StreetandAlleyClosingProcess
Inordertomeetalllegalrequirementsregardingclosingastreetoralleyorabandoning a publicright-of-way,petitioner(s) may wish to employ legal counsel and/or the services of a licensed professional surveyor.ThiswillalsoassurepropertyownersofcleartitletothepetitionedpropertyiftheCityCouncilchoosestoadoptaresolutiontoclosethestreet.
Oncethepetitionhasbeenreceived,theOfficeofTransportationPlanningwillcoordinateareviewoftheproposedstreetclosingwithotherCityDepartments and local utility companies.CityAdministrationwillmakearecommendationtotheCityCouncil.TheCouncilwillholdapublichearing,andthendecideiftheclosingisinthepublicinterest.Iftheydeterminethatitis,theywillpassaresolutionclosingthestreetoralley.
Atthistime,theabuttingpropertyownersmaysubmitrecombinationplatsshowingthenewpropertylinestoPlanningandDevelopment,whereintheywillbeauthorizedforrecordingintheWakeCountyRegisterofDeedsoffice.

N.C.G.S.160A-299ProcedureforPermanentlyClosingStreetsandAlleys
a / Whenacityproposestopermanentlycloseanystreetorpublicalley,thecouncilshallfirstadoptaresolutiondeclaringitsintenttoclosethestreetoralleyandcallapublichearingonthequestion.Theresolutionshallbepublishedonceaweekforfoursuccessiveweekspriortothehearing,acopythereofshallbesentbyregisteredorcertifiedmailtoallownersofpropertyadjoiningthestreetoralleyasshownonthecountytaxrecords,andanoticeoftheclosingandpublichearingshallbeprominentlypostedinatleasttwoplacesalongthestreetoralley.IfthestreetoralleyisundertheauthorityandcontroloftheDepartmentofTransportation,acopyoftheresolutionshallbemailedtotheDepartmentofTransportation.Atthehearing,anypersonmaybeheardonthequestionofwhetherornottheclosingwouldbedetrimentaltothepublicinterest,orthepropertyrightsoftheindividual.Ifitappearstothesatisfactionofthecouncilafterthehearingthatclosingthestreetoralleyisnotcontrarytothepublicinterestandthatnoindividualowningpropertyinthevicinityofthestreetoralleyorinthesubdivisioninwhichitislocated wouldbetherebydeprivedofreasonablemeansofingressoregresstothisproperty,thecouncilmayadoptanorderclosingthestreetoralley.Acertifiedcopyoftheorder (orjudgementofthecourt)shallbefiledintheofficeoftheregisterofdeedsofthecountyin whichthestreetoranyportionthereof, islocated.
