 2014—
(i) the conditions and circumstances under which a certificate cannot be created in relation to a prescribed activity; and
(ii)a class of customers that is prescribed for the purposes of the definition of scheme acquisition in section 3(1) of the Victorian Energy Efficiency Target Act 2007.
2Authorising provision

These Regulations are made under section 75 of the Victorian Energy Efficiency Target Act 2007.
3Commencement
These Regulations come into operation on 30 June 2014.
4Definitions
In regulation 4 of the Victorian Energy Efficiency Target Regulations 2008[1] insert the following definition—
"register of scheduled activities means the register kept under section 26G of the Environment Protection Act 1970 as in force immediately before the repeal of that section;".
5Conditions and circumstances under which a certificate cannot be created
For regulation 10(1)(ab) of the Victorian Energy Efficiency Target Regulations 2008substitute—
"(ab) if the prescribed activity is undertaken in premises in relation to which there was an entry on the register of scheduled activities on 29 June 2014; or

29 June 2014 is the day before the day on which section 17 of the Environment Protection and Sustainability Victoria Amendment Act 2014 came into operation. Thatsection repealed section 26G of the Environment Protection Act 1970, under which the register of scheduled activities was kept.".
6Shortfall penalty rate

In regulation 11(2) of the Victorian Energy Efficiency Target Regulations 2008, for "published by the Australian Statistician in respect of the September quarter of the previous year"substitute"in original terms for the most recent reference period in which fell the September quarter of the previous year most recently published by the Australian Bureau of Statistics before the variation is made".
7Scheme acquisition
For regulation 12(2)(b) of the Victorian Energy Efficiency Target Regulations 2008substitute—
"(b) therewas an entry in relation to those premises on the register of scheduled activities on 29 June 2014.
