TOWNSHIP OF CHISHOLM
COMMITTEE OF ADJUSTMENT MEETING
WEDNESDAY, JANUARY 23RD, 2013
CALL TO ORDER
Chairperson Leo Jobin called the meeting to order at 8:25 p.m. with members David Hodgins and Ted Vanderklugt present. Members Don Butterworth and Ken Frederick were absent with regret.
The meeting was held immediately following the Council/Committee of Adjustment meeting to review the proposed new draft Zoning By-law. The purpose of the meeting was to consider two time-sensitive items: a referral from Council for comment regarding the response to Ontario’s Provincial Policy Statement Review, submitted by the Municipalities of Neebing, Shuniah and Oliver Paipoonge and the Townships of Conmee, Gillies, O’Connor; and also to consider information from staff with respect to Severance Application 2012-01 (Gray).
Resolution 2013-01 (COA)
David Hodgins – Ted Vanderklugt: Be it resolved that the Committee of Adjustment recommends to Council that comments with respect to Ontario’s Provincial Policy Statement submitted by the Municipalities of Neebing, Shuniah, and Oliver Paipoonge and the Townships of Conmee, Gillies, O’Connor be supported. ‘Carried’
Secretary Linda Ringler informed the Committee that a Certificate of Consent had been requested for Severance Application No. 2012-01 (Gray). However, the survey plan provided was for the retained parcel, and not the severed parcel, as required by the “conditions of consent.” Secretary Ringler advised the Committee that she had spoken with the township’s solicitor, Jack Wallace, with respect to this matter and his advice was that this was acceptable, but it was not in compliance with condition 2(b), and suggested that the conditions be revised to accept the survey plan of the retained parcel. Mr. Wallace mentioned that surveying costs for the applicants were substantially reduced through the provision of a plan of the retained portion, rather than the severed portion.
Resolution 2013-02 (COA)
Ted Vanderklugt – David Hodgins: Be it resolved that the Township of Chisholm Committee of Adjustment deletes Condition No. 2, related to Severance Application No. 2012-01, in its entirety and replaces it with the following Condition No. 2:
That the following documents be provided for the transaction described in Condition No. 1:
(1) That a signed Acknowledgement and Direction Consent and Draft Electronic Transfer setting out the entire legal description of the parcel in question be submitted to the Clerk-Treasurer of the Township for the issuance of a Certificate of Consent.
(2) A reference plan of survey, which bears the Land Registry Office registration number and signature as evidence of its deposit therein, illustrating the retained parcel to which this consent approval relates,
And further that this change to the conditions is deemed to be minor and no further notice is required. ‘Carried’
