Upper Nehalem Watershed Council is requesting Bids for: “Rock Creek Salmon Habitat Improvement - 2015”.

The Rock Creek Large Wood Placement Project intends to place 38 full spanning large wood structures in the mainstream and South Fork of Rock Creek near the Sunset Rest Area. There are four landowners partners (Oregon Department of Forestry, Oregon Department Of Transportation, Weyerhaeuser and Stimson). Two of these landowners (ODF and Weyerhaeuser) are contributing off site wood resources to all 4 of the ownerships.
Project Purpose:
The constructed log jams create stream complexity that provides cover for fish and encourages channel adjustments, pool formation, and gravel sorting processes. These improvements will lead to overall stream and flood plain function with improved spawning and rearing habitat for salmonids.
Contractor Requirements:
The Contractor will furnish all labor, supplies, and equipment necessary for completion of the project in accordance with the specifications outlined in this document and communicated during the mandatory pre-Bid site meeting.
Contractor’s CCB license must be current. UNWC will not consider a Bid proposal for a Contract unless the Contractor is registered with CCB and demonstrates a good performance record.
Contractor must provide 3 references with Bid demonstrating that Contractor has prior experience with salmon habitat construction. Construction includes: whole tree extraction from mature forest stands, hauling 60’ logs with root wads attached, trail blazing to access sites, building temporary stream crossings, proper log staging, in-stream large wood structure construction, site clean-up; maintaining consistent work flow; and assuring environmental protections, fire protection specifications and safety standards are adhered too during operation, at all times, without exception.
This contract is subject to Prevailing Wage Rates as per ORS 279C.800 to 279C870 if contract meets or exceeds $50,000.
All Contractors working under this contract shall comply with ORS 656.017 (ORS 279C.530), Oregon
Contractor Law.
The successful Bidder and all subsequent sub-contractors shall comply with ORS 656.017, Oregon Workers’
Compensation Law, and produce appropriate certificates that they have complied.
The project is permitted through ODF Notification of Operation, Clatsop County Development and
ODOT Right Of Way Permits. Contractor must adhere to all permit requirements.
The Contractor will indemnify and hold harmless UNWC from any liens, claims, costs, damages, or other
expenses of litigation from personal or property damage to Contractor or third parties arising out of
Contractor’s performance of duties required under this contract. Throughout the life of this Contract, the
Contractor shall obtain and maintain such general liability and property damage or personnel injury
(including death). Such insurance will name the UNWC and each Landowner including: Stimson,
Weyerhaeuser, Oregon Department of Forestry and Oregon Department Of Transportation, as additional
insureds. A certificate of insurance documenting the above conditions shall be submitted to UNWC prior to
the award of the Contract. Such insurance will provide coverage for not less than the following:
· General Comprehensive Liability = $1,000,000
· Automobile Liability = $1,000,000
· Excess/Umbrella Liability = $1,000,000
· Workers’ Compensation = Statutory Requirements
· Employer Liability = $500,000 per person per accident
$500,000 per person aggregate
$500,000 per occurrence/occupational disease
· Logger’s Broadform Property Damage = YES
Project Management will be provided by UNWC Project Manager - Steve Trask and Oregon Department of
Fish and Wildlife – Troy Laws – Restoration Biologist. Contractor will follow their guidance, at all times,
during project implementation.
Contractor is required to promptly acquire and deliver, along with executed Contract, a good and sufficient
performance bond in a sum equal to 100% of the Contract price to secure faithful performance of this
Contract and for the sole protection of UNWC.
Contractor must disclose first tier subcontractor(s) if value of service is equal or greater than 5% of Contract.
Include name, dollar value and category of work for qualifying subcontractor(s) with Bid.
The Contractor must meet minimum equipment requirements, which includes: A 314 class excavator or
better, with hydraulic thumb (Rotex head preferred). Trucks suitable for hauling 60’+ logs with rootwads on
and off highway on designated roads. Fire suppression equipment, environmental spill kit, chainsaw and
all other necessary cables, blocks, pulleys, and hand tools required to complete this work.
Please Note:
UNWC reserves the right to reject any or all Bids and to waive any informality or irregularity in any Bid received. In addition, the Bidder recognizes the right of UNWC to reject a Bid if Bidder failed to submit by the date specified in the Bidding documents, or if Bid is in any way incomplete or irregular.
Bid selection will be based on price, examples of similar work, references, proof of required equipment and ability to mobilize construction in summer 2015.
The ensuing Contract will require completion of the outlined tasks prior to reimbursement. The project is grant funded with a set budget. No change of work order will be considered and a not to exceed the awarded sum value clause will be appended to the Contract.
The selected Contractor will attend a pre-construction meeting with UNWC Project Manager and ODFW
Restoration Biologist to discuss coordination of project. The intent of this Contract is to have the project
construction completed in 2015, contingent of ODFW instream work window and ODF fire season
restrictions.
The in-stream work must be completed during the ODFW instream work window which occurs July 1st
through August 31st, 2015. An extension to the ODFW instream work window has been requested by
UNWC, however an extension is not guaranteed, at this time.
If an instream work extension is not granted by ODFW for 2015 and/or ODF fire danger restricts
construction activities then UNWC reserve the right to postpone the balance of the remaining construction
until the summer of 2016.
In the event of a postponement the Contractor will be reimbursed for project Construction items
completed up to the date of postponement. The Contractor will be reimbursed for remaining project
Construction items completed in the summer of 2016.
