Development Contract

This contract is by and between THE UNIVERSITY OF TENNESSEE, acting by and through its Martin campus, (hereinafter referred to as “UTM”), and Employee Name, employee.

WITNESSETH:

WHEREAS, in consideration of Employee Nameagreeing to pursue education terminating in the receipt of a Type of Degree to beconferred by University Name, UTM agrees to pay the tuition and fees net of any scholarships conferred upon Employee NamebyUniversity Nameand in an amount not to exceed $0.00 during the academic terms identified below. Said tuition and fees will be paid directly to University Nameupon receipt of a valid itemized invoice. However, total tuition and fees will not exceed $0.00 during the term of this agreement.

NOW, THEREFORE, in consideration of the mutual covenants hereinafter contained, the parties agree as follows:

Employee Nameagrees to render full-time employment service, with compensation, to UTM for a period of two months for every month awarded under this Contract, commencing at the completion of the degree as herein described.

Employee Nameagrees to reimburse UTM the total amount of pro rata portion of the award under this Contract plus interest at the rate of six (6) percent per year should Employee Namefail to continue employment with UTM for the period stated in this contract. Reimbursement shall be made within a reasonable time and in no event later than sixty (60) days after notice is given to UTM by Employee Name(either by communication or by failure to report for employment) of intent to withhold services. Employee Namefurther agrees to pay all attorney’s fees and other reasonable collection costs and charges necessary for the collection of any amount not paid when due.

UTM reserves the right to terminate the employment of Employee Namewith the stipulation that the financial obligation of Employee Nameto UTM is cancelled, unless such termination is for cause. Any termination shall be in accordance with University policies and procedures as applied to termination of any faculty/staff member, without regard to leave status.

In the event Employee Nameterminates his/her employment with UTM prior to degree completion, the financial obligation of UTM under this contract will be terminated immediately and Employee Namewill owe all fees paid to University Name.
