Chairman McCall called the meeting to order at 7:00 p.m.

Councilman Wardle moved to amend the agenda and move agenda item # 8 to item # 3. Councilman Pratt seconded the motion. The vote was as follows: Councilman Pruden, “Aye”, Councilman Wardle, “Aye”, Councilman Pratt, “Aye”, Councilwoman Winn, “Aye”, and Chairman McCall, “Aye”.
3. Resolution 2013-35 A Resolution of the Tooele City Council Regarding Payment, and Security to Stay Enforcement, of a Judgment in Accordance with Utah Law
Presented by Roger Baker
Mr. Baker stated that the District Court has recently entered a judgment against Tooele City in the amount of 20.7 million dollars in a law suit brought by Tooele Associates against Tooele City. Tooele City believes the judgment to be incorrect and it must be appealed. It is in the public interest to appeal the judgment. If the judgment is affirmed by the appellate courts this resolution adopts the right for the City to pay that judgment over 10 years in equal installment payments. There is a new statute and rule of civil procedure this year that says, in essence, that to stay a judgment during an appeal the government must provide a security. This resolution is that security. The City’s pledge to pay a judgment, which has been affirmed by legislative act of the governing body of the City, is the security that is required by rule. Attached to the resolution is a letter from Tooele City’s lawyers that practice in the areas of bonds and debts, and it is their opinion that there is no other security the City could provide.
Councilman Wardle moved to approve Resolution 2013-35. Councilman Pratt seconded the motion. The vote was as follows: Councilman Pruden, “Aye”, Councilman Wardle, “Aye”, Councilman Pratt, “Aye”, Councilwoman Winn, “Aye”, and Chairman McCall, “Aye”.
4. Mayor’s Community Youth Recognition Awards
Presented by Mayor Patrick Dunlavy, Chief Ron Kirby, and Heidi Peterson
Mayor Dunlavy welcomed all that had come to support these students and said that it is his honor to recognize these students. He said that this award is very important to the Council and himself and it is one of the most important things that they do at City Council meeting. He said that it is essential that the local government play an important role with the youth in the Community. He also said that it is very important for youth to be recognized for the good things that they do. The young people that they will honor tonight go above and beyond the “norm”. He noted that the Community that Cares program teaches important skills to young people. He appreciates the involvement of the community in these awards. He introduced Chief Ron Kirby, Chief of Police and Ms. Heidi Peterson the Communities that Care Director.
Ms. Peterson thanked everyone for coming and supporting these students. She stated that the Communities that Cares department evaluates the risks that kids are up against and they put programs into place in the community to help them. She mentioned that there are three programs that the Communities that Care program offers in the community which are; 1) Lions Quest in the Elementary Schools, 2) Life Skills Training in the Secondary Schools and 3) Guiding Good Choices which is a family program. She encouraged anyone interested in the Guiding Good Choices program to contact her. She explained that the students receiving this award will receive a backpack filled with donations from various businesses in the community and she thanked those businesses for their donations. She thanked the Tooele School District and the teachers for their support of the Communities of Care program in the schools.
Ms. Peterson then presented the Mayor’s Community Recognition Award to the following students:

Christian Harvey, Clarke Johnsen Junior High

Ms. Peterson congratulated these students for their hard work in their families and the community.
Mayor Dunlavy asked the students to stand and he recognized them and congratulated them again for receiving this this award. He said that he is very proud of these students and noted that they will be the future leaders of the City. He also recognized the families for the important role they play in these young people’s lives. He thanked the teachers in the schools for helping the Communities that Care program succeed.
A brief recess was taken for a picture with the Mayor, City Council and the recipients of this award.
5. Open Forum for Public Comment
Chairman McCall invited anyone from the public who would like to come forward and address the Council to please do so. No one came forward.
Chairman McCall closed the open forum at 7:28 p.m.
6. Presentation of Independent Audit Report
Presented by Randy Jensen, Haynie & Company
Mr. Randy Jensen of Haynie & Company presented the annual audit report for the fiscal year ending June 30, 2013. A copy is included with the minutes as Exhibit “A”. Mr. Jensen indicated that overall this was a positive report and he commended the City Council, Mayor Dunlavy, Mr. Caldwell and Mrs. Wimmer for the operations of the City and for the great job that they do. He said that the City is well managed.
7. PUBLIC HEARING and MOTION on Community Development Block Grant (CDGB) Application Sponsorship

