1 Dates of Engagement

2 Fees and Expenses

The Artist will be paid a comprehensive fee of £…….. to include all rehearsals, learning fee, brush-ups, and performances within the stated period. The engagement is made on a season’s basis, and, should cast changes occur, you may be called in for rehearsals on days when we are not performing. There is also the possibility of further performances within the stated period, where theatres take late bookings, or invite the company to perform at short notice.

In addition The Company will organise and pay for all travel to venues outside of the M25, and will decide whether this should be by minibus, train, bus, or private car. Travel will be calculated from central London.

Travel to venues within the M25, to rehearsals, or to central London to join a minibus or train will not be paid. When private cars are the Company’s chosen method of transport a rate of 16p per mile will be paid.

The Company will also provide accommodation after performances when it is not practicable to return to London. Such accommodation will be in small hotels and guest houses, and will be in single occupancy rooms. We will use our best efforts to book rooms with ensuite facilities, but cannot guarantee this.

3 Promotional Activities

Artists may be requested to assist with promotion and events, give short interviews, or meet members of the Press, Radio or TV. Artists may also be called upon to meet supporters of the Company or attend receptions given for the company on tour.

4. Complimentary Tickets

We will use our best efforts to offer the Artist complimentary tickets where they are available, however the number available to the company is decided by the venues. Complimentary tickets should always be arranged through the company and not directly with the venue.

5. Recording

The Company shall inform Equity of any proposal to undertake a sound broadcast, television relay or other such form of re-cording and/or transmission of a performance. The Artist’s fee for such broadcast or recording shall be the subject of a separate agreement between Equity and the broadcasting or recording company concerned. Except that:

The Company may make a video recording of up to 10 minutes completed edited recording of actual performance or rehearsal for the express purpose of demonstrating the nature of the production, and for marketing purposes. The recording may also be supplied for broadcast on terrestrial cable or satellite TV provided this is limited to news access only and no more than 10 minutes of the recording may be used by the broadcaster.

The Company may make a video recording of the complete production for archival, promotional and rehearsal purposes.

6. Photography

The Company may take photographs of the production and may use these to promote the production at any time in the future, whether the Artist remains in the production or not.

7. Equal Opportunities

The parties to this agreement affirm their commitment to a policy of equal opportunity, fair employment and treatment of all individuals in connection with the engagement regardless of age, colour, race, ethnic origin, disability, marital/parental status, gender or sexual orientation.

8. Non-Attendance

N/A’s have been agreed for:

Any post-contractual NAs during the rehearsal or performance period must be mutually agreed in writing before the artist commits to an outside engagement. The Company’s consent shall not be unreasonably withheld.

9. Tax Status

The Artist acknowledges that it is in the intention of the parties that the Artist shall have the status of an independent performer and accordingly shall account to the appropriate authorities in respect of all duties national insurance contributions and arrangements relating to pension sickness and income tax and any other taxation arising on fees payable by the Company. The Artist shall indemnify the Company against any Tax charge levied or imposed on the Company in relation to the services of the Artist rendered to the Company in respect of this agreement.

10. Health and Safety

You should make yourself aware of Health and Safety requirements at each venue you are working at during the contract.

The Artist shall note that personal travel and health insurance is the responsibility of the Artist and that at no time during the engagement either at performance/rehearsal venues or in transit are the Artists’ personal possessions covered by the Company’s insurance. The Company shall not be liable for any loss of the Artists’ personal possessions or effects of any nature or kind during this engagement with the company.

11. Force Majeure

No fee shall be payable for any performance during which any theatre at which the company may or should be performing is closed by reason of Royal demise, national mourning, enemy action, fire, strikes, natural disaster, or by reason of the order of any licensing authority having Jurisdiction, or for any cause beyond the control of the Company.

12. Arbitration

If any disciplinary or grievance issue cannot be resolved internally either part may refer the matter to the Independent Theatre Council for arbitration.
