PROCEEDINGS :(1)Based on the 12(3) settlement dt.10.08.07 signed before the Commissioner of Labour, the TNEB issued orders for revival of the post of Mazdoor and for absorption of contract labourers who have worked continuously in Distribution Circles, General Construction Circles and Wind Energy Development Circles as Mazdoor, Helper cum Meter Reader and Assessor Grade - II in a phased manner vide B.Ps. read above. As per these orders, the contract labourers whose qualification is below 10th standard and 'nil' qualification have been appointed to the post of Mazdoor vide B.P. (3) read above.
(2)Further as per the said settlement, the Board has also issued orders prescribing 2 years of service to the Mazdoors for their next promotion vide B.P. (4) read above.
(3)The above said settlement was challenged by the unions in the Hon'ble High Court/ Madras and then in the Hon'ble Supreme Court. Finally the Divisional Bench of the Hon'ble High Court/ Madras have passed orders in W.P. No.1302 dt.24.10.08 among other things upholding the settlement into.
(4)However, various unions in the TANGEDCO have represented to consider the promotion of the Mazdoor appointed as per 12(3) settlement as provided in the settlement. The representation of the Unions have been carefully examined by the TANGEDCO.

The qualification of NTC/ NAC for the post of Helper was prescribed vide B.P. (FB) No.38 dt.23.05.86 and the amendment to Service Regulation 94 (a) of Tamil Nadu Electricity Board Service Regulation was also issued. Subsequently, the issue of the revised qualification of NTC/NAC for the post of Helpers was taken up by the Unions in the High Court and then in the Supreme Court. The Supreme Court appointed Justice Khalid Commission to examine the matter and give its report. The Justice Khalid Commission gave its report dt.11.12.91 in the SLP No. 1820/90 and the same was issued by the Supreme Court. Thus the report of Justice Khalid Commission became the order of Supreme Court.
5)Prior to the 12 (3) settlement the initial level category in RWE is Helper and the earlier absorption of contract labourers as per the Justice Khalid Commission's report and as per the orders of the Board was therefore made to the post of Helper. However, due to acute financial stringency and due to administrative reasons the TNEB passed orders for revival of the post of Mazdoor in a lesser scale of pay and to consider them for promotion after 2 years service. Therefore the Mazdoor appointed as per the 12 (3) settlement are eligible to be considered for promotion to the post of Helper.
6)In its report Justice Khalid Commission has observed that the workers who had worked for 2 years and more have experience to do the work expected of the skilled helpers and that the experience will compensate for the qualification prescribed. Accordingly, as per Justice Khalid Commission's report the Board has regularized the service of 13,054 contract labourers in a phased manner from 1991 to 31.03.98 by relaxing the rules relating to educational qualification and age.
7)In the 22nd Board meeting of TANGEDCO Ltd., held on 06.03.12, the Board has considered the representation of the unions to consider the promotion to the post of Mazdoor sympathetically and approved the proposal for the relaxation of rules relating to qualification of NTC/ NAC in favour of Mazdoors for promotion to the post of Helper in a phased manner and accordingly 6,593 Mazdoors as Helper (Field Assistant) in the first phase who are working in Distribution Circles, General Construction Circles and Wind Energy Development Circles
8)Accordingly, the TANGEDCO hereby direct that the 6,593 Mazdoors appointed during the year 2005 to 2007 as mentioned in the Annexure shall be promoted as Helper (Field Assistant) in the first phase in the time scale of pay of Rs.5,400 - 20,200 + 1,900 G.P if they are or otherwise suitable.
9)The TANGEDCO also have decided that consequent on promotion of Mazdoors, the 6,593 post of Mazdoors shall be abolished.

11)The Superintending Engineers are informed that the no. of Mazdoors appointed during the year 2005 and 2007 are furnished in the Annexure enclosed.
(12)The receipt of this B.P. should be acknowledged.
