Call to Order:

The meeting was called to order at 1:00 P.M. by Supervisor Donnelly.

Motions:

Motion to authorize Marge Merzig and Supervisor Donnelly to submit a stipulation letter to NYC DEP, made by Councilman Liddle, Seconded by Councilman Hall. Councilman Grommeck absent, all others in favor, motion carried.

Resolutions:

RES #5-2012 Andes Wastewater Treatment Plant Modifications/Upgrade Budget and Project Resolution

WHEREAS, the Town Board of the Town of Andes is undertaking a Wastewater Treatment Plant Modifications/Upgrade Project (hereinafter referred to as “the Project”) to provide improved wastewater treatment facilities in the Andes Sewer District #1; and

WHEREAS, the Project includes equipment changes and reconstruction of certain processes at the existing WWTP; and

WHEREAS, the Town of Andes has been notified of a consent order for failures at the WWTP; and

WHEREAS, the Town of Andes has secured funding for the system repairs and must submit a final project budget to both New York City Department of Environmental Protection (NYCDEP) and to the US Army Corps of Engineering; and

WHEREAS, in December of 2010, the Town has enacted a Bond Resolution authorizing the Town to seek funding for this project up to $2.5 million; and

WHEREAS, the timing of availability of funds, though guaranteed, could cause a delay in construction or in timely payment of contractors and may cause the Town to seek funding in the form of a short-term financing; and

WHEREAS, in order for the Project to be completed within the time limit established by the New York State Department of Environmental Conservation, certain equipment must be ordered to allow for a 6 month delivery delay; and

WHEREAS, the Town of Andes seeks to proceed with the ordering of such equipment for the Project, contingent upon the final approval by the above named agencies;

NOW, THEREFORE BE IT RESOLVED BY THE TOWN BOARD OF THE TOWN OF ANDES AS FOLLOWS:

  1. The Town Board hereby approves the Engineering and Design of the WWTP repairs; and
  2. The Town Board hereby approves the final project budget based upon the 100% Design report; and
  3. The Town Board hereby authorizes the Supervisor, upon receipt of the signed and certified project budget from NYCDEP, to execute a special invoice for the NYCDEP project share; and
  4. The Town Board hereby authorizes the Supervisor, upon receipt of the signed and certified project budget from NYCDEP, to solicit bids for the required equipment; and
  5. The Town Board hereby authorizes the Supervisor to execute a Project Partnership Agreement with the US Army Corps of Engineers; and
  6. The Town Board authorizes the Supervisor, upon receipt of the signed and certified project budget from NYCDEP, to seek a Bond Anticipation Note for the initial cost of the above equipment plus other identified pre-construction costs.
