Dear Sir or Madam,

Hereby I apply to have my claim treated under Article 118 paragraph 1 Bankruptcy act (No. 21/1991).

I further request that the Winding-up Committee as the organiser and moderator of the creditors' meeting bring the above request before the decision making body of Kaupthing's creditors and put it to the vote.

If the Winding-up Committee is not willing to bring my request before the decision making body of Kaupthing's creditors, I alternatively request that I am or my attorney Michael Fortmann is allowed to bring my request before the decision making body of Kaupthing's creditors and put it to the vote.

The reason(s) to have my claim treated in accordance with Article 118 is(are) as follows:

  1. My claim reached the address in time, but it was delivered to the Depositors’ and Investors’ Guarantee Fund (TIF) instead of the Winding-up Committee which both had their offices on the third floor of the Building Borgatun 26 at the time of delivery.

  1. My claim was send out in time but was delivered delayed because the letter was previously misdirected through postal service to Ireland instead of Iceland.

  1. My claim was sent out in time but because of delayed mail processing due to the huge amount of letters directed to the Winding-up Committee it was not delivered in time. My additional advanced send in of the claim by email in time was not acknowledged by the Winding-up Committee.
In contrast to that the Winding-up Committee itself did not meet relevant deadlines set up by the Bankruptcy act (No. 21/1991) due to delay of mail delivery problems, i.e. during the period of sending Notifications about the Decisions on Claims before the beginning of the Creditors meeting. Nevertheless the Winding-up Committee insists in that cases on its decisions being legally acknowledged or are dealt as re-setted in the previous state.
  1. My claim must have reached the Winding-up Committee in time but it is said to have disappeared there since. In contrast to quite a considerable number of claims found later which were mixed up or mislaid at the Winding-up Committee's my claim was not found again.

  1. My claim could not reach the Winding-up Committee in time solely due to my conviction that the Depositors’ and Investors’ Guarantee Fund (TIF) was in charge of making the claim on my behalf.
The Depositors’ and Investors’ Guarantee Fund (TIF) informed me of not feeling responsible any more when it was too late for handing in my claim in time. My application of having my claim treated under the regulation of Article 118 paragraph 2 Bankruptcy act (No. 21/1991) etc. was refused by the Winding-up Committee without giving any reasons, which are based on my individual case.
I request to approve my claim to spare the creditors the cost of unnecessary litigation.

Registration for the Creditors' Meeting convened by the Winding-up Committee of Kaupthing Bank hf. was confirmed with Meeting Identification Number -
Michael Becker (Claim Number 20091223-0164), and Michael Fortmann (Claim Number 20091216-0275) are confirmed as my representatives.
Registration for the third Follow-Up-Creditors' Meeting convened by the Winding-up Committee of Kaupthing Bank hf. was requested, but M.I.N. not received to date.