Additional Instructions to Bidders
Contract Tasks
Resource Acquisition (Maps attached)
· Harvest Area A: Load and truck 28 trees with root wads attached (60 ‘x 24” DBH average) and 28 logs without rootwads (60’x24” DBH average) from Harvest Area A (Osweg Creek Road) to staging locations on the Sterling Ranch Road. Logs are cut and decked roadside off of Osweg Creek Road.
· Harvest Area B: Tip, clean, yard and haul 60 trees (2 logs/tree) with root wads attached (approx. log size 60 ‘ x 24” DBH average) from Harvest Area B – McGregor Block area along Music Creek rd. to the staging locations on the Weyerhaeuser Mainline downstream of the Sunset Wayside Park, Sterling Ranch Road and Shields Road. Trees to be thinned from Harvest Area B will be marked by Project Manager.
· Harvest Area C: Tip, clean, yard and haul 72 full trees (2 logs/tree) with root wads attached (70‘ x 24”DBH average) from Harvest Area C - Weyerhaeuser land on a spur of Buchanan Creek Rd. near the summit of Hwy 53 in Clatsop County to staging areas on the Weyerhaeuser Mainline downstream of the Sunset Wayside Park and Shields Road.
Note: Logs may be delivered to the specific log staging areas from the harvest areas at the Contractor’s discretion. Each LWD site has a minimum of 6 logs (3 with root wads and 3 without). Contractor shall consult with the Project Manager concerning distribution/placement of additional logs.
Note: Cleanup at each of the designated Harvest Sites will be required (brush piling, back filling stump cavities post tipping and access road obliteration).
Contractor must avoid damage to adjacent leave trees in Weyerhaeuser and ODF harvest sites.
Site Preparation
· Temporary stream crossings on Reach D across the South Fork Rock Creek and tribs will need to be constructed from the staging area on Shields Road to and along the old railroad grade on the south side of the South Fork of Rock Creek. Crossings shall adhere to Forest Practice Act Standards. See Reach D Map for crossings.
· The old railroad grade needs to be cleared of standing alder and maple to access the 13 LWD sites downstream of the staging area. The most minimal clearing necessary for machine access will be the optimal target. Downed trees may be utilized within the structures at some sites (dependent on Project Manager and final design criteria).
Structure Placement
· All logs will be required to be staged prior to structure placement.
· A rotex head is preferred for this Contract but not required.
· The Contractor should consider the size class of this material in relation to known lift capacities of excavator. Log dimensions for placement will not exceed 36” DBH or 80 feet in length, but will often contain the entire root wad.
· The placement Contractor will be working directly with the Project Manager for each structure placement so that design criteria associated with maximizing stability and accomplishing the project goals of aggradation are achieved. Expect this to involve the intricate weaving of logs between riparian trees and woven amongst themselves to achieve particular function required by the Project Manager.
· Working in high visibility stream corridors (adjacent to Hwy 26 and the Sunset Wayside Park) will require the Contractor to expend additional time yarding oversized material to the structure site. Barking and damaging the existing riparian stand will not be acceptable. Some of the structure sites may require crossing an existing State Wayside Park lawn and remediation to original condition will be an expectation of the Contract.
Note: clean-up of each access route to placement sites is required. Contractor will consult with Project Manager regarding site by site clean-up requirements.
General Requirements
· Fire protection guidelines will mimic those required by each individual landowner while the Contractor is working on their property. There are 4 different landowners concerned (ODF, ODOT, Stimson, Weyerhaeuser). The requirements regarding fire prevention and control on this project site are in the attached document published by ODF - “A Guide to Legal Requirements for Preventing and Controlling Fires in Operations on and Near Forest Land in Oregon”. The Contractor is expected to fight their own fire(s). The Contractor, acting independently, shall immediately extinguish without expense to UNWC or the Landowner all fire’s on or in the vicinity of the project site caused by the Contractor or by the contractor’s employees.
· Equipment shall not cross stream except in designated areas. All equipment will be free of leaks and in good operating condition. All equipment moved to job site will be cleaned of weeds and seeds prior to entering job site. All maintenance work and refueling of equipment shall be done outside riparian areas. An adequate spill kit must be on site during operation of heavy equipment.

If this Bid is accepted, bidder will: a) execute the approved form of Contract with Upper Nehalem Watershed Council; b) provide the performance security, if any, specified in the Contract Documents; c) will provide all the necessary labor, machinery, tools, apparatus and other means of construction to do all the work required; d) furnish all the materials necessary (whole trees/logs provided by UNWC); and e) do all of the foregoing in the manner and time prescribed in, and according to the requirements set forth in, the Contract Documents.
8. If this Bid is accepted and the bidder fails to or neglect to execute and return the Contract, and provide performance security, if required, within ten (10) days from the date of receiving from the Upper Nehalem Watershed Council the Contract prepared and ready for execution, the Upper Nehalem Watershed Council may, at its option, determine that the bidder has abandoned the Contract, declare the bid security described in the Instructions to Bidders, if any, forfeited, and award the Contract to the next lowest responsible bidder.
9. The Bidder will make all the payments to workers, suppliers and agencies required under the Contract in the manner described in the Contract Documents; the bidder will comply with all other applicable provisions of Oregon Law, Upper Nehalem Watershed Council Ordinances and rules relating to public contracting including the provisions of ORS 279C.840, if applicable.
