1.  ROLL CALL.

Chairman Erdmann called the meeting to order at 9:00 a.m. with 30 members present.

Others present: Corporation Counsel Kordus, Administrative Coordinator Pascarella, County Clerk Bohm, Finance Director Rusch, Jail Administrator Borroughs, Pat Fritz, and several others.

2. SILENT MEDITATION AND PLEDGE OF ALLEGIANCE.

Chairman Erdmann requested a moment of silent meditation and asked that we remember all of our military troops serving our country during this time and for the families waiting at home. The Pledge of Allegiance followed.

3. APPROVAL OF THE JANUARY COUNTY BOARD MINUTES.

Motion by Zwirschitz, seconded by Wnek to approve the January County Board minutes. Motion prevailed by acclamation.

4. PUBLIC COMMENTS

None

5. CHAIRMAN’S REPORT

Chairman Erdmann stated that the WCA Regional Legislative District meeting has been rescheduled for Monday, March 14th, at 1:00 p.m. at the Menominee Casino Conference Center. The main topic will be the proposed Budget Repair Bill.

6. PETITIONS AND COMMUNICATIONS TO THE COUNTY BOARD.

None to report.

7. MOTION TO DEVIATE FROM THE ORDER OF THE AGENDA, IF NECESSARY.

Motion by D. Noffke, seconded by Young to deviate when necessary. Motion prevailed by acclamation.

8. RESOLUTION NO. 6-11 THANKING PATRICIA FRITZ FOR 38+ YEARS OF SERVICE TO THE RESIDENTS OF SHAWANO COUNTY

WHEREAS, Jailer Patricia Fritz began her law enforcement career with the Shawano County Sheriff’s Department the Fall of 1972 as a part-time Matron in the Jail Division; and

WHEREAS, Patricia Fritz became a full-time Jailer on January 1, 1986; and

WHEREAS, Patricia Fritz has given almost 39 years to protecting the lives, security and property of the inmates of the Shawano County Jail; and

WHEREAS, Patricia Fritz has been a devoted employee to Shawano County; and

WHEREAS, Patricia Fritz retired from the Sheriff’s Department, Jail Division, on January 14, 2011.

NOW, THEREFORE, BE IT RESOLVED BY THE SHAWANO COUNTY BOARD OF SUPERVISORS in session this 23rd day of February, 2011, that the County of Shawano publicly thanks Jailer Patricia Fritz for over 38 years of service to the residents of Shawano County.

PUBLIC SAFETY COMMITTEE

Motion by Capelle, seconded by Gueths to adopt Resolution No. 6-11. Jail Administrator Steve Borroughs addressed the board and congratulated Pat Fritz on a great job. A letter from the Sheriff expressing congratulations as well was read. Pat briefly addressed the board and thanked the board for letting her serve the residents of the county. She stated that she has seen many changes through the years and worked for many Sheriffs’. A certificate of appreciation was given to Pat.

Resolution No. 6-11 adopted 30 yes, 0 no, 0 absent.

9. IT IS ANTICIPATED THAT A MOTION WILL BE MADE AND SECONDED TO GO INTO CLOSED SESSION PURSUANT TO SECTION 19.85(1)(C) OF THE WISCONSIN STATUTES TO DISCUSS EMPLOYMENT ISSUES CONCERNING THE POTENTIAL APPOINTMENT OF THE NEW PUBLIC HEALTH OFFICER.

Roll Call vote was taken, all supervisors voting yes.

10. IT IS ANTICIPATED THAT A MOTION WILL BE MADE AND SECONDED TO COME OUT OF CLOSED SESSION, ADDRESS AN ISSUES NECESSARY ARISING OUT OF THE CLOSED SESSION IF NECESSARY, AND CONTINUE WITH THE AGENDA DISCUSSION AND POSSIBLE ACTION TO APPOINT NEW PUBLIC HEALTH OFFICER.

Roll call vote with all supervisors voting yes.

