We confirm that we are the consignees and the owners of the cargo stuffed into the subject container/s which have arrived per M.V……………………………………………………
under your agency. In consideration of your permitting us to move the subject container/s to our factory premises at ………………………………………………………………………………..
We hereby agree and confirm to undertake transportation of containers/s from ICD/CFS at our cost and risk.We will bear the entire costs of transportation and handling charges for the said container/s from the time of lifting from ICD/CFS premises. In this connection, all formalities with customs/custodian etc will be our responsibility and all costs thereof will be borne by us.
We hereby give our irrevocable undertaking to you as under :
1)We hereby agree and undertake to bring to your notice in writing the damage,if any to the container/s prior to our taking delivery of the same from the ICD/CFS for moving to our aforesaid premises for de-stuffing. In the absence of any written notice of any damage to the container/s, the container/s shall be deemed to have been delivered to us in good order and sound condition.
2)We hereby agree and undertake to return the aforesaid container/sunder survey at the site nominated by you in good order and sound condition within reasonable period of time but in any event not more than 15 days from the date of lifting the container/s from ICD/CFS.
3)We hereby agree and undertake to pay you on demand the amount in respect of any loss/damage sustained by the container/s. In this connection your surveyor’s estimate certifying the loss / damage as well as the amount of loss determined by them shall be final and binding on us even though we may not be present during the survey.
4)We undertake to pay a sum of Rs. 2,71,000 ( Rs. Two Lacs Seventy One Thousand only) per 20’ container and Rs. 5,42,000.00 ( Rs. Five Lac Forty Two Thousand only) per 40’ container which includes the value of the container and customs levy to you on demand in case we fail to return the container/s within the requisite time limit or due to loss of container/s.
5)The empty container will be returned under survey to your nominated site ICD/CFS and necessary receipt will be obtained by us and forwarded to you immediately.
6)We hereby agree and confirm that we are liable to pay you on demand not only for loss or damage sustained by the container/s but also container detention charges as per your tariff or other outstanding charges prior to submission of receipts to you for cancellation of this guarantee.
7)We hereby agree and undertake to indemnify you against all third party claims,costs,charges,expenses and / or liability whatsoever in the event of any loss or damage caused to the property of any person and/or in the event of any injury and / or death caused to any person arising out of the use,operation or possession of your aforesaid containers by us and / or servants and/or by our employees and/or by any person/s and or servants upon having taken delivery of the container/s from the ICD/CFS till the time returned to your nominated site .
