Control of Goods (Price Control) (Amendment) Order, 2007 (No. 11)

IT is hereby notified that the Minister of Industry and International Trade has, in terms of section 5 of the Control of Goods (Price Control) Regulations, 2001. published in Statutory Instrument 334 of 2001, made the following order:

1.This order may be cited as the Control of Goods (Price Control) (Amendment) Order, 2007 (No. 11).

2.Section 2 ("Interpretation") of the Control of Goods (Price Control) Order, 2003, published in Statutory Instrument 125 of 2003 ((hereinafter referred to as "the principal order"), is amended by the repeal of "base date" and the substitution of —

"base date" means the 18th of June, 2007;".

3.Section 7 of the principal order is repealed and the following is substituted—

Prices of other specified essential commodities

7.(1)The base price of any commodity shall, after consultation between the Minister and the manufacturer thereof, be fixed by reference to the costs of production thereof as at the base date, subject to periodical reviews as and when production costs increase:

Provided that no base price shall be fixed without the Minister's express written approval, which approval shall not be unreasonably withheld or delayed.

(2)Price increases effected or mark-ups applied by a manufacturer, wholesaler or retailer on any commodity which exceed—

(a)those applied at the base date; or

(b)twenty per centum of the base price of that commodity at any time;

must be approved by the Minister in writing.

(3)The approval of the Minister referred to in subsections (1) and (2) shall be communicated to the manufacturer, wholesaler or retailer in writing, by any official delegated by him or her.

(4)Every manufacturer of any commodity shall print or attach an adhesive label clearly exhibiting the selling price, per unit, of commodities, directly on the packaging materials of such commodities.

(5)Apart from the price increase or mark-up, where the wholesaler or retailer collected the commodity concerned for resale at any outlet situated forty kilometres or more from the point of collection, a transport allowance not exceeding twenty per centum of the base price of that commodity at any time may be charged.".

4.Part III and Part IV of the First Schedule to the principal order is repealed and the following is substituted—

5.The Fifth Schedule to the principal order is amended by the addition of item 7—

"17.Until the 1st of August, 2007, all other goods of any description whatsoever and any services relating to the distribution, disposal, purchase and sale of the goods.".

6.The Control of Goods (Price Control) (Amendment) Order, 2007 (No. 10), published in Statutory Instrument 101A of 2007, is repealed.