11. RESOLUTION NO. 7 -11 TO APPOINT VEERINDER (VINNY) TANEJA AS THE HEALTH OFFICER/DIRECTOR OF PUBLIC HEALTH

WHEREAS, the position of Health Officer/Director of Public Health became vacant through the retirement of Jan Lewellyn; and

WHEREAS, the position was advertised, following which 8 applications were received, and 3 applicants were interviewed; and

WHEREAS, pursuant to Chapter 251 of the Wisconsin Statutes, the Health Officer/Director of Public Health shall be appointed by the Chairperson of the County Board of Supervisors, subject to confirmation by the County Board of Supervisors; and

WHEREAS, Veerinder (Vinny) Taneja has been appointed the new Health Officer/Director of Public Health for Shawano County; and

WHEREAS, Mr. Taneja graduated from Eastern Kentucky University with a Master’s degree of Public Health, Majoring in Community Health, and was previously employed as an Epidemiologist with the City of Milwaukee; and

WHEREAS, Mr. Taneja has accepted the position of Health Officer/Director of Public Health, subject to confirmation by the County Board of Supervisors.

NOW, THEREFORE, BE IT RESOLVED BY THE SHAWANO COUNTY BOARD OF SUPERVISORS in session this 23rd day of February, 2011, that it confirms the appointment of Veerinder (Vinny) Taneja as the new Health Officer/Director of Public Health for Shawano County, with a starting date of March 31, 2011.

BE IT FURTHER RESOLVED that the County will pay Mr. Taneja an annual salary of $76,000, based on Grade 25 of the County non-represented pay plan.

BE IT FURTHER RESOLVED that, in addition, the County will pay Mr. Taneja a $4,500 lump sum payment to help defray costs associated with COBRA, moving, etc., and that 112.5 hours will be placed in his PTO bank at the start of his employment with the County, and thereafter, for PTO purposes, Mr. Taneja will be considered at year 5 of employment, and will accrue PTO at the .1188 multiplier.

12. RESOLUTION NO. 8-11 TO APPROVE THE FIXED BASE OPERATOR’S AGREEMENT BETWEEN THE SHAWANO CITY-COUNTY AIRPORT COMMISSION AND SHAWANO FLYING SERVICE

WHEREAS, pursuant to § 114.11, Wis. Stats., the Shawano City-County Airport Commission is authorized to operate and manage the Shawano City-County Municipal Airport, which includes aeronautical navigation facilities; and

WHEREAS, the Shawano City-County Airport Commission desires to lease to Shawano Flying Service certain premises located on said airport, as described in the attached agreement; and

WHEREAS, Shawano Flying Service wishes to lease the premises for the purpose of, among other things, engaging in the business of selling gasoline, oil and other lubricants, maintaining and operating full aircraft servicing facilities, selling aircraft, accessories and parts, providing storage space for aircraft, repairing and servicing aircrafts, giving flying instructions, and carrying passengers and freight for hire, all as set forth in the attached agreement; and

WHEREAS, the Airport Commission has requested that the City of Shawano and Shawano County approve the agreement.

NOW, THEREFORE, BE IT RESOLVED BY THE SHAWANO COUNTY BOARD OF SUPERVISORS in session this 23rd day of February, 2011, that it approves the attached Fixed Base Operator’s Agreement between the Shawano City-County Airport Commission and Shawano Flying Service.

CITY-COUNTY AIRPORT COMMISSION

FISCAL NOTE: Establishes an agreement between Shawano Flying Services, Inc and the Airport Commissions for payments of $605 per month which is utilized to fund the Airport budget.

Motion by Zwirschitz, seconded by M. Noffke to adopt Resolution No. 8-11.

Comments by Olson stating that this was basically for information only and in the past had never been brought before the County Board. Further comments by Hoppe, Corporation Counsel Kordus, D. Noffke and Krause.

Motion by Krause, seconded by Steinke to table indefinitely. Resolution No. 8-11 was tabled indefinitely by a vote of 28 yes, 2 no, 0 absent. All supervisors voting yes, except Stern and M. Noffke.

The County Board thanked the Commission for bringing the matter to the County Board’s attention for its awareness and that acknowledged that the Commission is free to proceed.

The Fixed Base operator’s agreement is on file in the Clerk’s office and used for information only.

13. RESOLUTION NO. 9-11 TO AUTHORIZE THE PURCHASE OF PROPERTY NECESSSARY FOR THE OPERATION AND IMPROVEMENT OF THE CITY-COUNTY AIRPORT

WHEREAS, on November 15, 2006, the Shawano County Board passed Resolution 95-06 which authorized the Shawano City-County Airport Commission (“Commission”) to petition the applicable state and federal agencies for funding necessary to improve the Shawano City-County Airport (“Airport”) including, among other things, to purchase land necessary to facilitate Airport operations; and

WHEREAS, in particular, Resolution 95-06 generally authorized petitioning for funding to purchase land off the southeast end of the primary runway to facilitate the improvement and operation of the Airport; and

WHEREAS, thereafter, the Commission diligently went about petitioning the applicable agencies for funding and has secured the funding necessary to submit an offer to purchase the roughly 9.5 acres of land off the southeast end of the primary runway now owned by WE Inc. (which is owned by Jim Zierden and Randy Bohm) and formerly known as the Gillett Cement property (“Property”) as set forth on the attached survey map; and

WHEREAS, the Commission seeks the approval of Shawano County for the purchase of the Property that will be titled jointly in the name of the City of Shawano and Shawano County similar to the other Airport property, and the purchase of the Property would be in the amount of $52,000, at no cost to Shawano County whatsoever.

