“Application Procedures for Purchase/Lease of a Unit”

The attached application form (Purchase or Lease) must be completed in full and submitted to the Management Company who will forward to the Board of Directors for consideration. A copy of the prospective tenant(s) or purchaser(s) Driver’s License(s) or picture ID(s) must accompany the application along with the appropriate fee. A copy of a National Background Check and a credit check must also accompany the application, which must be provided by the realtor or owner.

Reminder: The Board of Directors are to be notified in writing ten (10) days prior to a sales or lease listing advertisement notice.

Unit owner may sell or lease his entire unit in accordance with the following procedures.

A.  Failure to give notice:

Any sale or lease entered into without the application process is in violation of the above provisions and shall be treated as null and void by the Board of Directors. No move in or closing is allowed to take place.

B. Rental of Unit:

No unit may be leased for a term of less than six (6) months. The Board of Directors shall have the right, but not the obligation, to grant a short lease when deemed appropriate. No option for the lessee to extend or renew for any additional period of time shall be permitted without Board approval. No subleasing or assignment of lease rights by the lessee is allowed.

C. The Board of Director’s authority:

Within the guidelines of the uniform and approved Application Form, the Board of Directors shall have the authority to approve or deny all sales and leases. The Board shall have the authority to require such other information from the proposed transferees as is appropriate.

D. Owner and Realtor Responsibilities:

The owner and/or realtor are responsible for getting the information packet from the Management Company and back to them to be submitted to the Board. The packet shall include:

a.  Sales or Lease Application Form

b.  A Receipt Form acknowledging receipt and full understanding of the House Rules, Articles of Incorporation, Bylaws, Declaration of Covenants and Restrictions is to be returned with the application.

c.  Billing and Collection Procedures

d.  ARB Procedure and Form

e.  National Criminal Background and Credit check to be returned with application.

f.  Appropriate fee to accompany application; $50.00 for rentals; $100.00 for sales to be returned with application.

g.  Copy of Driver(s) licenses for lessee(s) or purchaser(s). This is considered a picture ID. If no driver(s) license, picture ID(s) must be presented.

h.  Applicant Background Waiver.

E.  Board of Directors approval/disapproval responsibilities:

a.  The Board is responsible for approval/disapproval of the Lease or Sales Application within thirty (30) days or less, upon receipt of the items listed in “D” above.

b.  A meeting with the prospective transferee(s) will be at the option of the Board.

c.  If the Application is approved/disapproved, it will be signed by the Board and returned to the Management Company.

d.  The Management Company will notify the owner/realtor if the application is approved, if there is a problem, or if the application is rejected.

e.  If approved, files and copies will be returned to the Association, and copies will be sent to the owner, realtor, and transferee(s).

f.  No closing shall take place or tenant be allowed to move in without the proper application requirements being met and approved by the Board.

g.  Fees are non-refundable.

F.  National Background Check includes ALL OCCUPANTS.

a.  Any convictions of a felony involving violence to persons or property, or a felony demonstrating dishonesty or moral turpitude will disqualify any candidate(s) for sale or leasing of a unit.

G.  Credit Check of Transferee(s).

a.  The proposed transferee(s) may make no misrepresentation of the credit check or the establishment of personal financial responsibility during this Application process.

H.  Association Fees and Assessments.

a.  The new owner(s) shall pay any and all back fees not paid by the current owner at time of closing, and agree to pay ongoing fees/or assessments.

b.  The lease of any homeowner with a leased unit shall be cancelled should the homeowner default in paying any association dues or assessments.

c.  The Board may approve the tenant to continue living in the homeowners unit who is not paying their fees or assessments until the end of the current lease, if the tenant pays the dues as required.

I.  Non-Compliance.

a.  Any non-compliance of the terms of this application shall be subject to full legal action.
