SEMEN BREEDING CONTRACT
Mare Owner/LESSEE hereby agrees to breed their mare ______Reg No. ______Age ______to _Gunnit_____ standing at Tanya Jenkins Performance Horses, utilizing (CIRCLE ONE: cooled shipped, Fresh on premises, Frozen) semen and paying a stallion services fee of $____1000.00________which included a non-refundable booking fee of $__500____. The booking fee is due and payable with this signed contract which will reserve for the mare owners a breeding during the month of ______for the 2018 breeding season.
Prior to shipment, the Mare Owner must pay the following: Booking Fee, Stud Fee. A Chute Fee of $___350_____ plus the cost of shipping via Federal Express, air freight or courier must be paid to TJPH prior to each shipment. Rebreeds or any additional shipments will be____$250___ each. Total shipping costs greater than $400.00 will be discussed with Mare Owner or designated mare manager prior to shipment(s). Mare Owner agrees to purchase for $45.00 an EST Disposable Shipping Container. The container can be returned and reused during the 2018 breeding season or until the above mentioned mare has been declared “in foal”.
At Mare Owner’s request a hard plastic container (equitainer or EST XL container) may be substituted as a shipping container and the Mare Owner agrees to return this container within 48 hours of initial delivery at Mare Owners expense, a $25.00 per day fee will be charged for each day over four days from the shipment date the container has not been returned up to $300. A $300 fee will be charged ifthe container is not returned.
____Gunnit______ will be collected Monday, Wednesday and Friday during the breeding season (February 1st through July 15th). Cooled semen shipments on Saturday and Sunday will only be by Air Freight. No warranty or guarantee express or implied is given. No guarantee of delivery within neither a certain time period nor the quality of the semen at arrival is given.
The Mare Owner agrees to furnish a copy of the mare’s registration papers, shipped semen forms and other information as the stallion manager requests. The Mare Owner represents the mare is healthy and in breeding condition so as to conceive and carry a foal to term. The mare is registered with the designated registration organization. Mares older than 16 years of age must have a current signed veterinary certificate of reproductive soundness.
This contract provides for a return breeding in the succeeding year only, for a mare (or agreed upon substitute) that fails to produce a live foal. This may be satisfied at the sole option of TJPH by 1) shipping semen or 2) require the rebreeding be performed at TJPH. TJPH shall be notified in writing within 10 days and sent a veterinary certificate from the attending veterinarian. Failure to attend foaling voids guarantee.
The Mare Owner agrees to use the semen shipped solely to breed the designated mare in accordance with this breeding contract and registry rules.
It is further agreed that should the stallion die or become unfit for service, frozen semen may be made available to satisfy the terms of this contract. The location for breeding, the number of doses used per breeding and the number of breeding attempts using frozen semen from ______shall be at the sole option of TJPH.
The Mare Owner agrees to inform TJPH of the presence of multiple embryos by day 18 post semen shipment. Failure to notify, failure to complete a contract, and or failure to pay for each subsequent stud fee, the stallion owner reserves the right to deny release of multiple breeder certificates for a donor mare with multiple embryos in one given year.
When Mare Owner or the authorized representative signs and returns this contract to TJPH it will be a binding contract on both parties subject to the above terms and conditions. This contract is not transferable or assignable. The Mare Owner/Lessee agrees that interest of 1.5% will be charged on all accounts that are 30days past due. The Mare Owner/Lessee agrees to pay all reasonable attorney fees incurred by TJPH in attempting to collect any outstanding balance owed.
