CITY COUNCIL MINUTES

December 2, 2103

The regular meeting of the Underwood City Council was called to order at 7:00 p.m. Person present were Paul Hoff, Jim Erpelding and Marilyn Olson. Also present was Anna Kiser and Anita Gumphrey. Bert Kinzler, Rick Jacobson and Paxton Lind were absent. Guest was Matt Dreschel.

The agenda and minutes were approved by motion of Olson, second by Erpelding.

Paul asked Mr. Dreschel to address the council. Matt was concerned about the decision to make a portion of the Burlington Northern Subdivision a bike/walking path. As there would be no motorized vehicles allowed he would not have access from the back (south) of his property to the garage. He feels that he should be grandfathered in as the structure and use have been there for a number of years. He also mentioned that he had spoken with Rick Jacobson about filling a portion of his property to gain access from the street (Woodland Ave.) side of his property. After some discussion, it was decided to table that matter until the January 6 meeting when, weather permitting, all the council members will be in attendance.

RESOLUTION #1213-1

RESOLUTION APPROVING FINAL 2014 TAX LEVY

BE IT RESOLVED, by the City Council of the City of Underwood, County of Otter Tail, State of Minnesota, that the following sums of money be levied and collected in the year 2014, upon taxable property in the City of Underwood, for the following purposes:

GENERAL REVENUE$84,062.00

FIRE 12,561.00

TOTAL LEVY$96,623.00

Adopted by the City Council of Underwood, Minnesota on this the 2nd day of December 2013.

Ann informed the council that the City had received the bill from Otter Tail Highway Department for the 2013 seal coat project. The final bill is $15,130.38, over the original estimate of $10,750.52 by $4,379.86. She had called Chuck Grotte and spoke to him about the increase and was informed that a letter was sent in May revising the estimate and asking if the city wanted to continue. We did not receive the letter. A motion by Hoff, second by Erpelding to approve the payment for seal coating in the amount of $15,130.38 was approved. Paxton is looking into another source for this work.

A motion by Olson, second by Erpelding to transfer $10,000 from the liquor fund to the general fund was approved.

A motion by Erpelding, second by Olson was approved to pay the 2014 membership dues of $84.00 to Lakes Country Service Cooperative.

Street, Lighting, Parks, & Recreation (Hoff, Erpelding)

Paul addressed the council regarding selling lots 1, 2 and 3 of the Burlington Northern Subdivision, which are adjacent to property owned by Orval and Shirley Brenaman and Ken & Michelle Jevne. After some discussion, a motion by Hoff, second by Erpelding to offer the lots to the Brenamans and Jevnes for the original price of 18¢ per square foot was approved. Ann will send a letter.

Paul also informed those present that the school is again looking at the old ball park as a location for a new bus garage. The alley (signed as Athletic Avenue, but not platted as a street) would not be necessary for the school project. He is asking for approval to sell the land to the adjacent property owners. After some discussion, a motion by Erpelding, second by Olson was approved to offer the property to adjoin land owners for 18¢ a square foot. Ann will send a letter.

After some discussion, it was decided that the city would not be part of Otter Tail County’s seal coat project for 2014.

Personnel & Safety (Olson, Erpelding)

Anita addressed the council, asking that he holiday pay for part time help at the liquor store be reinstated at the time and a half that was in place before. It was decided to table this issue until January.

NEW BUSINESS

A motion by Erpelding, second by Olson was approved to not waive monetary limits on municipal tort liability established by MN §466.04.

RESOLUTION #1213-2

A RESOLUTION TO APPROVE THE RENEWAL OF LIQUOR LICENSES

BE IT RESOLVED by the City Council of the City of Underwood, County of Otter Tail, State of Minnesota that the renewal of the liquor licenses for the American Legion, Stockman’s Tavern, and Under-Mart be approved contingent upon the receipt to the City Clerk before 3:30 p.m. on December 31, 2013 the following:

1. Proof of insurance

2. Payment of license fees

3. Certificate of Compliance

The fee schedule was reviewed. A motion by Erpelding, second by Olson was made to maintain the current schedule for 2014.
