Use Case Specification: Garnish for Child Support

1.  Use Case Name- Garnish for Child Support Use Case 18

1.1  Brief Description

This use case allows the Automated Child Support Enforcement System, (ACSES) or a written Court Order, to authorize UI to withhold child support from benefit payments. This includes UI, DDU and State Plan Disability Claims.

2.  Flow of Events

2.1  Basic Flow

2.1.1  UC964 System sends file to ACSES with social security number and name of all those who filed a claim each week ending.

2.1.2  UC965 ACSES/interested parties notify UI of all child support court orders that match with UI applicants.

This use case begins when ACSES provides UI with a file of intercept orders. DDU will also be notified.

2.1.3  UC395 Child Support/Garnishment Unit verifies that data received from ACSES is correct and complete.

2.1.4  UC396 System establishes a Child Support Case file.

2.1.5  UC397 System notifies claimant of Child Support Garnishment

System generates a notice to the claimant advising them of the amount of child support which will be deducted from their weekly benefit amount.

2.1.6  UC398 Claimant certifies for weekly benefits

System withholds the amount of child support garnishment from claimant’s weekly benefit amount in accordance with the Court Order. Include Business Use Case 26 and System Use Case 3, Process Payments.

2.1.7  UC399 System records and disburses money withheld

System records amount of money withheld from claimant’s benefits so that the monies can be disbursed to the appropriate Human Service Account by Budget and Accounting.

2.2  Alternative Flows

2.2.1  UC798 Probation provides incomplete court order

In step 2.1.1 of the basic flow, if an incomplete court order is received, court order is sent back manually. Notice is not sent to claimant. Continue with step 2.1.7 in basic flow.

2.2.2  UC799 Child Support/Garnishment Unit receives child support request not directly from probation

In step 2.1.1 of the basic flow, if child support request is received from an interested party, not from probation, a letter is sent directing interested party to contact County Probation Office. Continue with step 2.1.7 in basic flow.

2.2.3  UC800 Child Support/Garnishment Unit receives child support request from another state and court order is attached

In step 2.1.1 of the basic flow, Child Support/Garnishment Unit receives a child support request from another state and a court order is attached. Return to step 2.1.2 in basic flow.

2.2.4  UC801 Child Support/Garnishment Unit receives child support request from another state and claim is not active

In step 2.1.4 of the basic flow, a case file will be created. Continue with step 2.1.7 in basic flow.

2.2.5  UC802 Probation notifies Child Support/Garnishment Unit of child support termination

In step 2.1.1 of the basic flow, Child Support/Garnishment Unit receives court order to stop payment of garnishment because of child support termination. Child Support/Garnishment Unit will stop the garnishment. Child Support/Garnishment Unit will update the garnishment case file with the ending date. Continue with step 2.1.7 in basic flow.

2.2.6  UC803 Child Support/Garnishment Unit receives an amended court order from probation

In step 2.1.1 of the basic flow, Probation notifies Child Support/Garnishment Unit of any amended court orders. Child Support/Garnishment Unit will review amended court order and modify record. Return to step 2.1.7 in basic flow.

2.2.7  UC804 Child Support/Garnishment Unit receives multiple court orders

In step 2.1.1 of basic flow, Child Support/Garnishment Unit enters multiple court orders into one case file per claimant. Continue with step 2.1.4 in basic flow.

2.2.8  UC1556 The system allows for sending money to multiple counties.

In step 2.1.7 of basic flow, money will be broken down and sent to individual counties. Continue with step 2.1.8 in basic flow.

2.2.9  UC1558 Child Support is withheld in error

In step 2.1.3 of basic flow, the Probation Unit contacts the Child Support/Garnishment Unit regarding an error where the incorrect claim was garnished. They advise them to vacate the court order. The Probation Unit is responsible for reimbursing the claimant for garnishment amount which was erroneously withheld. This use case ends.

2.2.10  UC1557 The name received from ACSES does not match the name on the claims record

In step 2.1.3 of basic flow, the Child Support/Garnishment Unit receives a list of discrepancies from the cross match. The unit investigates whether the discrepancy is an error or not. If it is not an error, they will create the case file. If an error exists, they will not create a case file. Continue with step 2.1.4 in basic flow.

3.  Special Requirements – Business Rules

3.1  The total garnishment amount for child support can not exceed 65% of the claimant’s weekly benefit rate.

3.2  NJ garnishment of child support must be tagged by county.

3.3 Out of State garnishment of child support must be tagged by state.