NOW, THEREFORE, BE IT RESOLVED BY THE SHAWANO COUNTY BOARD OF SUPERVISORS in session this 23rd day of February, 2011, that it approves the purchase of the property off the southeast end of the primary runway at the City-County Airport now owned by WE Inc. (and formerly known as the Gillett Cement Factory Property), provided the Property is titled jointly in the name of the City of Shawano and Shawano County, and the purchase would be in the amount of $52,000 at no cost to Shawano County.

BE IT FURTHER RESOLVED that Wisconsin Secretary of Transportation is appointed to act as the owners agent in acquiring this land, which includes the exercise of eminent domain authority.

BE IT FURTHER RESOLVED that Shawano County shall be provided a copy of the Offer to Purchase document.

FINANCE COMMITTEE

Motion by Hoppe, seconded by Gallagher to adopt Resolution No. 9-11. Comments regarding fencing, price, size of area, etc. by Ainsworth, Hoppe, Steinke, Tober, Erdmann, Krause, and Olson. Resolution No. 9-11 adopted 29 yes, 1 no, 0 absent. All supervisors voting yes except Ainsworth.

14. RESOLUTION NO. 10-11 TO REDUCE THE SIZE OF THE COUNTY BOARD FROM 30 TO _?__

WHEREAS, § 59.10(3), Wis. Stats., provides that counties, such as Shawano County, with a population of less than 50,000 but greater than 25,000 shall have up to 31 supervisors; and

WHEREAS, Shawano County has chosen to utilize a districting system which provides for the implementation of 30 supervisors and 30 supervisory districts, however, the County Board may decrease the number of supervisors and supervisory districts as it sees fit; and

WHEREAS, pursuant to § 59.10(3), Wis. Stats., adjustments to the number of supervisory districts must be evaluated every ten years after the decennial federal census is computed to ensure that the districts are divided equally based upon population and other factors to guarantee citizens equal representation under the law; and

WHEREAS, the decennial federal census will not be received until after the election of supervisors in April of 2010 effective for the April 2010 to April 2012 term; and

WHEREAS, effective for the April 2012 election of supervisors, in conjunction with the evaluation of the supervisory districts required under § 59.10(3) noted above, the Administrative Committee recommends that the number of supervisory districts and corresponding number of supervisors shall be reduced from 30 to __ in order to better streamline the management of county business and to reduce the costs of such management.

NOW, THEREFORE, BE IT RESOLVED BY THE SHAWANO COUNTY BOARD OF SUPERVISORS in session this 23rd day of February, 2011, that effective for the election of supervisors for the April 2012 election, the size of the Shawano County Board of Supervisors and corresponding number of supervisory districts shall be reduced from 30 to ?.

ADMINISTRATIVE COMMITTEE

Motion by Olson, seconded by Steinke to adopt Resolution No. 10-11. Chairman Erdmann stated that the Redistricting will be done in 2011 based on the 2010 Census numbers. New districts need to be drawn every 10 years based on population. If the board desires to decrease the size of the board, now would be the time. Comments regarding membership by Tober, Krause, Gueths, Hoppe, Steinke, Martell, Powers, Gallagher, and D Noffke. Many board members wanted to wait until April when the official census numbers are available before making the decision on size. The Administrative Committee felt that the entire board should decide on the size and that is why no particular number was inserted at this time. Further comments on the number of members by Krause, D. Noffke, McClelland, Knaak, and Corporation Counsel Kordus.

Motion by Martell, seconded by Krause to refer Resolution10-11 to the newly created Redistricting Committee to analyze and recommend to the County Board the number of supervisors that the County Board should be made up of, with consideration of the ramifications to possible changes in committee size and structure. This shall be done no later than the April County Board meeting. Motion to refer to Redistricting Committee adopted 29 yes, 1 no (Ainsworth), 0 absent.
