Approve Agenda / The meeting was called to order at 7:00 PM by Mayor Carney. Mayor Carney welcomed everyone.
All Council members and staff were present; Mayor Carney led the Council/Audience in the Pledge of Allegiance.

Councilman Parten moved to approve agenda as presented. Seconded by Councilman Williams. Motion carried unanimously.
Consent Agenda / Councilman Guyton moved to approve Consent agenda. Seconded by Councilman Parten. Motion carried unanimously.
1.  Approve Study Minutes of 4/9/12.
2.  Approve minutes of 4/9/12 Regular Council Meeting.
3. Approve those Claim Checks dated through May 14th. In the amount of $111,457.91 check #’s 16042 through 16089, Manual check #5323 & EFT.
4. Approve Payroll Checks dated through April 30st, 2012 in the amount of $29,318.25 Check #s 16048 through 16059.

/ Lt. Winter provided bar graph reports that included how much contract time was spent patrolling the Town. The report shows 13 calls in the month of April 2012. Mr. Winter also provided the Spillman report formatted in detailed.

The Public Hearing was opened at 7:06 to receive testimony and comments regarding the Library District. Ms. Noel, 8321 State Route 410 testified: As an educator at the Middle School I do encourage the kids to use the Library and I know personally that this Library gets a lot of use. I do encourage you the Town Council to take this into consideration and don’t close the Library or take it into annexation.
Lori Arbogast 102 Apple Loop testified: Mayor and Council please don’t put annexation on the ballot for the Naches Library. The Library represents the best of Naches. It provides services to children and the elderly. It is a safe haven for teenagers and youth. Take pride that you are encouraging lifelong learning in our community. You are working in partnership with our schools to provide the best intellectual environment for our youth and keep our Library local. Please do not put Library annexation on the ballot.
Sue Dunn 441 Kellowry Road on behalf of Kathy Paulson presently the librarian at the Middle school testified: Mayor reminded that testimony is supposed to be at first hand. The school district has a partnership with the Town of Naches Library. When the Naches School District don’t have certain books we encourage kids to go to the Library and a lot of times we get the response back and Katie found it for me. In my opinion is very important to have the Library available in this Town kids often utilized the internet services and all the services given by the Library.
Elena Leonardo 13407 Old Naches Hwy testied: It’s just wonderful what everyone has said and in my opinion the Library is not just a place of learning it’s also a place to meet new people and create friendships. I use the Library a lot and in the past it has been in discussion if 433 active users within the Town of Naches and I know it’s a very busy place. Councilman Williams: The past discussion about the 433 users is active users within the past 3 years that have used the Library at least once.
Karen Young 102 Apple Loop testified: I’m very opposed to the annexation process at this time because of my household’s economic condition. In my opinion it is a very bad move. My understanding is if it doesn’t go to annexation the other option is renegotiating the current contract and I don’t think that’s a good idea either. I think our Library does a wonderful job and we have a wonderful Town Council.
Mayor Carney, with no other testimony at this time the Public Hearing is closed at 7:23 P.M.
The Public Hearing for the Fire District was opened. No testimony was provided. The Public Hearing was closed at 7:24 P.M. Regular Council meeting reopens at 7:24 p.m.
LightSpeed Networks, Inc. (dba “ LS Networks”) Robin Smith. Robin Smith of LS Networks provided information to Council regarding the planned use of rights-of-way, the franchise and services which will be offered to the Town and its residents by LS Networks.
a)  Fire District and Library District Annexation. Councilman Williams questioned Kim Hixon, Director of the Yakima Valley Libraries. Rgarding the number of libraries shut down by the District, to which she answered: I believe 3, one the Nile Library in the Upper Valley. Councilman Guyton asked if the Council could talk about the contract. Admin. Ranger stated that the contract is very amicable and it serves both the Library and the Town. Councilwoman Hawver stated that we have never had the intent not to have a contract with the Library. The voting is whether or not the Library is to be put on the annexation ballot. If it went on the ballot only the Town citizens would vote on the Library for annexation. Councilwoman Hawver asked if voters went with annexation it would be probably another year before is effective. Admin. Ranger answered.
b)  LS Networks Franchise agreement. Ordinance No. 672 included in the packet for review. There’s 2 one with Streets included and one without Streets.
c)  West Naches Utility Extension Project (SIED). Admin. Ranger the sale of the Chinook Center should close in the next 15 days. SIED don’t cost anything to the Town the repayment of the loan portion is paid by the developer.
d)  Penney Avenue funding and re classification request has been submitted.
a)  NoaNet Franchise. Attorney Watkins NoaNet is different than LS Networks. NoaNet will be providing services through Federal funding for rural communities to have internet connection. If it’s feasible they’ll be working at the same time. The Franchise is nearly identical to LS Networks. Mr. Walker will be available to do a presentation for Council at the next meeting.
b)  Council approval to advertise for request for qualification for engineering services 2013 through 2016. Councilman Williams Moved to approve the request for qualification engineering services 2013-2016. Seconded by Councilman Guyton. Motion carried unanimously.
c)  Council approval to advertise for request qualifications for engineering services for Penney Avenue. Councilman Williams moved to approve to advertise for engineering services for Penney Avenue. Seconded by Councilman Guyton. Motion carried unanimously.
d)  Council approval for engineering contract services for West Naches Utility Extension Project. Councilman Williams moved to approve engineering contract services for West Naches Utility Extension. Seconded by Councilwoman Hawver. Motion carried unanimously.
Proposed Ordinance No. 670 an Ordinance of the Town of Naches, Washington, stating its intent to join and annex into Fire District No. 3 of Yakima County. Councilman Williams moved to approve ordinance No. 670. The motion died for lack of a second.
Proposed Ordinance No. 671 and Ordinance of the Town of Naches, Washington, stating its intent to join and annex into the Rural Library District No. 1 of Yakima County. No motion was made by Council on the Library District.
Proposed Ordinance No. 672 and Ordinance of the Town of Naches, Washington, granting lighspeed networks, inc. DBA “LS Networks” and Oregon Corporation, a Franchise to construct, operate and maintain a telecommunications network within the Town of Naches Washington. Councilman Williams moved to approve Ordinance No. 672. Seconded by Councilman Parten. Motion carried unanimously.