Ms. Baker stated that this is the first public hearing for the Community Development Block Grant (CDGB) Application Sponsorship program. She read a statement into the record for the first hearing with all the information regarding the CDGB Grant. (A copy is included with the minutes as Exhibit “B”.)
Chairman McCall closed the CDGB public hearing at 7:43 p.m.
Councilman Wardle moved that Tooele City has acknowledged and met all the requirements of the Community Development Block Grant (CDGB) Application Sponsorship and have stated all the necessary facts and opened a public hearing. Councilwoman Winn seconded the motion. The vote was as follows: Councilman Pruden, “Aye”, Councilman Wardle, “Aye”, Councilman Pratt, “Aye”, Councilwoman Winn, “Aye”, and Chairman McCall, “Aye”.
8. Resolution 2013-34 a Resolution of the Tooele City Council Amending the Fiscal Year 2013-2014 Budget
Presented by Glenn Caldwell
Mr. Caldwell explained that they need to adjust the 2013-2014 budget. He then outlined the adjustments that needed to be made. A copy of the adjustments is included with the resolution. He also stated that they are going to hire some additional library personnel.
Mayor Dunlavy stated that the Tooele City Library has been a success and usage has gone up drastically over the last few years. There have been a lot of requests from the public for the library to be open more. If the Council approves this resolution the City will hire two more personnel for the library which would then allow the library to be open on Monday’s. They will hire in January for the remainder of the fiscal year and address personnel again during the 2014-2015 budget process next year.

9. Ordinance 2013-21 An Ordinance of the Tooele City Council Establishing its Public Meeting Schedule for Calendar Year 2014

Ms. Pitt stated that they are required by city code to set the dates, time and place of their public meetings for 2014. Tooele City Council meetings will remain on the 1st and 3rd Wednesdays of each month at City Hall, 90 North Main Street, at 7:00 p.m. The dates are as follows:

· February 5 & 19
· March 5 & 19
· April 2 & 16
· May 7 & 21
· June 4 & 18
· July 2 & 16
· August 6 & 20
· September 3 & 17
· October 1 & 15
· November 5 & 19

10. Resolution 2013-04 A Resolution of the Redevelopment Agency of Tooele City, Utah (“RDA)” Establishing its Public Meeting Schedule for Calendar Year 2014

Ms. Pitt explained that they are also required to set the dates, time and place of the Tooele City Redevelopment Agency (RDA) public meetings for 2014. RDA meetings will remain on the 1st and 3rd Wednesdays of each month at City Hall, 90 North Main Street, at 7:00 p.m. with the same dates as listed in the previous agenda item.
Councilman Pruden moved to approve RDA Resolution 2013-04. Councilwoman Winn seconded the motion. The vote was as follows: Councilman Pruden, “Aye”, Councilman Wardle, “Aye” Councilman Pratt, “Aye”, Councilwoman Winn, “Aye” and Chairman McCall, “Aye”.
11. Minutes: Work Session and Business Session November 20, 2013; November 18, 2013 (Canvass)
Councilwoman Winn moved to approve the Tooele City Council Minutes for the meetings held November 18, 2013 and November 20, 2013 as presented. Councilman Pruden seconded the motion. The vote was as follows: Councilman Pruden, “Aye”, Councilman Wardle, “Aye” Councilman Pratt, “Aye”, Councilwoman Winn, “Aye” and Chairman McCall, “Aye”.
12. Invoices

Ms. Pitt presented the following invoice for payment:
· Kilgore Company LLC to resurface the Dow James parking lot in the amount of $50,660.54.
Councilman Pruden moved to approve the invoice as presented by Ms. Pitt. Councilman Pratt seconded the motion. The vote was as follows: Councilman Pruden, “Aye”, Councilman Wardle, “Aye” Councilman Pratt, “Aye”, Councilwoman Winn, “Aye” and Chairman McCall, “Aye”.
13. Adjourn
